Board of Education<\/em>. They played the long game to get here\u2014a long shame.<\/p>\n<p>Many news outlets have been <a href=\"https:\/\/www.cbsnews.com\/news\/trump-fafsa-student-loans-what-does-the-department-of-education-do\/\" target=\"_blank\" aria-label=\"Link opens in new window (quick)\">quick<\/a> to <a href=\"https:\/\/www.commondreams.org\/news\/education-department-layoffs\" target=\"_blank\" aria-label=\"Link opens in new window (attribute)\">attribute<\/a> this proposal to the infamous Project 2025, but\u00a0 the idea that the federal government should take a backseat in shaping education policy is hardly a new one. Its history traces back to the<a href=\"https:\/\/teachingamericanhistory.org\/blog\/the-southern-manifesto\/\" target=\"_blank\" aria-label=\"Link opens in new window ( Southern Manifesto)\"> Southern Manifesto<\/a>, a 1956 Congressional<a href=\"https:\/\/history.house.gov\/Historical-Highlights\/1951-2000\/The-Southern-Manifesto-of-1956\/\" target=\"_blank\" aria-label=\"Link opens in new window ( proclamation)\"> proclamation<\/a> signed by nineteen U.S. Senators and eighty-two Representatives\u2014all from former Confederate states\u2014characterizing the Supreme Court\u2019s decision as judicial overreach and pledging to resist school desegregation by \u201call lawful means.\u201d<\/p>\n<p>For those who thought this movement began with contemporary billionaires and conservative think tanks, think again. The purported argument for \u201cstates\u2019 rights\u201d in education is as much about ideology as it is about historical resistance to federal intervention, particularly when that intervention sought to dismantle racial segregation. So, before we crown Project 2025 the grand villain of public education, let us take a Constitutional walk down memory lane.<\/p>\n<p>The manifesto\u2019s legal argument was based on a loose interpretation of the <a href=\"https:\/\/constitution.congress.gov\/browse\/amendment-10\/#:~:text=Tenth%20Amendment%20Rights%20Reserved%20to,respectively%2C%20or%20to%20the%20people.\" target=\"_blank\" aria-label=\"Link opens in new window (Tenth Amendment)\">Tenth Amendment<\/a> which contended that controlling education policy was not a power granted to the federal government under the Constitution and therefore should remain in the hands of the states. In doing so, it conveniently\u00a0 ignored the Fourteenth Amendment\u2019s <a href=\"https:\/\/constitution.congress.gov\/browse\/amendment-14\/\" target=\"_blank\" aria-label=\"Link opens in new window (Equal Protection Clause)\">Equal Protection Clause<\/a>, which provides a clear Constitutional basis for ensuring that state-run education systems do not violate fundamental civil rights. Decades later, the same arguments about \u201cfederal overreach\u201d persist, though often dressed in the language of <a href=\"https:\/\/www.yahoo.com\/news\/ineffective-inefficient-department-education-crosshairs-110600416.html?guccounter=1&amp;guce_referrer=aHR0cHM6Ly93d3cuZ29vZ2xlLmNvbS8&amp;guce_referrer_sig=AQAAAF3_an9X2dTBA_xC93jSv2RLnWgv_WJSKKwz129MQWNovzQp87nyHdQzMh7pb7hlbt5iK3fRgS5ld395tl7H8wvylw_dB2ko3nZJ__-rqZJLeu_3s1GH5XcJ3tAZW94HTWgCWlcD8ettxrSIoO8_ETGzqdRVkaxxYuqj-ImTvv0B\" target=\"_blank\" aria-label=\"Link opens in new window (efficiency)\">efficiency<\/a>, <a href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2025\/03\/fact-sheet-president-donald-j-trump-empowers-parents-states-and-communities-to-improve-education-outcomes\/\" target=\"_blank\" aria-label=\"Link opens in new window (parent&#x2019;s rights)\">parent\u2019s rights<\/a>, and <a href=\"https:\/\/rethinkingschools.org\/articles\/what-happened-to-local-control\/\" target=\"_blank\" aria-label=\"Link opens in new window (local control)\">local control<\/a> rather than outright defiance of racial integration.