{"id":248782,"date":"2025-05-20T08:47:29","date_gmt":"2025-05-20T08:47:29","guid":{"rendered":"https:\/\/peraltafinancing.com\/alabama\/final-alabama-2025-legislative-report\/"},"modified":"2025-05-20T08:47:29","modified_gmt":"2025-05-20T08:47:29","slug":"final-alabama-2025-legislative-report","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=248782","title":{"rendered":"Final Alabama 2025 Legislative Report"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p class=\"p1\"><span class=\"s1\">The Alabama Legislature convened for Day 30 of its annual Regular Session on Wednesday, May 14 and adjourned Sine Die shortly before midnight.\u00a0<\/span><span class=\"s1\">Absent a Special Session, the Legislature will next convene for the 2026 Regular Session on Tuesday, January 13, 2026.\u00a0<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The Governor has 10 days from adjournment to sign the bills passed in the last 5 days of the Session or they receive pocket vetoes.\u00a0<\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">968 bills were introduced during the Session.\u00a0<\/span><\/p>\n<h2 class=\"p6\"><span class=\"s1\">NOTABLE BILLS ENACTED\u00a0<\/span><\/h2>\n<p class=\"p7\"><span class=\"s1\">SB79, Sen. Weaver: To define man, woman, boy, girl, father, mother, male, female and sex for purposes of state law, to provide <\/span><span class=\"s1\">policy of the differences between sexes, to provide that\u00a0<\/span><span class=\"s1\">state and local public entities may establish separate\u00a0<\/span><span class=\"s1\">single-sex spaces or environments in certain\u00a0<\/span><span class=\"s1\">circumstances, and to require the state or political\u00a0<\/span><span class=\"s1\">subdivisions that collect vital statistics related to sex as\u00a0<\/span><span class=\"s1\">male or female for certain purposes to identify each\u00a0<\/span><span class=\"s1\">individual as either male or female at birth.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB70, Sen. Jones: To create the Alabama Veterans Resource Center, provide for a board of directors to manage the center <\/span><span class=\"s1\">as a comprehensive, coordinated system of support for\u00a0<\/span><span class=\"s1\">veterans and their families.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB36, Sen. Kitchens: To provide further for who is subject to state competitive bid laws, to provide further for electronic <\/span><span class=\"s1\">bid submissions, to provide further for the procedures\u00a0<\/span><span class=\"s1\">for protesting certain competitive bid contracts, and to\u00a0<\/span><span class=\"s1\">revise requirements for disclosure statement forms.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB67, Sen. Jones: To authorize the Governor to appoint the Commissioner of the Department of Veterans Affairs to <\/span><span class=\"s1\">serve at the pleasure of the Governor, and to revise\u00a0<\/span><span class=\"s1\">membership and powers of the board.\u00a0<\/span><\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Elliott: To authorize certain public entities to contract with a nonpublic K-12 school to provide school resource <\/span><span class=\"s1\">officers in certain circumstances, and to require public\u00a0<\/span><span class=\"s1\">entities to charge the nonpublic school for the full cost\u00a0<\/span><span class=\"s1\">of employing any school resource officer.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB64, Sen. Livingston: To require persons engaging in the business of cutting or uprooting aquatic plants in public waters to use <\/span><span class=\"s1\">certain methods to remove this plant matter.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB116, Sen. Barfoot: To prohibit persons from possessing a part or combination of parts designed or intended to convert <\/span><span class=\"s1\">a pistol into a machine gun.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB115, Sen. Chambliss: To include additional activity that would constitute the crime of impersonating a peace officer.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB54, Sen. Roberts: To further provide for the term \u201ccritical infrastructure facility\u201d to include communications service infrastructure <\/span><span class=\"s1\">and facilities, and further provide for the crimes of\u00a0<\/span><span class=\"s1\">unauthorized entry of a critical infrastructure facility and\u00a0<\/span><span class=\"s1\">criminal tampering in the first and second degrees.