During the meeting, members of the press <a href=\"https:\/\/abcnews.go.com\/Politics\/trump-hosts-el-salvadors-bukele-amid-deportation-controversy\/story?id=120788481\" target=\"_blank\" aria-label=\"Link opens in new window (sought)\">sought<\/a> answers from both presidents regarding Kilmar Abrego Garcia, a Maryland-based asylum seeker who was <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/apr\/16\/who-is-kilmar-abrego-garcia\" target=\"_blank\" aria-label=\"Link opens in new window (forcefully detained)\">forcefully detained<\/a> in March and sent to an infamous mega-prison in El Salvador. \u00a0<\/p>\n<p>Abrego Garcia had no pending charges or convictions. Evidence of his alleged involvement with the notorious gang MS-13 is <a href=\"https:\/\/www.bbc.com\/news\/articles\/c1k4072e3nno\" target=\"_blank\" aria-label=\"Link opens in new window (shaky)\">shaky<\/a> at best. The Constitutional rights he was entitled to, even as an asylum seeker, were purposely ignored. Still, President Trump <a href=\"https:\/\/www.democracydocket.com\/news-alerts\/trump-abrego-garcia-maryland-return-el-salvador-prison\/\" target=\"_blank\" aria-label=\"Link opens in new window (refused)\">refused<\/a> to commit to following the U.S. Supreme Court\u2019s unanimous decision directing his administration to facilitate Abrego Garcia\u2019s return. \u00a0<\/p>\n<p>Indeed, Trump <a href=\"https:\/\/www.npr.org\/2025\/04\/16\/nx-s1-5366178\/trump-deport-jail-u-s-citizens-homegrowns-el-salvador\" target=\"_blank\" aria-label=\"Link opens in new window (floated)\">floated<\/a> the idea of sending prisoners who are U.S. citizens to El Salvador, where they would presumably be subject to its facilities\u2019 well-documented <a href=\"https:\/\/www.hrw.org\/news\/2020\/04\/29\/el-salvador-inhumane-prison-lockdown-treatment?gad_source=1&amp;gad_campaignid=16363698676&amp;gbraid=0AAAAADrFXciTsrBUFN6-Q_wboxbeIWsxq&amp;gclid=CjwKCAjw24vBBhABEiwANFG7yxUfwEd6OPtqpL48BjizyoYr5Our2ItOdZsEavOPYIC2yNEGDrW9BxoC4C0QAvD_BwE\" target=\"_blank\" aria-label=\"Link opens in new window (deprivations and abuse)\">deprivations and abuse<\/a>\u00a0 without any pretense of due process. President Bukele was receptive to this idea. \u00a0<\/p>\n<p>As someone who has been incarcerated for nearly nine years for a crime I did commit, hearing about this left me in complete and utter shock. This is not how the criminal justice system is supposed to work.\u00a0<\/p>\n<p>In 2008, when I was sixteen, I killed a friend after losing control during an argument. I was arrested in 2016 and charged with murder. In 2018, I pleaded guilty and was sentenced to nineteen-years-to-life.\u00a0\u00a0<\/p>\n<p>Though my legal process was far from ideal, I was still afforded certain rights that are enshrined \u00a0into our Constitution. I wasn\u2019t just placed in shackles and whisked off to prison. There was an arraignment, hearings and other court appearances\u2014all part of due process. Even after I was sentenced, there was no question that I\u2019d serve my time in New York or that I would have access to appeal processes. \u00a0<\/p>\n<p>Now, these liberties are at risk. Although presidential power is supposed to only affect federal. prisoners, Trump\u2019s actions thus far offer no assurances that state prisoners may also eventually be hauled away. Those awaiting trial in county detention centers might come next. And then, those who openly defy the President may face a day of reckoning. \u00a0<\/p>\n<p>When everyday citizens break the law, we are held accountable for our actions. Despite the criminal justice system being steeped in <a href=\"https:\/\/www.sentencingproject.org\/reports\/one-in-five-racial-disparity-in-imprisonment-causes-and-remedies\/\" target=\"_blank\" aria-label=\"Link opens in new window (racism and inequality)\">racism and inequality<\/a>, we are asked to respect the decisions of the court. Yet the Trump Administration\u2019s actions have displayed an unapologetic disregard for the institutions that are foundational to this country.<\/p>\n<p>Since his first term, Trump has been amplifying false narratives about the justice system which have had a corrosive effect on Americans\u2019 attitudes toward it. A Gallup poll <a href=\"https:\/\/news.gallup.com\/poll\/653897\/americans-pass%20judgment-courts.aspx\" target=\"_blank\" aria-label=\"Link opens in new window (conducted)\">conducted<\/a> in late 2024 found that only 35 percent\u00a0of Americans expressed confidence in American judicial systems and courts, a record low.\u00a0<\/p>\n<p>Meanwhile, the political divide in our country is at an all-time high. A National Bureau of Economic Research study from 2020 <a href=\"https:\/\/www.brown.edu\/news\/2020-01-21\/polarization\" target=\"_blank\" aria-label=\"Link opens in new window (found)\">found<\/a> that \u201cpolitical polarization among Americans has grown rapidly in the last forty\u00a0years\u2014more than in Canada, the United Kingdom, Australia, or Germany.\u201d<\/p>\n<p>Americans once had the ability to find middle ground amongst differences. In such polarizing \u00a0times, this has become much more difficult. But the right to fundamental protections like due process ought to be something we can all still agree on.<\/p>\n<p>The denial of due process to asylum seekers and the banishment of American prisoners should concern us all because it won\u2019t stop there. Once the proverbial floodgates are opened, others will be next. But it\u2019s not too late to stand up for what\u2019s right.
