Now Donald Trump\u2019s EPA appears poised to continue the appeal process rather than following the court order calling on the agency to take action against the risks posed by fluoridation chemicals.<\/p>\n\n\n\n<p>The order was issued in September 2024 as a result of a nearly decade-long legal battle between the EPA, and parents of children impacted by water fluoridation, as well as the\u00a0<a href=\"https:\/\/www.thelastamericanvagabond.com\/michael-connett-interview-2-5-24\/\" target=\"_blank\" rel=\"noreferrer noopener\">Fluoride Action Network<\/a>\u00a0(FAN). Judge Edward Chen found that fluoridation of water at 0.7 milligram per liter\u00a0<em>\u201cposes an unreasonable risk of reduced IQ in children\u201d.\u00a0<\/em>Chen said the risk is sufficient to require the EPA to enact a regulatory response.<\/p>\n\n\n\n<p>The judge said he only had the authority under the Toxic Substances Control Act (TSCA) to direct the EPA to take action against the risk, but not to prescribe the specifics of its response, which could range from a national warning to an outright ban.<\/p><div class=\"g g-1\"><div class=\"g-single a-23\"><a class=\"gofollow\" data-track=\"MjMsMSwxLDYw\" href=\"https:\/\/event.webinarjam.com\/register\/233\/wm1xna0z\" target=\"_blank\"><img loading=\"lazy\" width=\"850\" height=\"500\" decoding=\"async\" src=\"https:\/\/www.activistpost.com\/wp-content\/uploads\/2025\/05\/privacy-academy-photo_2025-05-16_14-29-29-1.jpg\"\/><\/a><\/div><\/div>\n\n\n\n<p>Supporters of Donald Trump and Robert F. Kennedy\u2019s MAHA (Make America Healthy Again) movement have hoped that Judge Chen\u2019s ruling would be followed by the new administration, especially in light of Kennedy\u2019s vocal opposition to water fluoridation.<\/p>\n\n\n\n<p>In early April, Kennedy and EPA Administrator Lee Zeldin\u00a0<a href=\"https:\/\/www.epa.gov\/newsreleases\/epa-will-expeditiously-review-new-science-fluoride-drinking-water\" target=\"_blank\" rel=\"noreferrer noopener\">announced the agency\u2019s decision<\/a>\u00a0to expeditiously review new scientific information on potential health risks of fluoride in drinking water. Kennedy also said he would instruct the Centers for Disease Control and Prevention (CDC) to stop promoting water fluoridation.<\/p>\n\n\n\n<p>\u201cWithout prejudging any outcomes, when this evaluation is completed, we will have an updated foundational scientific evaluation that will inform the agency\u2019s future steps to meet statutory obligations under the Safe Drinking Water Act,\u201d Zeldin said at the time.<\/p>\n\n\n\n<p>Notably, Zeldin and Kennedy did not mention the fluoride lawsuit in their press release or during their press conference.<\/p>\n\n\n\n<p>Michael Connett, the lead attorney representing the Fluoride Action Network and other plaintiffs in Judge Chen\u2019s court, commended Kennedy for ending the CDC recommendation of fluoride, but said the EPA does not need to conduct further reviews of fluoride.<\/p>\n\n\n\n<p>\u201cWhat we need the EPA to do is follow the court\u2019s order from last year. Where the court ordered the EPA to implement a rule-making proceeding to eliminate the unreasonable risk posed by adding fluoridation chemicals to drinking water,\u201d Connett told\u00a0<em>The Last American Vagabond<\/em>. \u201cThe court didn\u2019t ask EPA to do another review of the science. The court ordered the EPA to take action.\u201d<\/p>\n\n\n\n<p>Connett said previous EPA reviews of fluoride have been \u201cinadequate and superficial\u201d. He worries that the EPA will take years to conduct another review, but in the end arrive at a\u00a0<em>\u201cpreordained conclusion that will not result in changing current water fluoridation practices in the United States.\u201d<\/em><\/p>\n\n\n\n<p>Connett may be correct.<\/p>\n\n\n\n<p>In recent weeks the Trump administration has sought and received two extensions to allow more time to decide whether or not the EPA will continue the appeal process started by the Biden admin.