Kacsmaryk of the <a href=\"https:\/\/www.txnd.uscourts.gov\/\">United States District Court for the Northern District of Texas<\/a> struck down two Center for Medicare and Medicaid Services (\u201cCMS\u201d) staffing provisions for <a href=\"https:\/\/sandbergphoenix.com\/industry\/long-term-care-senior-living\/\">nursing homes<\/a> promulgated by the Biden Administration in 2024. District Judge Kacsmaryk reasoned CMS overstepped its authority by essentially \u201crevising\u201d clearly delineated staffing requirements set by Congress when it issued the two provisions.<\/p>\n<p>The two voided provisions from the case include the \u201c24\/7 Requirement\u201d and the \u201cHPRD Requirements.\u201d The \u201c24\/7 Requirement\u201d mandates that a \u201cfacility must have a registered nurse (\u201cRN\u201d) onsite 24 hours per day, for 7 days a week that is available to provide direct resident care.\u201d <em>See <\/em>42 C.F.R. \u00a7 483.35(c)(1) (2024). The \u201cHPRD Requirements\u201d set out three minimum staffing standards for facilities. First, the \u201cfacility must meet or exceed a minimum of 3.48 hours per resident day for total nurse staffing. <em>Id.<\/em> \u00a7 483.35(b)(1). Second, to do so, a facility must have a \u201cminimum of 0.55 hours per resident day for registered nurses.\u201d <em>Id.<\/em> \u00a7 483.35(b)(1)(i). Third, a facility must have a \u201cminimum of 2.45 hours per resident day for nurse aides.\u201d <em>Id<\/em>. \u00a7 483.35(B)(1)(ii).<\/p>\n<p>In the <a href=\"https:\/\/assets.law360news.com\/2322000\/2322240\/https-ecf-txnd-uscourts-gov-doc1-177117597984.pdf\">25-page opinion<\/a>, Judge Kacsmaryk reasoned CMS\u2019 \u201c24\/7 Requirement\u201d impermissibly expands the [42 U.S.C. \u00a7 1396r(b)(4)(C)(i)(II)\u2019s] 8 hour- minimum registered professional nurse requirement to a 24-hour requirement. While the defendants in the case argued that the words \u201cat least\u201d in the statute were only meant to set a baseline, Judge Kacsmaryk did not find the agency possessed the authority to demand more from nursing facilities. Doing so, in Kacsmaryk\u2019s opinion would permit CMS to \u201crewrite clear statutory terms to suit its own sense of how the statute should operate.\u201d (citing <em>In Re Benjamin<\/em>, 932 F. 3d 293, 300 (5th Cir. 2019)).<\/p>\n<p>Judge Kacsmaryk struck down the \u201cHPRD Requirements\u201d on similar grounds, noting the statute does not present a \u201cfill up the details scenario.\u201d Rather, Congress requires nursing homes to \u201cprovide 24-hour licensed nursing services which are sufficient to meet the nursing needs of its residents.\u201d <em>See<\/em> 42 U.S.C. \u00a7 1396(b)(4)(C)(i). Because the statute goes on to reveal factors that nursing home <em>must<\/em> consider in making this determination, Judge Kacsmaryk found the HPRD\u2019s blanket three-fold requirements usurped Congress\u2019 will of the consideration of those enumerated factors.<\/p>\n<p>While nursing home industry groups have cause for excitement, facilities should still prepare to meet the standards set out by CMS beginning in May 2026 as higher courts could overturn the ruling.
