How many times in your youth, were
\nyou told by a benevolent, or at the very least, good-hearted, coach or teacher,
\n\u201cThere\u2019s no such thing as a stupid question.\u201d You\u2019ve probably said that very
\nphrase to your children as well. <\/span><\/p>\n

And yet, when jurors ask during
\ndeliberations to have something explained to them or ask a question that
\nclearly reveals their lack of understanding, lawyers will frequently roll their
\neyes and mutter about \u201cthe decline in average intelligence\u201d or mumble about the
\nimpossibility of getting \u201cbright jurors\u201d on the panel.<\/span><\/p>\n

Similarly, in focus groups, when
\nit\u2019s obvious the mock jurors have completely missed a lawyer\u2019s point, the
\nlawyer will often blame the jurors for their stupidity . . . which drives me
\nabsolutely berserk.<\/span><\/p>\n

Jurors are people who are good at
\nwhat they do! Whether that\u2019s repairing cars, or managing a convenience store,
\nor cleaning houses. And just like the internationally acclaimed show
\n\u201cUndercover Boss\u201d revealed the inability of most bosses to accomplish the
\nmundane tasks of their employees, I defy any attorney to walk in the shoes of
\nany juror and accomplish their tasks in life, from bus driver to pediatric
\nnurse, with the same level of expertise as said juror.<\/span><\/p>\n

There are no stupid questions. There
\nare simply different arenas and levels of experience in the world. Run your
\ncases by focus groups whenever you can to ferret out what are the issues
\ncritical to your case that jurors are likely to misunderstand or fail to
\ncomprehend. <\/span><\/p>\n

Then do all that you can, with the
\naid of visuals whenever possible, to clarify matters for those who will be your
\n\u201creal\u201d jurors. <\/span><\/p>\n<\/p>\n

There are no stupid questions. But
\nthere are some mightily confusing, obfuscating answers.<\/span><\/p>\n\n","protected":false},"excerpt":{"rendered":"
