An Iowa House of Representatives subcommittee advanced a bill to bar the sale and administration of vaccines in the state unless manufacturers waive some of the liability protection granted under federal law for injuries caused by their vaccines.<\/strong><\/em><\/p>\n\n\n\n

House File 712<\/a>, which\u00a0advanced out of subcommittee<\/a>\u00a0would require vaccine manufacturers to waive liability protection for\u00a0design defect\u00a0<\/a>claims.<\/p>

<\/a><\/div><\/div>\n\n\n\n

Design defect claims occur when a problem with the vaccine\u2019s design, rather than a flaw in the manufacturing process, makes it dangerous, even if it was produced properly and administered as intended.<\/p>\n\n\n\n

State Rep.\u00a0Charley Thomson<\/a>, who introduced the bill, told The Defender that although the bill stalled in the judiciary committee, it isn\u2019t dead. It can either be added to another bill this legislative term, or he can reintroduce it next term.<\/p>\n\n\n\n

Thomson said he proposed the law because he didn\u2019t think companies should be able to put products on the market if they don\u2019t take responsibility for their potential to injure people.<\/p>\n\n\n\n

Thomson said:<\/p>\n\n\n\n

\u201cWe don\u2019t allow it for toaster ovens, for paint, for any one of 10 million different items that people buy in the United States, and we shouldn\u2019t allow it for vaccines.<\/p>\n\n\n\n

\u201cIf anything, we should maybe be a little more strict with things that are very complicated and are being put into people\u2019s bodies and represented as safe and not poisonous.<\/p>\n\n\n\n

\u201cIf you are doing that, why would you object to being held to account?\u201d<\/p>\n\n\n\n

The bill comes amid\u00a0growing public sentiment<\/a>\u00a0that vaccine makers should not have\u00a0immunity from legal action<\/a>\u00a0and the public should be able to\u00a0sue the manufacturer of a vaccine<\/a>\u00a0that caused them harm.<\/p>\n\n\n\n

Vaccine makers won freedom from liability from design defects in a 2011 Supreme Court decision,\u00a0Bruesewitz v. Wyeth<\/a>, when the Court effectively reinterpreted the\u00a01986 National Childhood Vaccine Injury Act<\/a>\u00a0to give Big Pharma blanket liability.<\/p>\n\n\n\n

Until that point, the act had given Big Pharma partial liability protection for vaccines listed on the Centers for Disease Control and Prevention\u2019s (CDC) childhood immunization schedule but continued to\u00a0hold them responsible<\/a>\u00a0for product design defects.<\/p>\n\n\n\n

Thomson said that in the subcommittee discussion, the support and opposition to the proposed bill didn\u2019t simply break down along partisan lines \u2014 both Democrats and Republicans supported and opposed the bill.<\/p>\n\n\n\n

Lindsay Mahar of\u00a0Informed Choice Iowa<\/a>\u00a0said that people concerned with vaccine safety have been working for years to develop different legal mechanisms to protect the public from vaccine injuries. Part of the thinking behind the bill, she said, is that \u201cif we could just restore accountability, the system would self-correct in a lot of ways.\u201d<\/p>\n\n\n\n

She said some people were concerned that passing the law on a state level might result in vaccine makers simply leaving the state. They said they hope the proposed bill will spark a state and national conversation about ending liability for vaccine makers.<\/p>\n\n\n\n

Informed Choice Iowa saw a lot of public support for the bill, with opposition coming primarily from the pharmaceutical companies and medical associations, Mahar added.<\/p>\n\n\n\n

She said public support for vaccine mandates and liability for Big Pharma has shifted since the\u00a0COVID-19<\/a>\u00a0pandemic period. Advocacy and education work by organizations like hers, along with \u201csocial media and the internet have just really helped educate people, get other sources of information besides just what they\u2019re told in the doctor\u2019s office.\u201d<\/p>\n\n\n\n

A\u00a02022 Iowa poll<\/a>\u00a0found that only 34% of Iowans supported mandatory school vaccinations.<\/p>\n\n\n\n

1986 Act set up \u2018no-fault\u2019 system to protect vaccine makers from lawsuits<\/strong><\/p>\n\n\n\n

The 1986 Act established the\u00a0National Vaccine Injury Compensation Program<\/a>\u00a0(VICP), which adjudicates vaccine injury claims.<\/p>\n\n\n\n

The act set up a \u201cno-fault\u201d system. Instead of suing the manufacturers, people injured by vaccines can file a claim against the U.S. Department of Health and Human Services through the VICP \u2014 also known as the \u201cvaccine court<\/a>\u201d \u2014 which adjudicates the claims.<\/p>\n\n\n\n

