{"id":241741,"date":"2025-05-14T16:40:25","date_gmt":"2025-05-14T16:40:25","guid":{"rendered":"https:\/\/peraltafinancing.com\/alabama\/hb445-and-the-nose-growing-narratives\/"},"modified":"2025-05-14T16:40:25","modified_gmt":"2025-05-14T16:40:25","slug":"hb445-and-the-nose-growing-narratives","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=241741","title":{"rendered":"HB445 and the nose-growing narratives"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p class=\"p1\"><span class=\"s1\">Last week, the Legislature was successful in passing House Bill 445, which is Alabama\u2019s first comprehensive legislation regulating hemp products, such as gummies and drinks, since the federal farm bill legalized hemp-derived cannabis in 2018.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Like most bills, it resulted in compromise, as there were two very aggressive sides to the issue.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">On one hand, you had the hemp industry, which, naturally, wasn\u2019t a big fan of any kind of additional regulatory measures being placed upon its businesses.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">On the other hand, you had the abolitionist crowd, which wanted these products out of Alabama entirely and pushed hard for an all-out ban.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Now that the bill has been passed and awaits Gov. Kay Ivey\u2019 signature, I\u2019m getting some not-so-polite feedback from both crowds.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The hemp industry\u2019s customers are under the impression that I\u2019ve taken their drug of choice or preferred medication away from them.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The abolitionist crowd is now accusing me of \u201clegalizing recreational marijuana in the state of Alabama.\u201d<\/span><\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Scroll to continue reading.<\/span><\/div>\n<\/div>\n<p class=\"p1\"><span class=\"s1\">I ask that you take a second and reflect upon the absolute absurdity of this situation.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">No matter which side you fall on, it seems as though someone is misleading you because they simply didn\u2019t get their way on this bill.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Let me say that again \u2013 special interests did not get their way on this bill, and now, their feelings are hurt.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Here\u2019s the truth:<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">HB445 neither bans all hemp-derived THC products, nor does it legalize recreational marijuana. What it does is introduce commonsense controls on substances that are already federally legal.<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">Smokable and vaporized products will no longer be legal.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Ingestible products, like gummies and seltzers, remain legal but are capped at 10mg of THC per serving.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Sales are restricted to specialty stores accessible only to those 21 and older.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Hemp seltzers can be sold in grocery stores over 14,000 sq. ft., but only from employee-accessed storage \u2014 just like cigarettes.<\/span><\/li>\n<\/ul>\n<p class=\"p1\"><span class=\"s1\">What is disappointing, but ultimately not surprising, is that Stephanie Smith, the self-proclaimed \u201cconservative thought leader of Alabama,\u201d has come out against this bill and levied an attack on my integrity, comprised of verifiably false statements.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Last Friday, she claimed that as a result of HB445, \u201cAlabama laws on recreational marijuana are now equal to or more lenient than Colorado drug laws.\u201d<\/span><\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Scroll to continue reading.<\/span><\/div>\n<\/div>\n<p class=\"p1\"><span class=\"s1\">Even Pinocchio is impressed with that one\u2026<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">I\u2019ve spoken with parents, teachers, school leaders, and even the Alabama Poison Information Center about rising concerns with youth exposure to these products.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">My goal was to address those issues with reasonable guardrails, not extremes.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Is this legislation perfect?
