The requirement relies on the long-dormant <a href=\"https:\/\/loveman.sdsu.edu\/docs\/1940AlienRegistrationAct.pdf\" target=\"_blank\" aria-label=\"Link opens in new window (Alien Registration Act of 1940)\">Alien Registration Act of 1940<\/a>, which provided the <a href=\"https:\/\/archives.utah.gov\/2022\/08\/17\/tracking-the-forced-displacement-and-relocation-of-persons-of-japanese-descent-during-wwii\/\" target=\"_blank\" aria-label=\"Link opens in new window (framework)\">framework<\/a> for the internment of Japanese Americans during World War II.\u00a0<\/p>\n<p>President Donald Trump seems determined to revive and magnify the horrors of America\u2019s past. But his immigration actions, while extreme, are not unprecedented. Many of the underlying laws are years-old bipartisan initiatives.\u00a0<\/p>\n<p>Challenging Trump\u2019s agenda regarding immigration is a moral imperative, and doing so requires an understanding of how both parties are complicit. As law students in 2023, we traveled to the U.S.-Mexico border to volunteer near one of the <a href=\"https:\/\/www.latimes.com\/california\/story\/2022-09-26\/woman-heads-san-ysidro-port-of-entry-for-first-time\" target=\"_blank\" aria-label=\"Link opens in new window (busiest)\">busiest<\/a> land border crossings in the world. There we witnessed some of the unforgivable effects of the U.S. government\u2019s systematic dehumanization of immigrants, well before Trump\u2019s election to a second term.\u00a0<\/p>\n<p>At his Inauguration in 2021, former President Joe Biden <a href=\"https:\/\/www.americanimmigrationcouncil.org\/news\/new-vision-immigration-creates-welcoming-and-inclusive-immigration-system\" target=\"_blank\" aria-label=\"Link opens in new window (promised)\">promised<\/a> to create \u201ca welcoming and inclusive vision for immigration,\u201d but did no such thing. His administration continued the pattern of slashing immigrants\u2019 rights while contributing to the destabilization of their home countries. In violation of <a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=granuleid:USC-prelim-title8-section1158&amp;num=0&amp;edition=prelim\" target=\"_blank\" aria-label=\"Link opens in new window (U.S.)\">U.S.<\/a> and <a href=\"https:\/\/www.aclu.org\/news\/immigrants-rights\/your-guide-to-discussing-the-right-to-seek-asylum-at-the-dinner-table\" target=\"_blank\" aria-label=\"Link opens in new window (international law)\">international law<\/a>, he dismantled the immigration system until the <a href=\"https:\/\/immigrationimpact.com\/2023\/02\/28\/cbp-one-app-flaws-asylum-seekers\/\" target=\"_blank\" aria-label=\"Link opens in new window (notoriously inaccessible)\">notoriously inaccessible<\/a> CBP One app was the only remaining way to seek asylum at the U.S.-Mexico border.\u00a0<\/p>\n<p>The consequences were dire. In Tijuana, we met two women who\u2019d fled persecution in China and Senegal and couldn\u2019t access CBP One or secure an appointment. We also met a woman who was misinformed by a stranger (likely maliciously) that she should return to the border crossing at 4:00 a.m. with her children for an appointment, which we advised against. Thousands of people seeking asylum were forced to spend undue time in transit cities, risking <a href=\"https:\/\/www.npr.org\/2021\/03\/26\/981190646\/rejected-by-1-mexican-port-of-entry-migrants-are-flown-by-u-s-to-another\" target=\"_blank\" aria-label=\"Link opens in new window (misinformation)\">misinformation<\/a>, <a href=\"https:\/\/humanrightsfirst.org\/wp-content\/uploads\/2024\/02\/Asylum-Policies-Harm-Black-Asylum-Seekers-FACTSHEET-formatted.pdf\" target=\"_blank\" aria-label=\"Link opens in new window (identity-based violence)\">identity-based violence<\/a>, <a href=\"https:\/\/www.reuters.com\/world\/migrants-are-being-raped-mexico-border-they-await-entry-us-2023-09-29\/\" target=\"_blank\" aria-label=\"Link opens in new window (kidnapping, and rape)\">kidnapping, and rape<\/a>.\u00a0<\/p>\n<p>President Trump, on returning to office, <a href=\"https:\/\/www.pbs.org\/newshour\/politics\/aclu-sues-trump-administration-for-shutting-down-southern-border-asylum-access\" target=\"_blank\" aria-label=\"Link opens in new window (eliminated)\">eliminated<\/a> CBP One and replaced it with <a href=\"https:\/\/www.cbp.gov\/about\/mobile-apps-directory\/cbphome\" target=\"_blank\" aria-label=\"Link opens in new window (CBP Home)\">CBP Home<\/a>, a self-deportation app. In doing so, he has essentially <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/guaranteeing-the-states-protection-against-invasion\/\" target=\"_blank\" aria-label=\"Link opens in new window (ended meaningful access to asylum)\">ended meaningful access to asylum<\/a> at the southern border. Now, <a href=\"https:\/\/apnews.com\/article\/trump-immigration-cbp-one-border-app-652854b5f2a4e6ccd6ee2ccc729cbb55\" target=\"_blank\" aria-label=\"Link opens in new window (thousands of migrants)\">thousands of migrants<\/a> must endure dangers at the border, risk entry without inspection, or return to conditions they\u2019d risked their lives to flee.