The VICP was meant to insulate vaccine makers from lawsuits that could bankrupt them while ensuring injury victims had a straightforward, non-adversarial and fair path to compensation.<\/p>\n\n\n\n

Supporters say<\/a>\u00a0the program ensures access to vaccines for the broader public while compensating injury victims. However, critics say the program has devolved to\u00a0protect government agencies and corporations<\/a>\u00a0rather than the\u00a0health<\/a>\u00a0of vaccinated children.<\/p>\n\n\n\n

Between 1988-2022, 28,292 petitions were filed with the VICP, according to the\u00a0Health Resources & Services Administration<\/a>, which houses the program.<\/p>\n\n\n\n

Over that 30-year period, 24,602 petitions have been adjudicated, with 11,671 of those determined to be compensable, and 12,931 dismissed. Total compensation paid was approximately $5.3 billion.<\/p>\n\n\n\n

Bruesewitz decision \u2018devastating\u2019 for vaccine-injured people and their families<\/strong><\/p>\n\n\n\n

When the 1986 law was first passed, it gave drug companies partial liability protection, but still allowed, in certain circumstances, an injured party who had gone through the vaccine court and wasn\u2019t happy with the outcome to bring a case in court against the manufacturer,\u00a0Children\u2019s Health Defense<\/a>\u00a0General Counsel Kim Mack Rosenberg said.<\/p>\n\n\n\n

This possibility was \u201cseverely curtailed\u201d by the 2011 Supreme Court decision in Bruesewitz v. Wyeth, she said.<\/p>\n\n\n\n

The case began as a Pennsylvania lawsuit brought by the parents of\u00a0Hannah Bruesewitz<\/a>, who suffered seizures and developmental issues after taking the DPT vaccine in 1992. The vaccine court didn\u2019t compensate Hannah\u2019s parents, so they sued the vaccine manufacturer, Wyeth (now Pfizer) in state court in Pennsylvania.<\/p>\n\n\n\n

In its\u00a0majority ruling<\/a>\u00a0in favor of Wyeth, the court interpreted the 1986 Act to shield Big Pharma with full immunity from liability for vaccine injuries by ruling that people could no longer sue vaccine makers for injuries caused by design defects.<\/p>\n\n\n\n

In a scathing\u00a0dissenting opinion<\/a>, Justice Sonia Sotomayer, joined by Justice Ruth Bader Ginsburg, accused the court of imposing its own\u00a0policy<\/a>\u00a0preferences, misconstruing the Act, and disturbing \u201cthe careful balance Congress struck between compensating vaccine-injured children and stabilizing the childhood vaccine market.\u201d<\/p>\n\n\n\n

Sotomayer noted that as Bruesewitz was argued, there were 5,000 petitions in the vaccine court alleging a causal link between some\u00a0vaccines<\/a>\u00a0and autism spectrum disorder and that Wyeth\/Pfizer argued that if the court did not find in its favor, it \u201ccould unleash a \u2018crushing wave\u2019 of tort litigation that would bankrupt vaccine manufacturers and deplete vaccine supply.\u201d<\/p>\n\n\n\n

Sotomayer wrote:<\/p>\n\n\n\n

\u201cThis concern underlies many of the policy arguments in respondent\u2019s brief and appears to underlie the majority and concurring opinions in this case. Manufacturers, given the lack of robust competition in the vaccine market, will often have little or no incentive to improve the designs of vaccines that are already generating significant profit margins.\u201d<\/p>\n\n\n\n

Mack Rosenberg said the decision, \u201cwas devastating to those who were injured or killed, and their families.\u00a0 Post-Bruesewitz, parties have very limited judicial remedies against the manufacturers, including manufacturing defect, failure to warn, and fraud-based claims, all of which are challenging claims for a plaintiff to bring.\u201d<\/p>\n\n\n\n

She said if the Iowa bill were enacted, she expects it would be subject to challenges due to its conflicts with Breusewitz.<\/p>\n\n\n\n

However, Mack Rosenberg added, \u201cThis bill is important from an educational perspective as well. At a minimum, this bill focuses attention on the extraordinary liability protection enjoyed by vaccine manufacturers.\u201d<\/p>\n\n\n\n

She added:<\/p>\n\n\n\n

\u201cMore and more people are waking up to the reality of vaccine injury, particularly as a result of COVID-19 vaccine injuries. People also need to know that vaccine manufacturers have no incentive to make safer vaccines due to the liability shield.\u201d<\/p>\n\n \n <\/div>\r\n
