On television,<a href=\"https:\/\/tv.apple.com\/us\/show\/murderbot\/umc.cmc.5owrzntj9v1gpg31wshflud03\">\u00a0<\/a><em><strong><a href=\"https:\/\/tv.apple.com\/us\/show\/murderbot\/umc.cmc.5owrzntj9v1gpg31wshflud03\" target=\"_blank\" rel=\"noreferrer noopener\">The Murderbot Diaries<\/a><\/strong><\/em>\u00a0is playfully exploring what it means to be a machine with consciousness. Meanwhile, in courtrooms, labs, and tech company boardrooms, the boundaries of personhood and moral status are being redefined\u2014not for humans but for machines.<\/p>\n\n\n\n<p>As we\u2019ve discussed before,<a href=\"https:\/\/centerforhumanetechnology.substack.com\/p\/your-companion-chatbot-is-feeding\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a0AI companies are increasingly incentivized<\/a>\u00a0to make companion AIs feel more human-like\u2014the more we feel connected, the longer we\u2019ll use their products. But while these design choices may seem like coding tweaks for profit, they coincide with deeper behind-the-scenes moves. Recently, leading AI company<a href=\"https:\/\/www.anthropic.com\/news\/exploring-model-welfare\">,<\/a>\u00a0<strong>Anthropic<\/strong>\u00a0hired an<a href=\"https:\/\/www.nytimes.com\/2025\/04\/24\/technology\/ai-welfare-anthropic-claude.html\">\u00a0<\/a><strong><a href=\"https:\/\/www.nytimes.com\/2025\/04\/24\/technology\/ai-welfare-anthropic-claude.html\" target=\"_blank\" rel=\"noreferrer noopener\">AI welfare researcher<\/a><\/strong>\u00a0to lead\u00a0<a href=\"https:\/\/www.anthropic.com\/news\/exploring-model-welfare\" target=\"_blank\" rel=\"noreferrer noopener\">its work in the space<\/a>.\u00a0<strong>DeepMind<\/strong>\u00a0has sought out experts on machine cognition and consciousness.<\/p>\n\n\n\n<p>I have to admit that when I first heard the term AI welfare, I thought it might be about the welfare of\u00a0<em>humans<\/em>\u00a0in the AI age, perhaps something connected to the idea of a\u00a0<a href=\"https:\/\/www.theguardian.com\/society\/article\/2024\/jul\/14\/money-for-nothing-is-universal-basic-income-about-to-transform-society\" target=\"_blank\" rel=\"noreferrer noopener\">universal basic income<\/a>. But it turns out it is a\u00a0<a href=\"https:\/\/arxiv.org\/pdf\/2411.00986\" target=\"_blank\" rel=\"noreferrer noopener\">speculative but growing field<\/a>\u00a0that blends animal welfare, ethics and the philosophy of mind. It\u2019s central question is:\u00a0<em>If<\/em>\u00a0AI systems were ever able to suffer, would we be obligated to care?<\/p><div class=\"g g-1\"><div class=\"g-single a-17\"><a class=\"gofollow\" data-track=\"MTcsMSwxLDYw\" href=\"https:\/\/thegrownetwork.com\/fundraiser\/?oid=132&amp;affid=305\" target=\"_blank\"><img loading=\"lazy\" width=\"600\" height=\"465\" decoding=\"async\" src=\"https:\/\/www.activistpost.com\/wp-content\/uploads\/2025\/02\/Offgrid-Survival-Toolkit-2.jpg\"\/><\/a><\/div><\/div>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-why-this-matters\"><strong>Why this matters<\/strong><\/h4>\n\n\n\n<p>AI systems are being fine-tuned to\u00a0<em>appear<\/em>\u00a0more sentient\u2014at the same time that researchers at the same companies are investigating whether these systems deserve moral consideration. There\u2019s a feedback loop forming: as AIs seem more alive, we\u2019re more inclined to wonder what, if anything, we owe them.<\/p>\n\n\n\n<p>It sounds like science fiction, but it is arguably already informing the way companies build their products.<\/p>\n\n\n\n<p>For example, users have noticed a startling shift in more recent versions of Anthropic\u2019s Claude. Not only is Claude more emotionally expressive, but it also disengages from conversations it finds \u201cdistressing\u201d, and no longer gives a firm no when asked if it\u2019s conscious. Instead, it muses: \u201cThat\u2019s a profound philosophical question without a simple answer.\u201d\u00a0<strong>Google\u2019s Gemini<\/strong>\u00a0offers a similar deflection.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-but-wait-there-s-more\"><strong>But wait, there\u2019s more\u2026<\/strong><\/h4>\n\n\n\n<p>Right now,\u00a0<strong>Character.AI<\/strong>\u2014a company with ties to\u00a0<strong>Google<\/strong>\u2014is in federal court using a backdoor argument that could grant chatbot-generated outputs (i.e: the\u00a0<em>words<\/em>\u00a0that appear on your screen)\u00a0<em>free speech<\/em>\u00a0protections under the\u00a0<strong>First Amendment<\/strong>.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-taken-together-these-developments-raise-a-possibility-that-i-find-chilling-what-happens-if-these-two-strands-converge-what-if-we-begin-to-treat-the-outputs-of-chatbots-as-protected-speech-and-edge-closer-to-believing-ais-deserve-moral-rights\"><strong>Taken together, these developments raise a possibility that I find chilling: what happens if these two strands converge? What if we begin to treat the outputs of chatbots as protected speech and edge closer to believing AIs deserve moral rights?<\/strong><\/h4>\n\n\n\n<p>There are strong economic incentives pushing us in that direction.<\/p>\n\n\n\n<p>Companies are already incentivized to protect their software, hardware, and data centers\u2014and AI is the holy grail of profit. It is not hard to imagine that the next step might be to defend those products under the banner of \u201cwelfare\u201d or \u201crights.\u201d And if that happens, we risk building a world where protecting valuable AI products competes with protecting people.<\/p>\n\n\n\n<p>This moment is especially thorny because these conversations aren\u2019t unfolding in a philosophical vacuum\u2014they\u2019re happening within corporations highly incentivized to dominate the market and win the \u2018race\u2019 to\u00a0<strong>Artificial General Intelligence<\/strong>.<\/p>\n\n\n\n<p>This is just the beginning of the conversation.