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB78, Sen. Weaver: To prohibit the possession, use, or sale of butyl nitrite or any mixtures containing butyl nitrite, commonly <\/span><span class=\"s1\">known as \u201cwhippets,\u201d except under certain\u00a0<\/span><span class=\"s1\">circumstances, and to prohibit the possession, use, or\u00a0<\/span><span class=\"s1\">sale of nitrous oxide, commonly known as \u201claughing\u00a0<\/span><span class=\"s1\">gas,\u201d and amyl nitrite, commonly known as \u201cpoppers\u201d\u00a0<\/span><span class=\"s1\">or \u201csnappers,\u201d except under certain circumstances.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">HB93, Rep. Space and Rocket Center <\/span><span class=\"s1\">Commission, to provide that the Governor serve as an\u00a0<\/span><span class=\"s1\">ex officio nonvoting member of the commission, to\u00a0<\/span><span class=\"s1\">authorize interested public and private partners to\u00a0<\/span><span class=\"s1\">provide facilities for U. S. Space and Rocket Center\u00a0<\/span><span class=\"s1\">exhibits, and to specify that the commission operates\u00a0<\/span><span class=\"s1\">outside of the State Treasury.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB199, Sen. Figures: To provide for paid parental leave for eligible employees following the birth, stillbirth, or miscarriage <\/span><span class=\"s1\">of a child or the placement of a child for adoption.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">HB243, Rep. Whitt: To unabate a portion of state noneducational ad valorem taxes and state abated construction related <\/span><span class=\"s1\">transaction taxes pursuant to abatements granted on or\u00a0<\/span><span class=\"s1\">after June 1, 2026, and require the local tax collecting\u00a0<\/span><span class=\"s1\">official and the Department of Revenue to collect the\u00a0<\/span><span class=\"s1\">unabated portion and deposit the revenue into the\u00a0<\/span><span class=\"s1\">Alabama Development Fund.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">HB101, Rep. Drummond: To provide that a Class 2 municipality (Mobile) may declare certain abandoned or discarded debris a <\/span><span class=\"s1\">nuisance and require its abatement or removal at the\u00a0<\/span><span class=\"s1\">expense of the owner of the property.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB40, Sen. Kelley: To provide for the recognition of firearm hold agreements between a federal firearm licensee or a <\/span><span class=\"s1\">municipal or county law enforcement officer and in\u00a0<\/span><span class=\"s1\">individual firearm owner where the licensee or law\u00a0<\/span><span class=\"s1\">enforcement officer agrees to hold a lawfully possessed\u00a0<\/span><span class=\"s1\">firearm for a specified period of time.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB60, Sen. Albritton: To allow the Alabama Corrections Institution Finance Authority to increase the amount of bonds issued to <\/span><span class=\"s1\">implement the existing prison modernization plan from\u00a0<\/span><span class=\"s1\">$785,000,000 to a total of $1,285,000,000.\u00a0<\/span><\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Beasley: To further provide for the regulation of pharmacy benefits managers by the Commissioner of Insurance,\u00a0<\/span><span class=\"s1\">to provide a civil action to person injured by pharmacy\u00a0<\/span><span class=\"s1\">benefit managers, to provide a minimum\u00a0<\/span><span class=\"s1\">reimbursement amount for independent pharmacies,\u00a0<\/span><span class=\"s1\">and to regulate rebates from drug manufacturers to\u00a0<\/span><span class=\"s1\">pharmacy benefits managers.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB91, Sen. Kelley: To require a person seeking to construct a tall structure within a minimum distance of a military installation to <\/span><span class=\"s1\">receive approval from the local government before\u00a0<\/span><span class=\"s1\">construction may begin, and authorize a local\u00a0<\/span><span class=\"s1\">government to seek enjoinment of the construction of\u00a0<\/span><span class=\"s1\">a tall structure if prior approval was not granted.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB83, Sen. Orr: To require public entities to install and maintain powered, height-adjustable, adult-size changing tables <\/span><span class=\"s1\">accessible to both males and females in newly\u00a0<\/span><span class=\"s1\">constructed or renovated public buildings, to provide\u00a0<\/span><span class=\"s1\">for grant award payments to public entities with\u00a0<\/span><span class=\"s1\">preexisting public restrooms subject to appropriation,\u00a0<\/span><span class=\"s1\">and to encourage the installation and maintenance of\u00a0<\/span><span class=\"s1\">adult-size changing tables in private sector facilities\u00a0<\/span><span class=\"s1\">across the state.