BBC Radio 4 Consumer Programme \u2018You and Yours\u2019 highlight the vulnerability of Executors to personal claims<\/h5>\n

The BBC\u00a0Radio Four Consumer Programme \u2018 You and Yours\u2019 has highlighted just how vulnerable executors are in terms of their personal liability to claims.<\/p>\n

A listener who had been named as an executor in her mother\u2019s will contacted the programme for help.\u00a0 She explained she had taken on\u00a0the role of executor as a promise to her mother, saying she felt it was \u2018 a moral duty..\u2019 and that she wanted to give her mother \u2018\u2026peace of mind\u2019.\u00a0 She had now found herself\u00a0caught in the middle of a nightmare scenario, with an unexpected claim on the estate which had been totally unpredictable.<\/p>\n

Her mother\u2019s\u00a0will had unexpectedly been disputed by another party which prevented any assets being liquidated but had\u00a0left her as the executor\u00a0personally liable for spiralling legal defence costs of\u00a0\u00a390,000 even though the whole estate was valued at no more than \u00a3150,000.<\/p>\n
