A nasty one, but a bump nonetheless, because the world is on the road to zero-emission fuels and vehicles no matter what. That was one takeaway from \u201cCharging Ahead,\u201d the UCLA Emmett Institute\u2019s annual symposium held on April 9 \u2014 devoted this year to cutting vehicle pollution during the next four years and beyond. Another overarching idea: states like California and cities like Los Angeles have a lot of tools \u2014 it\u2019s time to break them out.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">More than 175 people turned out for the all-day symposium at UCLA Law, co-hosted by the <strong>California Lawyers Association\u2019s Environmental Law Section<\/strong>\u00a0and co-sponsored by <strong>LA Climate Week<\/strong> and the <strong>UCLA Journal of Environmental Law &amp; Policy.<\/strong>\u00a0 The event featured a keynote address by California Attorney General <\/span><strong>Rob Bonta<\/strong><span style=\"font-weight: 400;\">, three expert panels on a variety of transportation themes, and some inspiring <a href=\"https:\/\/youtu.be\/MC8Vpr1YvhI?si=Uk-nOzh6WgUv-Llm&amp;t=9\" target=\"_blank\" rel=\"noopener\">plenary remarks<\/a> from Emmett Institute Faculty Director <\/span><strong>Ann Carlson<\/strong> <span style=\"font-weight: 400;\">based on a forthcoming book about how Los Angeles cleaned up its air.\u00a0 We\u2019ve done hard things, and we can do them again, she told the crowd.\u00a0<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-42841\" src=\"https:\/\/legal-planet.org\/wp-content\/uploads\/2025\/04\/IMG_4211-870x1024.jpg\" alt=\"\" width=\"300\" height=\"353\" srcset=\"https:\/\/legal-planet.org\/wp-content\/uploads\/2025\/04\/IMG_4211-870x1024.jpg 870w, https:\/\/legal-planet.org\/wp-content\/uploads\/2025\/04\/IMG_4211-255x300.jpg 255w, https:\/\/legal-planet.org\/wp-content\/uploads\/2025\/04\/IMG_4211-768x904.jpg 768w, https:\/\/legal-planet.org\/wp-content\/uploads\/2025\/04\/IMG_4211.jpg 1088w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\"\/><span style=\"font-weight: 400;\">\u201cIn the 1970s, the average kid in Southern California \u2014 that would include me \u2014 had blood levels that were <em>1000 percent higher than the levels that were found in kids in Flint, Michigan<\/em> after the problems with the water system in Flint,\u201d Carlson said. \u201cLead concentrations in the air were <em>50 times higher than they are today,<\/em> and we were all breathing that in. Southern California has not violated the standard for lead since 1993. That\u2019s pretty extraordinary.\u201d Carlson told the story of those who helped topple LA\u2019s smog, ending with, \u201cIndividuals matter, government leaders, scientists, lawyers, activists, reporters \u2014 what we do matters in an extraordinarily difficult time.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Attorney General <a href=\"https:\/\/youtu.be\/L0vu9iVx13Q\" target=\"_blank\" rel=\"noopener\">Rob Bonta echoed that sentiment <\/a>and focused on protecting California\u2019s policies, values, and authorities. \u201cWe will be able to continue to defend California\u2019s progress against the targeting of our climate action by the Trump administration,\u201d he said, calling out the state\u2019s greenhouse gas reduction goals, cap-and-trade law, and clean vehicle waivers as ones he expects to successfully defend.\u00a0 <\/span><span style=\"font-weight: 400;\">Below are more key takeaways and videos of each of the panels.\u00a0 <\/span><\/p>\n<h2><b>\u201cI started making a list of threats and it went on and on and on.\u201d<\/b><\/h2>\n<p><iframe loading=\"lazy\" title=\"&quot;Charging Ahead&quot; Plenary and Panel 1: Powering cars more cleanly and efficiently\" width=\"840\" height=\"473\" src=\"https:\/\/www.youtube.com\/embed\/MC8Vpr1YvhI?