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB224, Sen. Jones: To rename \u201cdrug courts\u201d to \u201caccountability courts\u201d and to expand the scope of whom accountability courts <\/span><span class=\"s1\">would serve to include offenders with mental illness and\u00a0<\/span><span class=\"s1\">offenders who are veterans.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB221, Sen. Williams: To further provide for the compensation of the Mobile County Judge of Probate.\u00a0<\/span><\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Sessions: To authorize the governing body of a Class 2 municipality (Mobile) to establish a delegation <\/span><span class=\"s1\">agreement with the Alabama Department of\u00a0<\/span><span class=\"s1\">Environmental Management to enforce the Alabama\u00a0<\/span><span class=\"s1\">Scrap Tire Environmental Quality Act.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB102, Sen. Coleman-Madison: To extend the existing pregnant women benefit under the state Medicaid plan for up to 60 days to women <\/span><span class=\"s1\">who have not been formally approved for Medicaid\u00a0<\/span><span class=\"s1\">coverage but who submit proof of pregnancy and\u00a0<\/span><span class=\"s1\">household income information to a qualified provider\u00a0<\/span><span class=\"s1\">of ambulatory prenatal care.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB118, Sen. Barfoot: A proposed Constitutional Amendment to provide for additional offenses that would allow a judge to deny <\/span><span class=\"s1\">bail under certain circumstances.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">HB253, Rep. Colvin: To exempt the gross receipts from the sale of certain aircraft and aircraft parts from state sales and use tax, <\/span><span class=\"s1\">to provide conditions regarding the application of\u00a0<\/span><span class=\"s1\">rental or lease taxes to the rental or lease transactions\u00a0<\/span><span class=\"s1\">of commercial aircraft, to authorize county or municipal\u00a0<\/span><span class=\"s1\">governing bodies to adopt a local sales and use tax\u00a0<\/span><span class=\"s1\">exemption by resolution or ordinance, and to provide\u00a0<\/span><span class=\"s1\">for effective dates from September 1, 2025 to August\u00a0<\/span><span class=\"s1\">31, 2030.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB305, Sen. Williams: To add certain trucks to those that are excepted from certain weight limits, to further provide for an operator <\/span><span class=\"s1\">of a vehicle to verify the accuracy of portable scales,\u00a0<\/span><span class=\"s1\">and to remove the authority of certain individuals to\u00a0<\/span><span class=\"s1\">require vehicle operators to drive to stationary weigh\u00a0<\/span><span class=\"s1\">scales to enforce those weight limits.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB119, Sen. Barfoot: To further provide for the list of persons prohibited from possessing a firearm, to prohibit firearm possession by <\/span><span class=\"s1\">a person charged with certain felony offenses when the\u00a0<\/span><span class=\"s1\">person has been released pending or during trial, and\u00a0<\/span><span class=\"s1\">to increase the penalty for the offense of discharging a\u00a0<\/span><span class=\"s1\">firearm into an occupied dwelling, building or other\u00a0<\/span><span class=\"s1\">designated space.\u00a0<\/span><\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Faulkner: To authorize a nonprofit agricultural organization to offer health benefits to its members and their families, <\/span><span class=\"s1\">to specify that the nonprofit agricultural organization\u00a0<\/span><span class=\"s1\">would not be engaged in the business of health\u00a0<\/span><span class=\"s1\">insurance, and would specify health care benefits that\u00a0<\/span><span class=\"s1\">must by offered, to require a nonprofit agricultural\u00a0<\/span><span class=\"s1\">organization to create a complaint system for members\u00a0<\/span><span class=\"s1\">receiving health benefits, and to impose a tax\u00a0<\/span><span class=\"s1\">measured by premiums received by a nonprofit\u00a0<\/span><span class=\"s1\">agricultural organization.