\u00a0<\/p>\n<p>In Tijuana, we saw the persistence of those fleeing extreme violence <a href=\"https:\/\/newlaborforum.cuny.edu\/2024\/05\/01\/the-current-migrant-crisis-how-u-s-policy-toward-latin-america-has-fueled-historic-numbers-of-asylum-seekers\/\" target=\"_blank\" aria-label=\"Link opens in new window (facilitated by decades)\">facilitated by decades<\/a> of predatory U.S. policy. Indelible in our minds is the story of a man who fled <a href=\"https:\/\/www.nytimes.com\/2021\/07\/07\/world\/americas\/haiti-poverty-history.html\" target=\"_blank\" aria-label=\"Link opens in new window (Haiti)\">Haiti<\/a> and traversed <a href=\"https:\/\/www.cnn.com\/2023\/04\/15\/americas\/darien-gap-migrants-colombia-panama-whole-story-cmd-intl\/index.html\" target=\"_blank\" aria-label=\"Link opens in new window (the treacherous)\">the treacherous<\/a> Dari\u00e9n Gap with his wife, who died in the attempt. Pointing to a corner of her organization\u2019s community space, a nonprofit director told us the man would sit there for hours every day, expressionless and mourning his wife.\u00a0<\/p>\n<p>Many of Trump\u2019s most egregious actions <a href=\"https:\/\/www.aljazeera.com\/news\/2025\/2\/11\/the-us-held-migrants-at-guantanamo-before-is-trumps-approach-different\" target=\"_blank\" aria-label=\"Link opens in new window (stem from)\">stem from<\/a> measures from previous administrations, including the <a href=\"https:\/\/www.vox.com\/2016\/4\/28\/11515132\/iirira-clinton-immigration\" target=\"_blank\" aria-label=\"Link opens in new window (Clinton-era)\">Clinton-era<\/a> Illegal Immigration Reform and Immigrant Responsibility Act. The Obama Administration massively expanded <a href=\"https:\/\/www.vox.com\/2018\/6\/21\/17488458\/obama-immigration-policy-family-separation-border\" target=\"_blank\" aria-label=\"Link opens in new window (family detention)\">family detention<\/a> (a precursor to family separation, the brainchild of a Trump official appointed under Obama). And while the first Trump Administration\u2019s family separation was particularly horrific, the Biden Administration and other past administrations also <a href=\"https:\/\/www.kpbs.org\/news\/border-immigration\/2024\/07\/29\/report-reveals-migrant-family-separations-continue-under-biden\" target=\"_blank\" aria-label=\"Link opens in new window (separated)\">separated<\/a> children from accompanying adults who were not their legal guardians.<\/p>\n<p>In context, it\u2019s no surprise that Franklin D. Roosevelt, whose New Deal progressives celebrate, also signed the <a href=\"https:\/\/www.americanimmigrationcouncil.org\/research\/trump-administration-registration-requirement-immigrants\" target=\"_blank\" aria-label=\"Link opens in new window (now-reanimated)\">now-reanimated<\/a> Alien Registration Act. In a welcome step, Congressional lawmakers have now <a href=\"https:\/\/www.nbcnews.com\/news\/asian-america\/pramila-jayapal-trump-undocumented-immigrant-registry-rcna196331\" target=\"_blank\" aria-label=\"Link opens in new window (introduced)\">introduced<\/a> a bill to repeal it. But representatives\u2019 actions only go as far as constituents demand. History suggests that neither party will protect immigrants unless voters leave no choice.\u00a0<\/p>\n<p>We urge readers to pressure lawmakers, advocate for pro-immigrant policies, and organize around pro-immigrant candidates to show that the persecution of immigrants cannot be normalized. Community members can also volunteer with local organizations assisting migrants, including by getting trained for Know-Your-Rights work. Lastly, we encourage learning <a href=\"https:\/\/www.nyclu.org\/resources\/know-your-rights\/you-have-right-film-ice#\" target=\"_blank\" aria-label=\"Link opens in new window (local laws)\">local laws<\/a> around recording ICE interactions, to protect our neighbors during ICE encounters.\u00a0<\/p>\n<p>The <a href=\"https:\/\/www.nilc.org\/articles\/analysis-of-trump-day-1-executive-orders-unconstitutional-illegal-and-cruel\/\" target=\"_blank\" aria-label=\"Link opens in new window (illegality)\">illegality<\/a> and danger of the Trump Administration\u2019s actions cannot be overstated.