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Panel One<\/strong> explored where we stand with <\/span><span style=\"font-weight: 400;\">zero-emission vehicles, the biggest threats, and solutions to maintaining momentum. <\/span><span style=\"font-weight: 400;\">\u201cI started making a list of threats and it went on and on and on,\u201d said <\/span><strong>Joe Lyou<\/strong><span style=\"font-weight: 400;\"><strong>,<\/strong> of the Coalition for Clean Air, who was joined by Carlson; <\/span><strong>Brian Goldman<\/strong><span style=\"font-weight: 400;\"><strong>,<\/strong> with the Office of California Governor Gavin Newsom; <\/span><strong>Craig Segall<\/strong><span style=\"font-weight: 400;\">, Craig Segall Consulting LLC; and moderator <\/span><strong>Alexander Nieves<\/strong><span style=\"font-weight: 400;\">, who covers transportation for POLITICO\u2019s <a href=\"https:\/\/www.politico.com\/newsletters\/california-climate\" target=\"_blank\" rel=\"noopener\">California Climate newsletter<\/a>. <\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">The panelists found consensus that the transition to EVs is at a point of no return, at least globally, but that the burgeoning effort to electrify heavy-duty truck fleets is more fragile. <\/span><\/li>\n<li><span style=\"font-weight: 400;\">Segall noted that blue states like Maryland, Massachusetts, and Oregon have pursued, or are considering, rollbacks to their <\/span><a href=\"https:\/\/www.ttnews.com\/articles\/epa-block-clean-trucks-rule\"><span style=\"font-weight: 400;\">California-based heavy truck emissions laws<\/span><\/a><span style=\"font-weight: 400;\">. \u201cPart of that is, I think, an overreading of the election results, thinking that affordability means all environmental policies are to be slowed or scrapped, or a willingness to lean toward Trump\u2019s side of the issue,\u201d Segall said, calling it a \u201ccatastrophic political misperception.\u201d <\/span><\/li>\n<li>Some on the panel suggested California should fund its own state-version of the Inflation Reduction Act-style programs and think about \u201cmoney rather than regulation\u201d as the thing to accelerate clean technology and throw a lifeline to firms relying on federal incentives. Doing so could require new revenue streams and creative thinking about how to get around the obstacles presented by California\u2019s infamous Prop 13 as well as Proposition 26<span style=\"font-weight: 400;\">. That may require going to voters through the ballot initiative process.\u00a0<\/span><\/li>\n<li>There is some low hanging fruit: we spend more on highway construction than any other form of transit.<\/li>\n<li>\u201cI think we plan for the next governor. What can we put on the next governor\u2019s plate, that they\u2019re willing to do,\u201d Lyou said. \u201cThings like a road user charge, things like \u2018split roll,\u2019 other things that could really fundamentally change the dynamics of how we invest in the future.\u201d<\/li>\n<li><span style=\"font-weight: 400;\">Another climate policy reorientation the panel discussed was talking more about air pollution and less about climate pollution. <\/span><span style=\"font-weight: 400;\">\u201cWe focus too much on the climate pollution benefits of these policies and not the air quality benefits,\u201d Carlson said. \u201cWe have done a poor job in articulating the benefits people get from clean air.\u201d<\/span><\/li>\n<\/ul>\n<h2><b>\u201cWarehouse, you are the reason.\u201d<\/b><\/h2>\n<p><iframe loading=\"lazy\" title=\"&quot;Charging Ahead&quot; Panel 2: Place-based approaches to transforming fleets\" width=\"840\" height=\"473\" src=\"https:\/\/www.youtube.com\/embed\/oE-EpLCv2sk?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Panel Two<\/strong> <\/span><span style=\"font-weight: 400;\">focused on \u201cplace-based approaches to transforming fleets\u201d in cities and local air districts, including the role of Zero Emission Vehicle-only zones and Indirect Source Rules. The panelists were <\/span><strong>Jessi Hafer Fierro<\/strong><span style=\"font-weight: 400;\"> from the California Air Resources Board; <\/span><strong>Adriano Martinez<\/strong><span style=\"font-weight: 400;\">, Deputy Managing Attorney of Earthjustice; <\/span><strong>Amy Turne<\/strong><span style=\"font-weight: 400;\"><strong>r<\/strong> of Columbia Law School; and UCLA Law\u2019s <\/span><strong>Brennon Mendez<\/strong><span style=\"font-weight: 400;\"> as moderator. <\/span>The Emmett Institute is publishing <strong>a new policy brief later this week on the promise of using ISRs to clean our air<\/strong>\u00a0so stayed tuned.