{"id":193453,"date":"2025-04-19T21:00:08","date_gmt":"2025-04-19T21:00:08","guid":{"rendered":"https:\/\/peraltafinancing.com\/activist\/our-fight-for-social-security\/"},"modified":"2025-04-19T21:00:08","modified_gmt":"2025-04-19T21:00:08","slug":"our-fight-for-social-security","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=193453","title":{"rendered":"Our Fight for Social Security"},"content":{"rendered":"<p> <br \/>\n<br \/><img decoding=\"async\" src=\"https:\/\/progressive.org\/downloads\/21658\/download\/HandsOffDOGE.jpg?cb=83ca817d12a7e97c2cd577d2b6fb3d51\" \/><\/p>\n<div id=\"content\" data-transition=\"content\" data-loop=\"false\" itemprop=\"articleBody\">\n<div>\n<p class=\"lead\">It made me very happy to hear that some organizations representing people with disabilities, and some disabled folks themselves, are engaging in the highly honorable activity of suing the hell out of the administration of the squatter currently occupying the White House.<\/p>\n<p>The federal <a href=\"https:\/\/www.aapd.com\/wp-content\/uploads\/2025\/04\/AAPD-v.-SSA-Complaint.pdf\" target=\"_blank\" aria-label=\"Link opens in new window (lawsuit)\">lawsuit<\/a> that they filed on April 2, which names Elon Musk as a defendant, challenges all the slashing and burning that\u2019s been going on lately at the Social Security Administration (SSA).\u00a0<\/p>\n<p>\u201cThe defendants\u2019 actions,\u201d the lawsuit says, \u201care an unprecedented and unconstitutional assault on Social Security benefits, concealed beneath the hollow pretense of bureaucratic \u2018reform.\u2019 \u201d It refers to the squatter\u2019s notion of reform as \u201cadministrative vandalism.\u201d<\/p>\n<p>The lawsuit was filed by the <a href=\"https:\/\/www.aapd.com\/\" target=\"_blank\" aria-label=\"Link opens in new window (American Association of People with Disabilities)\">American Association of People with Disabilities<\/a>, along with four other organizations and seven individuals who rely on Social Security benefits. Among other things, the plaintiffs take issue with the recently announced <a href=\"https:\/\/www.usatoday.com\/story\/money\/personalfinance\/2025\/02\/28\/social-security-administration-layoffs-what-to-expect\/80843682007\/\" target=\"_blank\" aria-label=\"Link opens in new window (staff and service reductions)\">staff and service reductions<\/a> at SSA, particularly the plan to cut the number of SSA staff from <a href=\"https:\/\/blog.ssa.gov\/social-security-announces-workforce-and-organization-plans\/\" target=\"_blank\" aria-label=\"Link opens in new window (57,000 to 50,000)\">57,000 to 50,000<\/a>, which, according to the complaint, would be the lowest staff level at the agency since 1972.<\/p>\n<p>The complaint also objects to the plan to reduce the number of SSA regional offices from ten to four. \u201cIn an agency already beset by mounting backlogs and debilitating delays,\u201d it says, \u201cthe closure of offices, and reduction of staff only exacerbate an already untenable situation.\u201d\u00a0<\/p>\n<p>It notes that the average wait time for an initial SSA disability eligibility determination is currently eight months. Reducing the SSA workforce by 7,000 people, the complaint says, \u201cwill increase claim processing times by at least thirty-one additional days, and [cause] an additional 272,000 backlogged cases.\u201d\u00a0<\/p>\n<p>All this hatchet work is being done at the direction of Musk, the de facto leader of the <a href=\"https:\/\/doge.gov\/\" target=\"_blank\" aria-label=\"Link opens in new window (Department of Government Efficiency (DOGE))\">Department of Government Efficiency (DOGE)<\/a>, which has been leading the austerity rampage through federal agencies. \u201cMeanwhile,\u201d the complaint says, \u201cfalse claims by Defendant Musk and DOGE regarding widespread fraud within Social Security serve a clear strategic purpose to justify drastic agency cuts that would deprive eligible beneficiaries of their rightful payments.\u201d<\/p>\n<p>Verified cases of fraud account for only 0.3 percent of SSA claims, a rate the complaint calls \u201cminuscule.\u201d It continues: \u201cThese numbers expose Defendant Musk\u2019s rhetoric for what it is\u2014an attempt to manufacture a crisis to erode public confidence in Social Security and justify his dismantlement of SSA.\u201d<\/p>\n<p>These actions, the lawsuit charges, violate <a href=\"https:\/\/www.hhs.gov\/sites\/default\/files\/ocr\/civilrights\/resources\/factsheets\/504.pdf\" target=\"_blank\" aria-label=\"Link opens in new window (Section 504)\">Section 504<\/a> of the Rehabilitation Act of 1973 as well as the First and Fifth Amendments of the U.S. Constitution and the<a href=\"https:\/\/www.epa.gov\/laws-regulations\/summary-administrative-procedure-act\" target=\"_blank\" aria-label=\"Link opens in new window ( Administrative Procedure Act)\"> Administrative Procedure Act<\/a>.