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB330, Sen. Roberts: To further provide for the composition, manner of appointment, and length of terms of members of <\/span><span class=\"s1\">certain municipal water works boards, to provide\u00a0<\/span><span class=\"s1\">qualifications for and place limits on the employment\u00a0<\/span><span class=\"s1\">of board members, to provide for conversion of these\u00a0<\/span><span class=\"s1\">boards to regional boards, to further provide for these\u00a0<\/span><span class=\"s1\">boards to amend their articles of incorporation, to\u00a0<\/span><span class=\"s1\">subject these boards to the ethics laws of Alabama and\u00a0<\/span><span class=\"s1\">require training on the subject, to provide duties and\u00a0<\/span><span class=\"s1\">unlawful actions of these boards, to require a\u00a0<\/span><span class=\"s1\">consulting engineer be retained by a board, and to\u00a0<\/span><span class=\"s1\">require these boards to produce certain financial and\u00a0<\/span><span class=\"s1\">statistical records.\u00a0<\/span><\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Waggoner: To require the Alabama Department of Public Health to notify youth athletic associations of noncompliance with <\/span><span class=\"s1\">the Coach Safely Act, to levy a fine if noncompliance\u00a0<\/span><span class=\"s1\">is not remedied, and prohibit a youth athletic\u00a0<\/span><span class=\"s1\">association that is noncompliant for 4 consecutive\u00a0<\/span><span class=\"s1\">years from administering or conducting youth athletic\u00a0<\/span><span class=\"s1\">activities on state property.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB194, Sen. Melson: To authorize an agriculture authority to terminate or move easements on authority owned property using the <\/span><span class=\"s1\">power of eminent domain in the same manner as the\u00a0<\/span><span class=\"s1\">state.<\/span><\/p>\n<p class=\"p8\"><span class=\"s1\">HB165, Rep. Rehm: To add Juneteenth as a state holiday.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">HB152, Rep. Rafferty: To provide for a state sales and use tax exemption for purchases of certain baby supplies, baby formula, <\/span><span class=\"s1\">maternity clothing, and menstrual hygiene products,\u00a0<\/span><span class=\"s1\">and to allow local governments to adopt exemptions.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">HB386, Rep. Garrett: To reduce the state sales and use tax rate on food to 2% on September 1, 2025, and to revise the provisions <\/span><span class=\"s1\">authorizing a county or municipal governing body to\u00a0<\/span><span class=\"s1\">reduce their sales and use tax on food to eliminate the\u00a0<\/span><span class=\"s1\">restriction on the amount of the rate cut and remove\u00a0<\/span><span class=\"s1\">the growth requirement.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB63, Sen. Bell: To require law enforcement agencies to collect fingerprints and DNA from any illegal alien in the <\/span><span class=\"s1\">agency\u2019s custody and submit the fingerprints and DNA\u00a0<\/span><span class=\"s1\">for testing or cataloging.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">SB158, Sen. Barfoot: To provide that a foreign national driver license may not be used as photo identification for voting purposes.\u00a0<\/span><\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Lovvorn: To require the Department of Revenue to adjust the dollar value of \u201ccovered items\u201d that are exempt from <\/span><span class=\"s1\">sales tax during certain weekends based on changes in\u00a0<\/span><span class=\"s1\">the Consumer Price Index, and to increase the number\u00a0<\/span><span class=\"s1\">of days prior to which a local government must pass a\u00a0<\/span><span class=\"s1\">resolution or ordinance to adopt such exemptions for\u00a0<\/span><span class=\"s1\">local sales tax.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">HB407, Rep. Ingram: To authorize local redevelopment authorities to require payment in lieu of taxes for transient occupancy tax, <\/span><span class=\"s1\">and to require these authorities to report certain\u00a0<\/span><span class=\"s1\">payments in lieu of taxes to the Department of\u00a0<\/span><span class=\"s1\">Revenue.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">HB196, Rep. Wilcox: To further provide for the management of county juvenile detention facilities.\u00a0<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">HB366, Rep. Rehm: To authorize emergency medical services personnel to transport a police dog that is injured in the line of duty <\/span><span class=\"s1\">to a veterinary clinic or hospital, and authorize\u00a0<\/span><span class=\"s1\">emergency medical services personnel to provide\u00a0<\/span><span class=\"s1\">emergency medical care to a police dog that is injured\u00a0<\/span><span class=\"s1\">in the line of duty while at the scene of the injury or\u00a0<\/span><span class=\"s1\">during transport.<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">HB281, Rep.