<\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">Fierro started with slides on a range of California\u2019s clean air policies and an introduction to three words that we\u2019d hear a lot the rest of the day: Indirect Source Rules. These are rules for regulating pollution hotspots by targeting the mobile pollution sources that are drawn to them, like cars, trucks, Fierro explained. \u201cYou say, ok, warehouse, you are the reason why those mobile source emissions are here,\u201d she said. \u201cThey\u2019re driving around because of the warehouse. It is the magnet.\u201d Rather than regulate the mobile sources themselves, you assign them to the facility. <\/span><\/li>\n<li><span style=\"font-weight: 400;\">Turner continued with a presentation on <\/span><span style=\"font-weight: 400;\">the <a href=\"https:\/\/scholarship.law.columbia.edu\/cgi\/viewcontent.cgi?article=1229&amp;context=sabin_climate_change\" target=\"_blank\" rel=\"noopener\">current gap<\/a><\/span><span style=\"font-weight: 400;\"> that exists in regulating the emissions from e-commerce warehouses but also ticked through some innovative city approaches. <\/span><\/li>\n<li>Martinez recounted the process of passing a Warehouse Indirect Source Rule<span style=\"font-weight: 400;\"> in the South Coast Air Quality Management District and <a href=\"https:\/\/earthjustice.org\/experts\/adrian-martinez\/california-reins-in-its-smoggy-warehouse-problem\" target=\"_blank\" rel=\"noopener\">the <\/a><\/span>early evidence<span style=\"font-weight: 400;\"> that the rule is cleaning up LA\u2019s air while not threatening the ever-growing logistics industry the way critics of the policy said it would. <\/span><span style=\"font-weight: 400;\">In fact, South Coast concluded that over the last 10 years, the total inventory of warehousing space increased by 41% and warehouse rental prices increased by 164% in the district.\u202f<\/span><\/li>\n<li><span style=\"font-weight: 400;\">It\u2019s a winning formula, so why have only 2 of California\u2019s 35 air districts adopted ISRs? <\/span><span style=\"font-weight: 400;\">\u201cThe issues that are preventing us from making more progress with Indirect Source Rules are not legal, are not scientific \u2014 they are political.\u201d said Martinez. <\/span><\/li>\n<li><span style=\"font-weight: 400;\">Turner noted that both the city and state of New York are currently considering an ISR and that frontline communities themselves are giving central input to those potential warehouse rules, including delivery drivers and logistics employees. \u201cMany distribution centers are located in low-income, environmental justice communities,\u201d Turner said. \u201cThis is a policy area where the city at least and advocates to a great extent have been very good about bringing those folks to the fore.\u201d<\/span><\/li>\n<li>Asked about using \u201cplace-based\u201d regulations toward sports facilities ahead of the 2028 LA Olympics, Martinez said it\u2019s a good idea, but that Earthjustice is focused first on tougher rules for: the port, rail, and airports.<\/li>\n<li>A bill pending in Sacramento (<span data-olk-copy-source=\"MessageBody\">AB 914 by Assemblymember Robert Garcia) would clarify CARB\u2019s ability to adopt ISRs alongside local air districts. An audience question asked if it was needed? \u201cI think the authority is stronger if we can get it specifically, directly stated in the health and safety code,\u201d Fierro said.\u00a0<\/span><\/li>\n<\/ul>\n<h2><b>\u201cWe\u2019re building more but not getting tons of more service.\u201d<\/b><\/h2>\n<p><iframe loading=\"lazy\" title=\"&quot;Charging Ahead&quot; Panel 3: Transportation for all\" width=\"840\" height=\"473\" src=\"https:\/\/www.youtube.com\/embed\/P8Joz0qLyNw?