{"id":155057,"date":"2025-03-25T04:48:33","date_gmt":"2025-03-25T04:48:33","guid":{"rendered":"https:\/\/peraltafinancing.com\/activist\/suppressing-environmental-protest-just-got-easier\/"},"modified":"2025-03-25T04:48:33","modified_gmt":"2025-03-25T04:48:33","slug":"suppressing-environmental-protest-just-got-easier","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=155057","title":{"rendered":"Suppressing Environmental Protest Just Got Easier"},"content":{"rendered":"<p> <br \/>\n<br \/><img decoding=\"async\" src=\"https:\/\/progressive.org\/downloads\/21565\/download\/StandingRockDAPL.jpg?cb=ebc1e5d7dd522bac3cc93bb21119b535\" \/><\/p>\n<div>\n<p class=\"lead\">If you remember the <a href=\"https:\/\/www.npr.org\/sections\/thetwo-way\/2017\/02\/22\/514988040\/key-moments-in-the-dakota-access-pipeline-fight\" target=\"_blank\" aria-label=\"Link opens in new window (Standing Rock protest encampment)\">Standing Rock protest encampment<\/a> against the Dakota Access Pipeline, which lasted from 2016 into 2017 and was met with a harsh winter of political suppression, you might also remember that the movement was visibly and powerfully led by Indigenous water protectors from the Sioux tribe.<\/p>\n<p>These protests\u2014which remained largely non-violent in the face of hostile local law enforcement and corporate-hired \u201cprivate security\u201d\u2014were led by the Standing Rock Sioux, whose lands and treaty rights were endangered by the pipeline. The federal government approved the pipeline route without adequately consulting tribal members, in violation of the tribe\u2019s treaty rights.<\/p>\n<p>The protests <a href=\"https:\/\/www.aclu.org\/campaigns-initiatives\/stand-with-standing-rock\" target=\"_blank\" aria-label=\"Link opens in new window (drew thousands)\">drew thousands<\/a> of Native Americans, inspired Indigenous youth and other supporters (<a href=\"https:\/\/waterkeeper.org\/news\/robert-f-kennedy-jr-speaks-at-standing-rock-reservation-in-protest-of-pipeline\/\" target=\"_blank\" aria-label=\"Link opens in new window (including)\">including<\/a> Robert F. Kennedy Jr.) and set off a revival of Indigenous empowerment in the United States that has carried through the COVID-19 pandemic\u2014when many reservations <a href=\"https:\/\/nativenews.jour.umt.edu\/projects\/home\/bordersagainstinfection\/\" target=\"_blank\" aria-label=\"Link opens in new window (closed access)\">closed access<\/a> to outsiders as a protective measure\u2014and on to today. We\u2019re now in the midst of increased visibility for Indigenous art, films, culture, television shows, reclamation, as well as a push for emerging political leadership and co-management of lands and waters within the Native American community. This included, under the Biden Administration, the first Indigenous <a href=\"https:\/\/www.doi.gov\/deb-haaland\" target=\"_blank\" aria-label=\"Link opens in new window (Secretary of Interior)\">Secretary of Interior<\/a>, Deb Haaland, and the first Alaska Native <a href=\"https:\/\/alaskapublic.org\/news\/2022-09-13\/mary-peltola-makes-history-as-first-alaska-native-person-sworn-into-congress\" target=\"_blank\" aria-label=\"Link opens in new window (elected to Congress)\">elected to Congress<\/a>, Mary Peltola.