Grand jury indictment from federal court in California claims importer falsely classified ancient archaeological artifact.<\/span><\/h2>\n\n\n\n\n

Skilled prosecutors keep cases simple. So when\u00a0U.S. Department of Justice (DoJ)\u00a0attorneys secured an indictment last month in an antiquities trafficking case, they focused on one statute only, Entry of Goods Falsely Classified, 18 U.S.C. 541<\/a>.<\/p>\n

The straightforward charge, handed up by a grand jury sitting in the Central District of California, alleges that\u00a0Mohamad Yassin AlCharihi (a\/k\/a\/ Mohamad al-Sharihi), on August 13, 2015,<\/p>\n

knowingly claimed and caused to be claimed, that he was importing a shipment of a mosaic and other items valued at $2,199, when, in fact, defendant\u00a0AlCharihi\u00a0knowingly imported a mosaic that itself was valued at more than $2,199, and defendant\u00a0AlCharihi\u00a0knowingly misrepresented the quality of the mosaic, including what the mosaic depicted.<\/p>\n<\/blockquote>\n

The indictment in\u00a0U.S. v.\u00a0<\/i>AlCharihi<\/i>\u00a0(20-cr-00307)\u00a0simply is an allegation based on probable cause. The defendant is presumed innocent, and prosecutors bear the burden to prove the defendant\u2019s guilt beyond a reasonable doubt.<\/p>\n

The criminal investigation began approximately five years ago when the centuries old mosaic and other objects were imported into the U.S. A bill of lading, offered by AlCharihi in court papers, documented their ocean borne transport and their classification under Harmonized Tariff Schedule of the U.S. 6908.10 and 6802.91, codes that describe ceramic mosaic tiles and worked monumental or building stone. The\u00a0bill of lading\u00a0characterized the imports as \u201cGARDEN ORNAMENTAL VASE\u201d and \u201cMOSAIC TABLE.\u201d<\/p>\n

<\/span>FBI and Homeland Security Investigations\u00a0executed a search warrant in March 2016 (16-0589M under seal) and confiscated the ancient mosaic along with documents and computers from AlCharihi\u2019s home. The warrant authorized the seizure of\u00a0 \u201clooted and\/or stolen antiquities appearing to originate from Syria and\/or Turkey, including mosaics and records related to antiquities.\u201d<\/p>\n

Prosecutors later initiated the civil forfeiture action of\u00a0United States v. One Ancient Mosaic<\/em>\u00a0(18-cv-04420), alleging that\u00a0<\/span>the mosaic was a\u00a0Roman Empire artifact from the Byzantine Period<\/span>\u00a0and\u00a0\u201cwas consistent with the iconography of mosaics found in Syria.\u201d They contended that email evidence revealed that the mosaic was from Syria.<\/span><\/p>\n

Prior to the forfeiture case\u2019s filing, AlCharihi himself sued the government in the case of\u00a0AlCharihi v. United States of America, et al.<\/i>\u00a0(16-cv-07391). He insisted,\u00a0\u201cThere was no intent or attempt to evade customs duties and introduce uninspected items into the United States. No false or forged documents were used to bring the items into the United States.\u201d He averred that he invested money\u00a0<\/span>to enhance the value of the mosaic, arguing that it \u201c<\/span>was close to trash and in need of restoration.\u201d<\/span>\u00a0T<\/span>he federal district court dismissed AlCharihi\u2019s lawsuit in May 2017.<\/p>\n

F<\/span>acts and arguments offered in both civil cases are summarized in\u00a0\u201cImporter Restored Ancient Mosaic. FBI Seized It. Now U.S. Attorney Seeks Forfeiture\u201d<\/a>\u00a0and\u00a0likely will be re-presented in the pending criminal case<\/p>\n

The DoJ\u2019s pursuit of a conviction\u00a0<\/i>against\u00a0AlCharihi\u00a0veers from the\u00a0usual \u201cseize and send\u201d practice<\/a>\u00a0administered by federal authorities in most cultural property cases. \u201cSeize and send\u201d describes the process whereby U.S. government officials seize contraband archaeological material; gain title through a civil forfeiture that is predicated on criminal wrongdoing; send the evidence of archaeological looting\/smuggling back to the country of origin during a publicized press conference; fail to prosecute the traffickers or their accomplices; and then classify the case as an \u201congoing investigation,\u201d which prevents public review of the investigative file.<\/div>\n
But\u00a0U.S. v.\u00a0<\/i>AlCharihi<\/i>\u00a0is docketed in\u00a0the Central District of California where the U.S. Attorney\u2019s Office in 2012 prosecuted\u00a0U.S. v. Perez<\/a><\/i>\u00a0(07-cr-499)<\/a>,\u00a0<\/span>a case that confirmed that the federal anti-smuggling statute, 18 U.S.C. 545<\/a>, could be used to punish cultural property smugglers who illegally import archaeological or ethnological material in violation of the Convention on Cultural Property Implementation Act (CPIA). That office,<\/span>\u00a0moreover, achieved rare convictions against and even rarer prison sentences for<\/a>\u00a0gallery owners Jonathan and Carolyn Markell in 2015. Their prosecutions sprang from the 2008 museum raids<\/a>\u00a0that saw federal law enforcement agencies descend on the Los Angeles County Museum of Art, the Bowers Museum, the Pacific Asia Museum, and the Mingei Museum to \u201cseize in place\u201d cultural artifacts.<\/p>\n

Assistant U.S. Attorney and Environmental Crimes Chief Joseph Johns played a role in the Markell <\/i>cases. Now he exercises leadership over two attorneys assigned to the\u00a0AlCharihi <\/i>prosecution in his role as Chief, Environmental and Community Safety Crimes Section. Additional prosecutors appearing in the case display cooperation between Main Justice in Washington and attorneys in the Central District of California. The prosecutors include the Chief of the U.S. Attorney\u2019s Criminal Division; the DoJ\u2019s Acting Assistant Attorney General, Criminal Division; and Attorney Ann Marie Ursini from DoJ\u2019s Human Rights and Special Prosecutions Section, the ten year old unit that pays attention to issues such as war crimes.<\/p>\n

Because the government has claimed that the mosaic originates from conflict-ridden Syria,<\/span>\u00a0<\/span>Ursini\u2019s presence in the case is noteworthy. There has been an emerging recognition in the last several years of a relationship between transnational antiquities trafficking and U.S. national security, starkly illustrated by the case of\u00a0U.S. v. One Gold Ring with Carved Gemstone, An Asset of ISIL Discovered on Electronic Media of Abu Sayyaf, President of ISIL Antiquities Department et al.\u00a0<\/i>(16-cv-02442)<\/a>\u00a0that was filed in federal court in the\u00a0District of Columbia.\u00a0The case innovatively applied one of America\u2019s most robust anti-terrorism laws, the USA PATRIOT Act, to forfeit ISIS loot\u00a0<\/span>that U.S. soldiers identified during a 2015 raid in Syria.<\/span><\/p>\n<\/div>\n


<\/span>If convicted, AlCharihi could face fines, imprisonment up to two years, or both. Meanwhile, the government seeks criminal forfeiture of the ancient mosaic.<\/p>\n
