The importance of education was realised at <\/span><a href=\"https:\/\/www.encyclopedia.com\/children\/encyclopedias-almanacs-transcripts-and-maps\/aristocratic-education-europe\" style=\"text-decoration-line: none;\"><span style=\"color: #1155cc; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">a very later stage; <\/span><\/a><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">\u00a0before, it was only available to the privileged few, but once realised, many steps were taken to spread education to the masses. It is directly linked to the well-being of the people and the economy of the nation, making it the foundation of the very nation.<\/span><\/span><\/div>\n<p dir=\"ltr\" style=\"line-height: 1.8; margin-bottom: 0pt; margin-top: 0pt; text-align: justify;\"><span style=\"font-family: inherit; font-size: medium;\"><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">With the onset of the modern era, education was now seen as a fundamental human right, and to realise this goal, <\/span><span style=\"color: #0e101a; font-style: italic; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">The United Nations<\/span><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\"> incorporated in its <\/span><a href=\"https:\/\/www.un.org\/en\/about-us\/universal-declaration-of-human-rights#:~:text=Article%2026,on%20the%20basis%20of%20merit.\" style=\"text-decoration-line: none;\"><span style=\"color: #4a6ee0; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">Universal Declaration of Human Rights (UDHR) of 1948: Article 26<\/span><\/a><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">, also known as <\/span><span style=\"color: #0e101a; font-style: italic; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">The Right to Education<\/span><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\"> or <\/span><span style=\"color: #0e101a; font-style: italic; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">RTE<\/span><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">. Initially, in India, <\/span><a href=\"https:\/\/www.india.gov.in\/my-government\/constitution-india\/amendments\/constitution-india-eighty-sixth-amendment-act-2002\" style=\"text-decoration-line: none;\"><span style=\"color: #4a6ee0; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">the makers of our constitution placed RTE under Part IV of the Constitution \u2013 The Directive Principles of State Policy or DPSP<\/span><\/a><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">, but it was only in the landmark judgement of the Supreme Court in the case of <\/span><a href=\"https:\/\/indiankanoon.org\/doc\/1775396\/\" style=\"text-decoration-line: none;\"><span style=\"color: #4a6ee0; font-style: italic; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">Unnikrishnan JP vs State of Andhra Pradesh &amp; other<\/span><span style=\"color: #0e101a; font-style: italic; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">s<\/span><\/a><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\"> that RTE got incorporated under <\/span><a href=\"https:\/\/theindianconstitution.com\/article-21a-education-right\/\" style=\"text-decoration-line: none;\"><span style=\"color: #4a6ee0; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">Article 21(A)<\/span><\/a><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\"> [Part III- The Fundamental Rights]. It was not until 2009 that the parliament enacted the <\/span><a href=\"https:\/\/legislative.gov.in\/sites\/default\/files\/A2009-35_0.pdf\" style=\"text-decoration-line: none;\"><span style=\"color: #4a6ee0; font-style: italic; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">Right of Children to Free and Compulsory Education Act, 2009<\/span><\/a><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">, commonly known as the <\/span><span style=\"color: #0e101a; font-style: italic; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">Right to Education Act<\/span><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\"> or the <\/span><span style=\"color: #0e101a; font-style: italic; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">RTE Act,<\/span><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\"> making education <\/span><a href=\"https:\/\/righttoeducation.in\/forums\/suggest-rte-amendments\/section-3-right-of-child-to-free-and-compulsory-education\" style=\"text-decoration-line: none;\"><span style=\"color: #4a6ee0; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">free and compulsory for all children in the age group of 6-14 years<\/span><\/a><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">.