What Is a Life Estate?<\/strong><\/span><\/h2>\n

A life estate<\/strong> <\/a>is an interest that can arise in ownership and co-ownership of property<\/a> in which an individual, known as the life tenant<\/strong>, has the right to use and occupy a property for the duration of their lifetime. Upon their passing, ownership of the property automatically transfers to the remainderman<\/a><\/strong>, who holds the future interest.<\/p>\n

California Law Requires Life Estates to Be in Writing<\/strong><\/span><\/h2>\n

Under California\u2019s Statute of Frauds<\/a><\/strong> (California Civil Code \u00a7\u202f1624<\/a>) any agreement that creates or transfers an interest in real property<\/a><\/strong>\u2014including a life estate<\/strong>\u2014must be in writing to be legally valid. Courts have repeatedly upheld this rule to prevent fraudulent claims and misunderstandings.<\/p>\n

As relevant to this topic, Code of Civil Procedure \u00a7 1971 states that: \u201cNo estate or interest in real property, other than for leases for a term not exceeding one year, nor any power over or concerning it, or in any manner relating thereto, can be created, granted, assigned, surrendered, or declared, otherwise than by operation of law, or a conveyance or other instrument in writing, subscribed by the party creating, granting, assigning, surrendering, or declaring the same, or by the party\u2019s lawful agent thereunto authorized by writing.\u201d See Civ. Moreover, Civil Code \u00a7 1091 provides that: \u201cAn estate in real property, other than an estate at will or for a term not exceeding one year, can be transferred only by operation of law, or by an instrument in writing, subscribed by the party disposing of the same, or by his agent thereunto authorized by writing.\u201d<\/p>\n

App. 38, 42\u201343, which rejected a claim of a life estate not found in writing, finding that \u201coral testimony cannot be considered as against the written terms of a deed for the purpose of limiting or qualifying the estate thereby granted or created<\/strong>.\u201d<\/p>\n

This means that any claim of an oral life estate is legally invalid<\/strong>, and the alleged life tenant has no enforceable rights to remain on the property.<\/p>\n