\u00a0<\/p>\n<p>The Department of Education, formally <a href=\"https:\/\/federaleducationpolicy.org\/2011\/04\/15\/department-of-education-organization-act-1979\/\" target=\"_blank\" aria-label=\"Link opens in new window (established)\">established<\/a> in 1979, has been a frequent target of conservative efforts to downsize or eliminate federal involvement in schooling. Former President Ronald Reagan <a href=\"https:\/\/www.bbc.com\/news\/articles\/ckg80x2rw58o\" target=\"_blank\" aria-label=\"Link opens in new window (tried and failed)\">tried and failed<\/a> to abolish the department during his first term, while Trump\u2019s previous Education Secretary, Betsy DeVos, supported so-called \u201c<a href=\"https:\/\/www.npr.org\/2020\/11\/19\/936225974\/the-legacy-of-education-secretary-betsy-devos\" target=\"_blank\" aria-label=\"Link opens in new window (school choice)\">school choice<\/a>\u201d initiatives.\u00a0 While making policy choices that harmed schools\u2019 abilities to teach, conservatives labeled these schools as failing, then offered their desired solution\u2014deregulation of schools\u2014for a problem they built.\u00a0<\/p>\n<p>During Trump\u2019s second campaign, the Heritage Foundation explicitly called for eliminating the Department of Education in its <a href=\"https:\/\/www.project2025.org\/\" target=\"_blank\" aria-label=\"Link opens in new window (Project 2025)\">Project 2025<\/a> policy blueprint, arguing that federal oversight of schooling is an inefficient, unconstitutional intrusion. Project 2025 advocates for block-granting federal education funds to states with minimal strings attached,\u00a0 which would transfer power back to state governments and <a href=\"https:\/\/civilrights.org\/wp-content\/uploads\/2024\/08\/Project-2025-Education.pdf\" target=\"_blank\" aria-label=\"Link opens in new window (reduce)\">reduce<\/a> federal enforcement of civil rights protections in education.<\/p>\n<p>This renewed push to dismantle federal education oversight echoes the core tenets of the Southern Manifesto. Though today\u2019s proponents of state control over education are unlikely to invoke segregationist rhetoric, the structural consequences of their policies disproportionately impact marginalized communities, much like their predecessors\u2019 efforts in the mid-twentieth century.<\/p>\n<p>Dismantling the Department of Education <a href=\"https:\/\/www.nea.org\/nea-today\/all-news-articles\/how-dismantling-department-education-would-harm-students\" target=\"_blank\" aria-label=\"Link opens in new window (would likely weaken)\">would likely weaken<\/a> enforcement of federal civil rights protections in schools\u2014such as Title IX (prohibiting sex discrimination) and the Individuals with Disabilities Education Act (IDEA)\u2014and <a href=\"https:\/\/www.epi.org\/blog\/a-strong-department-of-education-is-critical-to-public-schools\/\" target=\"_blank\" aria-label=\"Link opens in new window (widen)\">widen<\/a> disparities in school funding, curriculum standards, and educational opportunities, leading to a fragmented and inequitable system in which the quality of students\u2019 education would depend even more on their ZIP code and state politics.<\/p>\n<p>States should not always be left to their own devices. The Jim Crow South\u2019s \u201cseparate but equal\u201d doctrine was a case study in the dangers of unchecked state control over education. The federal government\u2019s role in enforcing desegregation, funding Title I schools, and ensuring equal access to education has been essential in counteracting the prevalence of racial and economic inequality.<\/p>\n<p>The movement to dismantle the Department of Education is not a novel response to bloated bureaucracy or inefficiency. It is a decades-old ideological project rooted in resistance to racial and social progress.