\u00a0\u00a0\u00a0<\/span><\/span><\/p>\n<p><span style=\"font-family: inherit; font-size: medium;\"><br \/><\/span><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.8; margin-bottom: 0pt; margin-top: 0pt; text-align: justify;\"><span style=\"font-family: inherit; font-size: medium;\"><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">Education, if not taken up seriously, is even frowned upon by the members of our family. This shows its importance and relevance in this day and age. <\/span><a href=\"https:\/\/www.downtoearth.org.in\/news\/governance\/india-has-pushed-back-poverty-still-home-to-most-poor-people-in-world-undp-index-85502\" style=\"text-decoration-line: none;\"><span style=\"color: #4a6ee0; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">India is laden with poverty and illiteracy<\/span><\/a><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">, which makes it difficult for people who cannot afford to secure education for future generations. To counter this effect, the parliament in the year 2009 enacted the RTE Act with the aim of reducing the gap of illiteracy by providing free education to all children in the age group of 6-14 years. It was seen as a very novel initiative though a bit late but indeed in line. It provided, in various ways, opportunities for underprivileged children to educate and gave them a level playing field by providing them with the required quality and quantity of education. The government at the time was aware of the <\/span><a href=\"https:\/\/www.economicsdiscussion.net\/articles\/problems-faced-in-the-progress-of-education-in-india\/2291\" style=\"text-decoration-line: none;\"><span style=\"color: #1155cc; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">challenges it faced <\/span><\/a><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">in its education sector, some of them were \u2013 shortage of schools, teachers, and quality education, so with the help of public-private partnerships, it set on to decrease the gap and make the most of it. The Act lays down various rules to maintain the quality of education, some of which are discussed below.\u00a0<\/span><\/span><\/p>\n<p><span style=\"font-family: inherit; font-size: medium;\"><br \/><\/span><\/p>\n<p role=\"presentation\" style=\"line-height: 1.8; margin-bottom: 0pt; margin-top: 0pt; text-align: justify; white-space: pre;\"><span style=\"font-size: medium;\"><span style=\"font-family: inherit;\"><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">It envisages a specific <\/span><a href=\"https:\/\/righttoeducation.in\/forums\/suggest-rte-amendments\/section-25-pupil-teacher-ratio\" style=\"text-decoration-line: none;\"><span style=\"color: #1155cc; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">student-teacher ratio,<\/span><\/a><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\"> and the teacher so appointed should be adequately trained and <\/span><a href=\"https:\/\/righttoeducation.in\/forums\/suggest-rte-amendments\/section-23-qualifications-for-appointment-and-terms-and-conditions-of-service-of-teachers\" style=\"text-decoration-line: none;\"><span style=\"color: #1155cc; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">qualified<\/span><\/a><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">, imparting standard and on-par education.\u00a0<\/span><\/span><span style=\"color: #0e101a; font-family: inherit; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">To have <\/span><a href=\"https:\/\/righttoeducation.in\/forums\/suggest-rte-amendments\/section-19-norms-and-standards-for-school\" style=\"font-family: inherit; text-decoration-line: none;\"><span style=\"color: #1155cc; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">separate <\/span><\/a><span style=\"color: #0e101a; font-family: inherit; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">toilet facilities, maintain hygiene and sanitary conditions in schools, and have adequate drinking water facilities.\u00a0<\/span><span style=\"color: #0e101a; font-family: inherit; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">The Act not only <\/span><a href=\"https:\/\/righttoeducation.in\/forums\/suggest-rte-amendments\/section-17-prohibition-of-physical-punishment-and-mental-harassment-to-child\" style=\"font-family: inherit; text-decoration-line: none;\"><span style=\"color: #4a6ee0; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">does away with corporal punishment<\/span><\/a><span style=\"color: #0e101a; font-family: inherit; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\"> to have a healthy environment that students can study in but also with the <\/span><a href=\"https:\/\/righttoeducation.in\/forums\/suggest-rte-amendments\/section-15-no-denial-of-admission\" style=\"font-family: inherit; text-decoration-line: none;\"><span style=\"color: #4a6ee0; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">screening of students for admission<\/span><\/a><span style=\"color: #0e101a; font-family: inherit; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">s, ensuring that no discrimination occurs and students are not denied their rights. <\/span><span style=\"color: #0e101a; font-family: inherit; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">It also had <\/span><a href=\"https:\/\/righttoeducation.in\/forums\/suggest-rte-amendments\/section-4-special-provisions-for-children-not-admitted-to-or-who-have-not-completed-elementary-education\" style=\"font-family: inherit; text-decoration-line: none;\"><span style=\"color: #1155cc; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">provisions for training out-of-school children <\/span><\/a><span style=\"color: #0e101a; font-family: inherit; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">with the flexibility of admitting a child directly in their age-appropriate class on account of them not completing their elementary education or having not been admitted to any school and giving them special training to be on par with others.