{"id":204518,"date":"2025-04-25T10:02:22","date_gmt":"2025-04-25T10:02:22","guid":{"rendered":"https:\/\/peraltafinancing.com\/business\/legal\/kaplans-use-of-ai-for-sqe-question-development-comes-under-scrutiny-amid-us-bar-row\/"},"modified":"2025-04-25T10:02:22","modified_gmt":"2025-04-25T10:02:22","slug":"kaplans-use-of-ai-for-sqe-question-development-comes-under-scrutiny-amid-us-bar-row","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=204518","title":{"rendered":"Kaplan&#8217;s use of AI for SQE &#8216;question development&#8217; comes under scrutiny amid US Bar row"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>Company informs <em>Legal Cheek<\/em> that no questions generated by AI are used in SQE assessments<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"size-full wp-image-182351\" src=\"https:\/\/www.legalcheek.com\/wp-content\/uploads\/2022\/12\/AdobeStock_232585655.jpeg\" alt=\"\" width=\"700\" height=\"389\" srcset=\"https:\/\/www.legalcheek.com\/wp-content\/uploads\/2022\/12\/AdobeStock_232585655.jpeg 700w, https:\/\/www.legalcheek.com\/wp-content\/uploads\/2022\/12\/AdobeStock_232585655-300x167.jpeg 300w\" sizes=\"(max-width: 700px) 100vw, 700px\"\/><strong>Kaplan\u2019s use of AI for SQE \u201cquestion development\u201d has come under scrutiny amid a row in the US about California Bar exam questions being artificially generated.<\/strong><\/p>\n<p>A press statement from the California Bar <a href=\"https:\/\/www.calbar.ca.gov\/About-Us\/News\/News-Releases\/CBE-Recommends-Scoring-Adjustments-for-February-Bar-Exam?utm_medium=email&amp;_hsenc=p2ANqtz--CnICnXvZiq6A53tchi6LPt5OxbjzM9C4_1kkeOxqbeYzOfmn6zsRLv3qbUjkYrgHn4bNs1tlip8xPG75ELvG8Khg3AA&amp;_hsmi=357745879&amp;utm_content=357745879&amp;utm_source=hs_email\" target=\"_blank\">earlier this week<\/a> about scoring adjustments to the February bar exam claimed that some multiple-choice questions were \u201cdeveloped with the assistance of AI\u201d before being reviewed \u201cby content validation panels and a subject matter expert\u201d.<\/p>\n<p>The AI questions came from independent psychometricians, not Kaplan, which produces its own question sets for the same US exam, which it administers.<\/p>\n<p>Mary Basick, assistant dean at the University of California, Irvine, Law School, voiced her outrage in a LinkedIn post that has since gone viral: \u201cThis is unacceptable &amp; utterly outrageous.\u201d Others echoed her frustration in the comments. \u201cJust when I thought this couldn\u2019t get more outrageous,\u201d one wrote. \u201cWow. That is just insane,\u201d another added.<\/p>\n<p><iframe loading=\"lazy\" src=\"https:\/\/www.linkedin.com\/embed\/feed\/update\/urn:li:share:7320306231170994178\" height=\"473\" width=\"504\" frameborder=\"0\" allowfullscreen=\"\" title=\"Embedded post\"><\/iframe><\/p>\n<p>In the UK, where Kaplan develops and runs the SQE on behalf of the Solicitors Regulation Authority (SRA), the company told <em>Legal Cheek<\/em> that AI may be used for \u201cquestion development\u201d, highlighting a <a href=\"https:\/\/kaplan.co.uk\/about\/policies\/artificial-intelligence-commitment-statement#:~:text=We%20will%20take%20active%20steps,bias%2C%20discrimination%2C%20or%20harm.&amp;text=We%20are%20committed%20to%20maintaining,up%2Dto%2Ddate%20information\" target=\"_blank\">page on its website<\/a> that outlines its commitment to using it in a \u201cpositive and ethical\u201d way. <\/p>\n<p>A spokesperson for Kaplan said:<\/p>\n<blockquote>\n<p>\u201cKaplan employs a team of solicitors who write, edit and review SQE questions. All questions go through rigorous drafting, editing and review stages involving a minimum of three solicitors of England and Wales. AI may be used as one of a number of tools to assist the team with question development, in line with our published commitment statement around the use of AI.\u201d<\/p>\n<\/blockquote>\n<p>They added:<\/p>\n<blockquote>\n<p>\u201cTo be clear, we have not used any questions generated by AI in any SQE assessments. All questions used in SQE assessments are drafted by solicitors of England and Wales. We have recently started using the AI tool within Lexis for legal research and associated tasks. And, in addition to our established quality assurance checks, we are starting to trial AI to provide an extra layer of quality assurance. This is on top of quality assurance processes that are already in place.\u201d<\/p>\n<\/blockquote>\n<p>Kaplan\u2019s use of AI comes against a backdrop of past issues with the delivery and administration of the SQE \u2014 <a href=\"https:\/\/www.legalcheek.com\/2024\/04\/breaking-kaplan-issues-apology-as-175-students-wrongly-informed-of-sqe1-failure\/\">most notably in April last year<\/a>, when 175 students were mistakenly told they had failed, leading to some aspiring solicitors having their training contract offers revoked. <\/p>\n<p>It also follows the <a href=\"https:\/\/www.legalcheek.com\/2025\/03\/sqe-exam-fees-to-rise-for-third-time\/\">recent news<\/a> that SQE exam fees are set to rise for a third time, with the SRA \u2014 which partners with Kaplan to deliver the SQE \u2014 citing inflation as one of the reasons.<\/p>\n<\/p><\/div>\n<p><script src=\"https:\/\/connect.facebook.net\/en_US\/sdk.js#xfbml=1&#038;version=v2.2\" async><\/script><br \/>\n<br \/><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Company informs Legal Cheek that no questions generated by AI are used in SQE assessments Kaplan\u2019s use of AI for SQE \u201cquestion development\u201d has come under scrutiny amid a row in the US about California Bar exam questions being artificially generated.
