Time after time, what I discover
\nin jury debriefings is that jurors don\u2019t like being \u201cinterrogated\u201d during voir
\ndire. They don\u2019t mind being questioned, but they heartily dislike attorney
\nattempts to force answers out of them and especially resent being pressured
\ninto a \u201cyes\u201d or \u201cno\u201d response.<\/p>\n

Now this wouldn\u2019t be so critical
\nif it weren\u2019t for the fact that people who feel pressured into a position,
\nretaliate by disliking the person who pressured them. Cornered animals bite. So
\ndo jurors.<\/p>\n

As tempting as it is to finally
\nget that unqualified \u201cyes\u201d or \u201cno\u201d from a juror, be aware of the consequences.
\nA juror who doesn\u2019t like you will be far less susceptible to your arguments, and
\nmay very well damn you during deliberations. Not only that but the unqualified
\n\u201cyes\u201d or \u201cno\u201d is often the juror simply trying to wriggle free from your
\nunwanted persistence.<\/p>\n

You may receive a sufficiently
\ntruthful and more accurate response by framing your question differently such
\nthat it doesn\u2019t antagonize your juror unnecessarily: \u201cIs it more likely that
\nyou would . . .\u201d People respond well to choice, as well as to the word \u201cwould,\u201d
