Western conference session details Fourth Amendment and ag \u2013 National Agricultural Law Center"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>By Drew Viguet<br \/>National Agricultural Law Center<br \/>U of A System Division of Agriculture<\/p>\n<p>March 24, 2025<\/p>\n<p><strong>Fast facts:<\/strong><\/p>\n<ul>\n<li>Session at Western conference focuses on warrantless search of ag lands<\/li>\n<li>Institute for Justice Senior Attorneys Robert Frommer and Joshua Windham will present<\/li>\n<li>Registration is <a href=\"https:\/\/nationalaglawcenter.org\/western2025\/\">online<\/a>, livestream available<\/li>\n<\/ul>\n<p>FAYETTEVILLE, Ark. \u2014 Two crowd-favorite presenters are returning to speak at a national agricultural conference \u2014 this time out West.<\/p>\n<p>Senior Attorneys Robert Frommer and Joshua Windham of the <a href=\"https:\/\/ij.org\/\">Institute for Justice<\/a> will present on the Fourth Amendment and agriculture at the 3<sup>rd<\/sup> Annual Western Water, Agricultural, and Environmental Law Conference. The two previously spoke in 2024 at the 11<sup>th<\/sup> Annual Mid-South Agricultural and Environmental Law Conference.<\/p>\n<p>This year, the Western is co-hosted by the National Agricultural Law Center, or NALC, and the National Association of State Departments of Agriculture Foundation, or <a href=\"https:\/\/www.nasda.org\/nasda-foundation\/\">NASDA Foundation<\/a>. Frommer and Windham will discuss the \u201cFourth Amendment and Agriculture: Warrantless Access to Ag &amp; Private Rural Lands.\u201d The conference is June 19-20 in Reno, Nevada, with a livestream option available. Registration is available at <a href=\"https:\/\/nationalaglawcenter.org\/western2025\">nationalaglawcenter.org\/western2025<\/a>.<\/p>\n<p>The Fourth Amendment of the U.S. Constitution guarantees \u201cthe right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures.\u201d However, Frommer and Windham have found that most private ag land in the country is unprotected by the Fourth Amendment.<\/p>\n<p>\u201cThanks to the open fields doctrine, which was established in the 1924 Supreme Court case Hester v. United States, a majority of private agricultural land in the U.S. is unprotected by the Fourth Amendment,\u201d said Frommer. \u201cThe open fields doctrine means that private land can be searched without warrant or probable cause. This leaves many Americans questioning their rights. We\u2019ve seen it time and time again.\u201d<\/p>\n<p>A 2024 <a href=\"https:\/\/www.cato.org\/regulation\/spring-2024\/good-fences-good-luck\">study<\/a> co-authored by Windham for the Cato Institute stated that about 1.2 billion acres of U.S. private land is essentially open to warrantless government access.<\/p>\n<p>\u201cAlmost 96 percent of private land in the U.S. can be searched without a warrant,\u201d Windham said. \u201cRobert and I have handled many cases involving farmers who have had their land searched without a warrant or probable cause. We\u2019re looking forward to discussing this critical topic at the 3<sup>rd<\/sup> Annual Western.
