Yesterday, April 3, Rhode Island\u2019s federal district court denied a motion to stop the NEA from blocking funds to arts organizations whose projects promote \u201cgender ideology,\u201d a vague term used by the president to describe expansive and inclusive concepts of gender.\u00a0<\/p>\n<p>The ruling comes after four arts organizations represented by the American Civil Liberties Union (ACLU) \u2014 Rhode Island Latino Arts (RILA), the Theatre Communications Group and the National Queer Theater in New York, and the Theater Offensive in Massachusetts \u2014 <a href=\"https:\/\/hyperallergic.com\/994318\/aclu-sues-nea-for-enforcing-trumps-anti-lgbtq-mandate\/\">sued the NEA<\/a> in early March over the agency\u2019s implementation of a highly criticized grant requisite barring applicants from using NEA funds \u201cto promote gender ideology,\u201d following Trump\u2019s <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/defending-women-from-gender-ideology-extremism-and-restoring-biological-truth-to-the-federal-government\/\">executive order<\/a> mandating essentialist definitions of gender.\u00a0<\/p>\n<aside class=\"scaip scaip-1    \">\n\t\t<\/aside>\n<p>\u201cThis order fails to bring us the clarity we need to apply for funds for projects that allow Latinx artists, especially those who are queer, trans, or nonbinary, to show up as their whole selves without fear of erasure of censorship,\u201d Marta V. Martinez, executive director of RILA, said in a <a href=\"https:\/\/www.aclu.org\/press-releases\/court-denies-preliminary-relief-to-arts-organizations\">statement<\/a>.<\/p>\n<p>The NEA has not yet responded to <em>Hyperallergic<\/em>\u2019s request for comment.<\/p>\n<aside>\n\t\t<\/aside>\n<p>Less than a week after the ACLU filed the lawsuit, the NEA said it <a href=\"https:\/\/hyperallergic.com\/995344\/after-backlash-nea-drops-anti-trans-grant-requirement\/\">dropped the requirement<\/a>. However, the requisite remains on the agency\u2019s <a href=\"https:\/\/www.arts.gov\/grants\/legal-requirements-and-assurance-of-compliance\">website<\/a>, marked as \u201cpending the outcome of litigation in the United States District Court of Rhode Island.\u201d The NEA says it plans to issue a new policy by April 30.<\/p>\n<p>In his ruling, Judge Smith acknowledged that the plaintiffs demonstrated \u201ca likelihood of success\u201d that the grant requirement would violate the First Amendment. Still, he denied the request for a preliminary injunction to block it, arguing that the NEA has already temporarily withdrawn the requisite.<\/p>\n<p>In response to the ruling, Vera Eidelman, a senior ACLU attorney leading the suit, said in a statement that the judge\u2019s \u201copinion makes clear that the NEA cannot lawfully reimpose its viewpoint-based eligibility bar.\u201d<\/p>\n<aside class=\"scaip scaip-2    \">\n\t\t<\/aside>\n<p>\u201cThough it falls short of the relief we were seeking, we are hopeful that artists of all views and backgrounds will remain eligible for the support and recognition they deserve in this funding cycle and beyond,\u201d Eidelman said.<\/p>\n<p>NEA grant applications funding are due this Monday, April 7, leaving nonprofits funding programs that support LGBTQ+ and trans artists uncertain of their eligibility.<\/p>\n<p>In an email, Martinez told <em>Hyperallergic<\/em> that decreased funding based on \u201cgender ideology\u201d would \u201cnarrow the spaces where our artists can safely and authentically create\u201d and cut off crucial resources.\u00a0<\/p>\n<p>\u201cMany come to RILA because, similar to a Land Acknowledgement, we express our commitment to elevating their work, providing income, and helping them build career sustainability,\u201d Martinez said.<\/p>\n<aside>\n\t\t<\/aside>\n<section id=\"block-27\" class=\"below-content widget widget_block\"\/>\t<\/div>\n\n","protected":false},"excerpt":{"rendered":"<p>Ahead of next week\u2019s grant application deadline for the National Endowment for the Arts (NEA), organizations are in limbo following a new court ruling that does not prevent the federal agency from incorporating Trump\u2019s anti-trans directives into its grant-making activities.