<\/p>\n<p>But in spite of this groundswell of Indigenous activism, a North Dakota jury <a href=\"https:\/\/apnews.com\/article\/greenpeace-dakota-access-pipeline-lawsuit-verdict-5036944c1d2e7d3d7b704437e8110fbb\" target=\"_blank\" aria-label=\"Link opens in new window (decided)\">decided<\/a> on March 19 that the environmental and climate action group Greenpeace should pay more than $660 million for damages and defamation to Energy Transfer LP, a <a href=\"https:\/\/www.energytransfer.com\/\" target=\"_blank\" aria-label=\"Link opens in new window (Texas-based)\">Texas-based<\/a> pipeline company that <a href=\"https:\/\/www.reuters.com\/article\/business\/environment\/energy-transfer-says-dakota-access-pipeline-99-percent-complete-idUSKBN1621WE\/\" target=\"_blank\" aria-label=\"Link opens in new window (completed)\">completed<\/a> the Dakota Access Pipeline pipeline in 2017. Energy Transfer, whose CEO was a <a href=\"https:\/\/www.eenews.net\/articles\/billionaire-kelcy-warren-invests-in-pipelines-and-trump\/\" target=\"_blank\" aria-label=\"Link opens in new window (major supporter)\">major supporter<\/a> of President Donald Trump\u2019s 2024 campaign, claims that Greenpeace agitated against the completion of the crude oil pipeline by paying and training protestors, as well as providing them supplies to form a blockade.\u00a0<\/p>\n<p>It\u2019s hard to believe\u00a0 that, in the midst of the global climate emergency and decades-long disinformation campaign surrounding it, anyone can actually defame the fossil fuel industry. It would be like Vladimir Putin suing Alexei Navalny\u2019s family for defaming him by saying Navalny was <a href=\"https:\/\/www.brookings.edu\/articles\/the-death-of-alexei-navalny\/\" target=\"_blank\" aria-label=\"Link opens in new window (murdered)\">murdered<\/a> in prison.<\/p>\n<p>Greenpeace, of course, does not have hundreds of millions in spare cash to pay out.\u00a0 But the aim of this successful legal action, known as a Strategic Lawsuit Against Public Participation (SLAPP) suit, has less to do with enriching the nation\u2019s largest pipeline company, which <a href=\"https:\/\/ir.energytransfer.com\/news-releases\/news-release-details\/energy-transfer-reports-fourth-quarter-2024-results-and\" target=\"_blank\" aria-label=\"Link opens in new window (generated)\">generated<\/a> more than $82 billion in revenue last year, than with <a href=\"https:\/\/theconversation.com\/what-is-a-slapp-suit-legal-experts-explain-how-these-lawsuits-suppress-free-speech-251098\" target=\"_blank\" aria-label=\"Link opens in new window (suppressing)\">suppressing<\/a> voices of dissent.\u00a0<\/p>\n<p>\u201cThey want our silence, not our money,\u201d <a href=\"https:\/\/amp.theguardian.com\/us-news\/live\/2025\/mar\/19\/us-politics-live-donald-trump-republicans-democrats-elon-musk-latest-news#:~:text=18%3A14-,Nina%20Lakhani,-%E2%80%98This%20is%20the\" target=\"_blank\" aria-label=\"Link opens in new window (said)\">said<\/a> Sushma Raman, interim director of Greenpeace, whose lawyers plan to appeal the decision. Unfortunately, they\u2019ll be appealing to the North Dakota Supreme Court, which previously <a href=\"https:\/\/portal-api.ctrack.ndcourts.gov\/courts\/68f021c4-6a44-4735-9a76-5360b2e8af13\/cms\/case\/2b4aa1ab-cdd2-43fc-af88-33e078bbd827\/docketentrydocuments\/6f97cae5-9628-45df-81f7-9c14d68c8444\" target=\"_blank\" aria-label=\"Link opens in new window (rejected)\">rejected<\/a> Greenpeace\u2019s appeal for a change of venue to Fargo and away from Morton County that is close to the site of the protests with <a href=\"https:\/\/northdakotamonitor.com\/2025\/03\/05\/north-dakota-supreme-court-denies-petition-to-move-greenpeace-trial-to-different-court\/\" target=\"_blank\" aria-label=\"Link opens in new window (almost half)\">almost half<\/a> the prospective jury members having said they\u2019d been directly impacted by them. Oil drilling and gas extraction is North Dakota\u2019s largest industry, and Donald Trump won nearly <a href=\"https:\/\/results.sos.nd.gov\/ResultsSW.aspx?text=All&amp;type=SW&amp;map=CTY\" target=\"_blank\" aria-label=\"Link opens in new window (67 percent)\">67 percent<\/a> of the state\u2019s vote in 2024 (and 77% in Morton County), after <a href=\"https:\/\/www.brookings.edu\/articles\/trump-has-big-plans-for-climate-and-energy-policy-but-can-he-implement-them\/\" target=\"_blank\" aria-label=\"Link opens in new window (campaigning on)\">campaigning on<\/a> \u201cEnergy Dominance\u201d and <a href=\"https:\/\/www.donaldjtrump.com\/agenda47\/agenda47-america-must-have-the-1-lowest-cost-energy-and-electricity-on-earth\" target=\"_blank\" aria-label=\"Link opens in new window (insisting)\">insisting<\/a> that climate change was \u201ca hoax.