The free speech angle remains ripe for continuing coverage, as do the case\u2019s implications for other activist groups in the US and around the world.\u00a0The ruling came amid a broader assault on freedom of expression driven by President Donald Trump, who has sued and threatened news organizations, universities, law firms, and other civic institutions whose speech or actions he dislikes.<\/p>\n<p>Garbus and the rest of the monitoring team called the trial a \u201cdeeply flawed\u201d process studded with \u201cmultiple due process violations\u201d\u00a0that\u00a0give Greenpeace a good chance of winning on appeal.\u00a0\u201cThis was an illegitimate, corporate-funded SLAPP [Strategic Lawsuit Against Public Participation] harassment case\u00a0\u2026\u00a0that tried to criminalize Greenpeace and by extension the entire climate movement by attacking constitutionally-protected advocacy,\u201d the monitors added.<\/p>\n<p>In September 2024, Energy Transfer denied that it aimed to stifle free speech,\u00a0<a href=\"https:\/\/www.nytimes.com\/2025\/03\/16\/climate\/it-fought-to-save-the-whales-can-greenpeace-save-itself.html\">arguing<\/a>\u00a0that the case \u201cis about [Greenpeace] not following the law.\u201d\u00a0At trial, the company claimed that Greenpeace led \u201ca vast, malicious publicity campaign\u201dthat delayed construction of the pipeline\u00a0and\u00a0cost the company nearly $350 million.\u00a0The company\u2019s acrimony toward Greenpeace apparently came from the top. Its CEO, Kelcy Warren, a billionaire and\u00a0<a href=\"https:\/\/www.greenpeace.org\/usa\/a-brief-history-of-kelcy-warren-and-donald-trump\/\">Trump mega-donor<\/a>,\u00a0has\u00a0<a href=\"https:\/\/www.youtube.com\/watch?v=va3lL2LuLNs\">said<\/a> environmental activists should be \u201cremoved from the gene pool.\u201d<\/p>\n<p>Greenpeace\u00a0<a href=\"https:\/\/northdakotamonitor.com\/2025\/03\/12\/former-greenpeace-leader-disputes-allegations-by-dakota-access-pipeline-developer\/\">testified<\/a>\u00a0that it played only a minor, supporting role in the protests against the pipeline, which it pointed out was led by the Standing Rock Sioux Tribe.\u00a0Tribal chairwoman Janet Alkire\u00a0<a href=\"https:\/\/standingrock.org\/wp-content\/uploads\/2025\/03\/ChairwomanStatementOnEnergyTransfer-1.pdf\">confirmed that contention<\/a>, saying her people \u201cwere heartened when many non-Indigenous allies came to join us in opposing\u201d the pipeline.<\/p>\n<div id=\"current-issue-block_d98eecb22f658bc1771a97da88583dcc\" class=\"current-issue  float-l-w-2\">\n<h4 class=\"current-issue__title\">\n                    Current Issue<br \/>\n            <\/h4>\n<p>    <a href=\"https:\/\/www.thenation.com\/issue\/april-2025-issue\/\" class=\"current-issue__cover\"><br \/>\n        <img decoding=\"async\" src=\"https:\/\/www.thenation.com\/wp-content\/uploads\/2025\/03\/cover2504.jpg\" alt=\"Cover of April 2025 Issue\"\/><br \/>\n    <\/a><\/p>\n<\/div>\n<p>The Standing Rock protests, which began in 2016, attracted intense media coverage and launched a new era of climate activism led by Indigenous peoples and emphasizing social justice. Representative Alexandria Ocasio-Cortez has said that\u00a0<a href=\"https:\/\/www.eenews.net\/articles\/ocasio-cortezs-unlikely-path-to-becoming-green-hero\/\">joining the protests inspired her to run<\/a>\u00a0for Congress in 2018, where she co-sponsored Green New Deal legislation calling for a just transition away from fossil fuels.<\/p>\n<p>Journalists have abundant opportunities to cover the fallout from the Greenpeace verdict. What does this case mean for other activist groups and protest movements at a time when opposition to Trump and his agenda is growing\u2014and when climate driven extreme weather is intensifying?
