They say it\u2019s about safety. But HB445 is a blunt instrument disguised as protection \u2014 and the fallout will be severe.<\/p>\n<p>House Bill 445 hands sweeping power to the Alcoholic Beverage Control Board, bans all inhalable hemp products \u2014 including vapes, buds, and flowers \u2014 and forces what\u2019s left into pharmacies and liquor stores. Never mind that those stores don\u2019t carry these products or that they aren\u2019t equipped to serve patients seeking plant-based alternatives. This isn\u2019t about regulation. It\u2019s about control.<\/p>\n<p>HB445 is a case study in how to turn a legitimate concern into a harmful overreaction. You don\u2019t reduce harm or promote public safety by forcing a legal industry into hiding. Yet that\u2019s exactly what this bill does. People who rely on THCa, Delta-8, or other hemp-derived products won\u2019t stop needing them just because the state says so. They\u2019ll turn elsewhere \u2014 to unregulated, untaxed, and potentially dangerous alternatives.<\/p>\n<p>Meanwhile, thousands of Alabama\u2019s small businesses \u2014 many of them family-owned \u2014 are left twisting in the wind. Stores that invested in compliance, lab testing, and clear labeling are now being told their best-selling products are contraband.<\/p>\n<p>\u201cThis will crush us,\u201d said one north Alabama shop owner. \u201cWe\u2019ve followed every rule. Now we\u2019re being told to stop selling what our customers actually use \u2014 or else.\u201d<\/p>\n<p>And what about the people who depend on these products to manage anxiety, chronic pain, insomnia, or PTSD? What about cancer survivors, veterans, and working parents who turned to legal hemp alternatives after finding traditional medications inadequate or unsafe?<\/p>\n<p>\u201cThese products helped me get off opioids,\u201d said a veteran and father of three in Mobile. \u201cIf this law passes the Senate, I\u2019ll be back to square one \u2014 or I\u2019ll have to go looking for alternatives I don\u2019t trust.\u201d<\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Scroll to continue reading.<\/span><\/div>\n<\/div>\n<p>This isn\u2019t smart regulation \u2014 it\u2019s political panic dressed up in public safety language. And it\u2019s going to hurt a lot of good, law-abiding people.<\/p>\n<p>If lawmakers were truly serious about thoughtful reform, they\u2019d look next door. In Tennessee, officials built a licensing framework that enforces age restrictions, labeling requirements, and lab testing \u2014 all without banning inhalable products or dismantling the entire industry. Tennessee didn\u2019t treat small businesses and patients like problems to be solved. It treated them like stakeholders in the solution.<\/p>\n<p>In Tennessee, leaders took the time to think before they acted. They didn\u2019t ban first and ask questions later. They listened to farmers, retailers, and patients. They found a path forward. Alabama, meanwhile, rushed to the edge \u2014 and leapt.<\/p>\n<p>HB445 is what happens when politics overrides policy. It\u2019s what happens when public health becomes a talking point rather than a real objective. It\u2019s what happens when lawmakers mistake speed for seriousness.<\/p>\n<p>The Senate still has time to stop this \u2014 and they\u2019d be wise to take it. Because Alabama doesn\u2019t need another crackdown wrapped in moral posturing. It needs leaders with the courage to do the hard work of real governance \u2014 to write laws that protect people, not punish them.<\/p>\n<p>HB445 isn\u2019t it.