\u201d\u00a0\u00a0<\/p>\n<p>While Greenpeace is sometimes perceived as a radical organization in the United States, it has a global reputation as a valued resource by governments and companies. The group often <a href=\"https:\/\/www.greenpeace.org\/international\/story\/71155\/cop29-need-know-annual-global-climate-summit\/\" target=\"_blank\" aria-label=\"Link opens in new window (provides)\">provides<\/a> scientific advisers to government delegations at U.N. climate summits, ocean conferences, and similar events. The perception of Greenpeace as radical, even as it promotes common sense solutions like a rapid transition to clean energy, may reflect its history of coordinating banner drops and other dramatic nonviolent actions as early as its <a href=\"https:\/\/nvdatabase.swarthmore.edu\/content\/greenpeace-campaigns-against-whaling-1975-1982\" target=\"_blank\" aria-label=\"Link opens in new window (Save the Whales)\">Save the Whales<\/a> campaigns of the 1970s, when its advocates would venture out in Zodiac rafts to place themselves between the harpoon guns of Russian whalers and the whales being hunted.<\/p>\n<p>The organization also has a commitment to equity and fairness, which is why, back in 2016, Greenpeace <a href=\"https:\/\/www.greenpeace.org\/usa\/these-are-our-prayers-in-action-a-look-at-life-in-the-nodapl-resistance-camps\/\" target=\"_blank\" aria-label=\"Link opens in new window (acknowledged)\">acknowledged<\/a> the Indigenous leadership at Standing Rock, whose claims to the land and stewardship of its waters and other resources the oil industry would rather ignore.<\/p>\n<p>As for Greenpeace itself, Raman <a href=\"https:\/\/thehill.com\/policy\/energy-environment\/5204399-court-finds-greenpeace-liable-in-case-over-dakota-access-pipeline\/\" target=\"_blank\" aria-label=\"Link opens in new window (said)\">said<\/a>, \u201cThis is the end of a chapter, but not the end of our fight.\u201d And of course, that fight, especially in a time when the President is <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/feb\/06\/trump-60-minutes-cbs\" target=\"_blank\" aria-label=\"Link opens in new window (suing)\">suing<\/a> and <a href=\"https:\/\/www.theguardian.com\/us-news\/2024\/nov\/10\/trump-journalist-media-press-freedom\" target=\"_blank\" aria-label=\"Link opens in new window (threatening)\">threatening<\/a> to imprison journalists and anyone else who dares to criticize him, is really a fight for our First Amendment freedoms that <a href=\"https:\/\/constitutioncenter.org\/the-constitution\/amendments\/amendment-i\" target=\"_blank\" aria-label=\"Link opens in new window (assures)\">assures<\/a> us that \u201cCongress shall make no law . . . abridging the freedom of speech, or of the press: or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.\u201d There are now certainly many grievances in need of redress.<\/p>\n<\/p><\/div>\n\n","protected":false},"excerpt":{"rendered":"<p>If you remember the Standing Rock protest encampment against the Dakota Access Pipeline, which lasted from 2016 into 2017 and was met with a harsh winter of political suppression, you might also remember that the movement was visibly and powerfully led by Indigenous water protectors from the Sioux tribe.