<\/p>\n\n\n\n<p>On May 7th, the 9th Circuit Court of Appeals granted a\u00a0<a href=\"https:\/\/www.thelastamericanvagabond.com\/wp-content\/uploads\/2025\/05\/Fluoride-ruling-May-9th.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">30-day extension<\/a>\u00a0for the filing of an opening brief. This extension came only days before the EPA was\u00a0<a href=\"https:\/\/news.bloomberglaw.com\/environment-and-energy\/epa-allowed-extra-month-to-craft-path-forward-on-fluoride-appeal?context=search&amp;index=2\" target=\"_blank\" rel=\"noreferrer noopener\">due to provide an update on May 12th<\/a>. The Trump administration now has until June 11th to decide whether to continue the appeal or respect the court\u2019s ruling.<\/p>\n\n\n\n<p>\u201cThe Solicitor General has not yet made a decision regarding whether to pursue this appeal. A 30-day extension is warranted to give him sufficient time to provide thoughtful consideration regarding whether and what issues to appeal,\u201d\u00a0<a href=\"https:\/\/www.thelastamericanvagabond.com\/wp-content\/uploads\/2025\/05\/Fluoride-ruling-May-9th.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wrote attorney Michelle Melton<\/a>\u00a0in her extension filing. She said the government needed more time because the case involves \u201clengthy trial records, and extensive and complex scientific materials\u201d.<\/p>\n\n\n\n<p>Melton is with the\u00a0<a href=\"https:\/\/www.justice.gov\/enrd\/appellate-section\" target=\"_blank\" rel=\"noreferrer noopener\">Appellate Section of the Environment &amp; Natural Resources Division<\/a>\u00a0within the U.S. Department of Justice. The Appellate Section represents the federal government in federal and State appellate courts, and works closely with the Office of the Solicitor General in determining whether to appeal court decisions.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-the-solicitor-general-will-make-the-decision\"><strong>The Solicitor General Will Make the Decision<\/strong><\/h4>\n\n\n\n<p>As Melton noted, the final decision appears to be in the hands of U.S. Solicitor General. As of April 2025, the\u00a0<a href=\"https:\/\/www.justice.gov\/osg\/staff-profile\/solicitor-general-john-sauer\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. Solicitor General is D. John Sauer<\/a>, the former Solicitor General of Missouri from 2017 to 2023.<\/p>\n\n\n\n<p>Sauer is most well known for being the lawyer who represented Trump in his successful appeal to the U.S. Supreme Court in\u00a0<em>Trump v. United States<\/em>. In that case, Sauer argued that U.S. Presidents have broad immunity for actions taken while in office, including\u00a0<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4398223-trump-team-argues-assassination-of-rivals-is-covered-by-presidential-immunity\/\" target=\"_blank\" rel=\"noreferrer noopener\">ordering SEAL Team 6 to assassinate political rivals<\/a>.<\/p>\n\n\n\n<p>\u201cCould a president who ordered SEAL Team 6 to assassinate a political rival, who was not impeached, would he be subject to criminal prosecution?,\u201d a judge asked Sauer in January 2024. Sauer responded with a \u201cqualified yes\u201d, noting that a President would first \u201chave to be impeached and convicted\u201d.<\/p>\n\n\n\n<p>Sauer has also previously\u00a0<a href=\"https:\/\/www.youtube.com\/watch?v=UGlDRrVKqk0&amp;t=9s\" target=\"_blank\" rel=\"noreferrer noopener\">spoken against censorship<\/a>\u00a0under the Biden administration.<\/p>\n\n\n\n<p>However, Sauer has not made any public statements regarding his view on water fluoridation, or the federal court\u2019s decision ordering the EPA to take action to prevent harms from water fluoridation.<\/p>\n\n\n\n<p><em>TLAV will continue to provide updates on the progress of the fight to enforce the federal court\u2019s ruling.<\/em><\/p>\n\n            \n        <\/div>\r\n<br>\r\n","protected":false},"excerpt":{"rendered":"<p>In his final days in the White House, former U.S. President Joe Biden\u2019s Environmental Protection Agency (EPA) announced they were\u00a0appealing the historic ruling\u00a0in the federal fluoride lawsuit.