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Panel Three<\/strong> got us out of cars and trucks and into metro trains and buses. Panelists were <\/span><strong>Madeline Brozen<\/strong><span style=\"font-weight: 400;\">, UCLA Luskin School of Public Affairs;\u00a0 <\/span><strong>Bryn Moncelsi<\/strong><span style=\"font-weight: 400;\">, Climate Resolve; and moderator <\/span><strong>Cara Horowitz<\/strong><span style=\"font-weight: 400;\">, the UCLA Emmett Institute\u2019s executive director. <\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">Moncelsi explained that California has made real strides through AB 32 but that the state is not on track for 2030 carbon goals, because of the tricky transportation sector. Emissions reductions, she said, has 3 legs of the stool: shifting fuel sources (electrification), decarbonizing the electric sector, and reducing vehicle miles traveled (VMT). <\/span><\/li>\n<li><span style=\"font-weight: 400;\">Moncelsi presented slides on recent legislative approaches to creating more sustainable communities through regional planning and where those approaches are falling short on actually driving down VMT. \u201cWe can\u2019t just be putting more buses out there into traffic and making a difference,\u201d she said, noting that bus-only lanes and improvements to the job of bus driving are important. <\/span><\/li>\n<li><span style=\"font-weight: 400;\">We need to invest in more transit options, the panel agreed and follow it with better tools to make that service go further. When it comes to actually expanding public transit, LA has work to do, the panel agreed.\u00a0 \u201cWe are not putting more bus service out on the streets \u2014 and that is the backbone of our service in Los Angeles, the backbone of pretty much most transit service in the United States. Even on the rail side, we are building more, but we are not really getting a ton of new service.\u201d<\/span><\/li>\n<li>Brozen gave a talk based on case studies that focused, in a word, on balance \u2014 balancing quality of life with transportation opportunities, balancing the goal of <i style=\"font-size: 1rem;\">reducing <\/i><span style=\"font-weight: 400;\">VMT and <\/span><i style=\"font-size: 1rem;\">increasing<\/i><span style=\"font-weight: 400;\"> transportation access. And doing so in a way that accounts for a wide variety of income levels and transportation needs \u201cSome people need to be allowed to drive more,\u201d she said. That doesn\u2019t mean that we want to see an increase in car ownership, but an increase in access to many different, competitive modes of transportation, including rideshare, robust transit service, and subsidies for lower-income people to access multiple modes of transportation. <\/span><\/li>\n<li><span style=\"font-weight: 400;\">\u201cThe bottom line is the best tool to get higher-income people to drive less is to appropriately price our transportation system,\u201d Brozen said. \u201cWe have a woefully underpriced and very messed up market that we\u2019ve created that has\u2026 very little connection between how much you do the thing and how much you pay.\u201d<\/span><\/li>\n<li>Congestion pricing, or road pricing, was one example the panel covered. Road pricing works, as we\u2019re seeing in the New York <span style=\"font-weight: 400;\">where congestion pricing program is just 3 months in, but <a href=\"https:\/\/www.msn.com\/en-us\/money\/realestate\/how-well-is-congestion-pricing-doing-very\/ar-AA1CYT3O?ocid=BingNewsSerp\" target=\"_blank\" rel=\"noopener\">the preliminary results are very encouraging<\/a>. \u201cIt\u2019s reducing cars \u2014 60,000 cars poof off the road, you have travel times down, you have \u2018on time performance\u2019 going up, you have transit riding going up, the streets are safer, fewer people are honking, and by the way it\u2019s raising $50 million a month,\u201d Brozen said. \u201cThere\u2019s not any other tools in the toolbox that do all these things at once.\u201d\u00a0<\/span><\/li>\n<\/ul>\n<p>Many more big ideas and solutions surfaced during the panels so do watch the videos above.