\u00a0<\/span><span style=\"color: #0e101a; font-family: inherit; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">But one of the most notable moves was the <\/span><a href=\"https:\/\/www.livemint.com\/Politics\/v8XGnE7Bw4zVJofReOjvlI\/SC-upholds-25-reservation-for-poor-in-schools-through-RTE.html\" style=\"font-family: inherit; text-decoration-line: none;\"><span style=\"color: #4a6ee0; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">reservation of 25 per cent of the seats in private schools to economically weaker students or socially disadvantaged groups<\/span><\/a><span style=\"color: #0e101a; font-family: inherit; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\"> with the aim of boosting social inclusion and paving the way for a more just and equal country.<\/span><\/span><\/p>\n<p><span style=\"font-family: inherit; font-size: medium;\"><br \/><\/span><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.8; margin-bottom: 0pt; margin-top: 0pt; text-align: justify;\"><span style=\"color: #0e101a; font-family: inherit; font-size: medium; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">Things are different on paper and in reality, and often the reality is disappointing. The RTE Act, which was introduced to secure the rights of children and ensure them free education, failed in its purpose. A noteworthy criticism that is laid out is that the Act does not cover children below six years of age, limiting their learning and potential outcomes. Another criticism is that the criteria laid down to supplement documents such as BPL certificates, birth certificates, etc., for admissions withholds many children who cannot furnish these, especially orphans, exempting them from the benefits. A major problem with public schools is the untrained teachers who are unable to give on-par education to the students and inevitably stunt their growth and potential.\u00a0<\/span><\/p>\n<p><span style=\"font-family: inherit; font-size: medium;\"><br \/><\/span><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.8; margin-bottom: 0pt; margin-top: 0pt; text-align: justify;\"><span style=\"font-family: inherit; font-size: medium;\"><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">As previously discussed, as to how 25 per cent reservation in schools was a one-of-a-kind initiative to boost social inclusion, it is evident now how it has been <\/span><a href=\"https:\/\/www.indiatoday.in\/education-today\/featurephilia\/story\/why-our-school-admissions-process-is-plagued-with-frauds-1640920-2020-01-28\" style=\"text-decoration-line: none;\"><span style=\"color: #1155cc; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">misused <\/span><\/a><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">by well-to-do families by purchasing the reserved seats in schools or even producing fake certificates to claim the benefits of RTE Act. Not only this but also where children who have been able to <\/span><a href=\"https:\/\/www.educationworld.in\/karnataka-rte-quota-students-face-discrimination-in-some-private-schools\/\" style=\"text-decoration-line: none;\"><span style=\"color: #1155cc; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">claim this benefit <\/span><\/a><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\">are prone to be shunned on account of their background. There is also a dire need for <\/span><a href=\"https:\/\/www.ndtv.com\/india-news\/many-government-schools-have-no-toilets-drinking-water-and-boundary-walls-survey-reveals-526609\" style=\"text-decoration-line: none;\"><span style=\"color: #1155cc; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">proper infrastructure<\/span><\/a><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\"> in place to meet the demands of the growing student population, with standard toilets missing in the public schools of India. Above everything else, India today, as of the latest data, only spends about <\/span><a href=\"https:\/\/data.worldbank.org\/indicator\/SE.XPD.TOTL.GD.ZS?locations=IN\" style=\"text-decoration-line: none;\"><span style=\"color: #1155cc; font-variant-east-asian: normal; font-variant-numeric: normal; text-decoration-line: underline; text-decoration-skip-ink: none; vertical-align: baseline; white-space: pre-wrap;\">4.5 per cent<\/span><\/a><span style=\"color: #0e101a; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\"> of its GDP on education, making achieving the set targets a larger dream which needs to be increased subsequently.<\/span><\/span><\/p>\n<p><span style=\"font-family: inherit; font-size: medium;\"><br \/><\/span><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.8; margin-bottom: 0pt; margin-top: 0pt; text-align: justify;\"><span style=\"color: #0e101a; font-size: medium; font-variant-east-asian: normal; font-variant-numeric: normal; vertical-align: baseline; white-space: pre-wrap;\"><span style=\"font-family: inherit;\">The government must shore up its efforts to ensure that India meets its current demand. Some of the problems discussed above are what is plaguing the education sector and making education a right, a difficulty in itself. These issues need to be addressed to realise the true spirit of the Right to Education.
