margin: 0px 0px 0px 20px;\"><img decoding=\"async\" title=\"Novichok Vodka via https:\/\/www.rt.com\/business\/426529-novichok-brand-russia-business\/ [Fair Use]\" src=\"https:\/\/www.exportlawblog.com\/images\/novichok.jpg\" alt=\"Novichok Vodka via https:\/\/www.rt.com\/business\/426529-novichok-brand-russia-business\/ [Fair Use]\" width=\"170px\" \/><\/span>According to a\u00c2\u00a0<a href=\"https:\/\/www.state.gov\/r\/pa\/prs\/ps\/2018\/08\/285043.htm\">State Department press release<\/a>\u00c2\u00a0released today, the\u00c2\u00a0United States has made a determination that Russia used novichok, a chemical warfare agent, in an attack on British soil and, as a result, the US will impose sanctions on Russia under the Chemical and Biological Weapons Control and Warfare Elimination Act of 1991 (the \u00e2\u20ac\u0153CBWC Act\u00e2\u20ac\u009d), 22 U.S.C. \u00c2\u00a7 5601 et seq.\u00c2\u00a0 The text of these sanctions was not released.\u00c2\u00a0 Instead, the text will be in a Federal Register notice expected to be published on or around August 22.\u00c2\u00a0 The sanctions will be effective as of the date of the publication of that notice.<\/p>\n<p>Because\u00c2\u00a0these sanctions are being imposed under the CBWC Act,\u00c2\u00a0we can already get a good idea of\u00c2\u00a0what these sanctions will be.\u00c2\u00a0\u00c2\u00a0 The Act contemplates sanctions being imposed in two stages.\u00c2\u00a0 The first stage, described in <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/22\/5605\">section 5605(a)<\/a>,\u00c2\u00a0sets forth the following sanctions, all of which are required to be imposed upon the offending country:<\/p>\n<ul style=\"margin-left: 15px; padding-left: 50px; list-style-type: square;\">\n<li>Termination of all foreign assistance<\/li>\n<li>Termination of all arms sales<\/li>\n<li>Termination of all foreign military financing<\/li>\n<li>Denial of U.S. government credit or assistance<\/li>\n<li>Termination of all exports of items controlled on the Commerce Control List for NS reasons<\/li>\n<\/ul>\n<p>To be honest, none of these sanctions will have any significant impact on Russia.\u00c2\u00a0 Arms sales to Russia have been prohibited for some time now.\u00c2\u00a0\u00c2\u00a0 The country chart already has Russia controlled for both columns of NS controls.\u00c2\u00a0 Of course, you could say that the new sanctions will mean that NS items will not be considered for licenses under any circumstances.\u00c2\u00a0 But I don\u2019t think licenses to export NS items\u00c2\u00a0to Russia\u00c2\u00a0are being readily granted now.<\/p>\n<p>The second\u00c2\u00a0stage, if it happens, would take place on November 8 of this year unless the President determines that Russia is no longer using chemical or biological weapons.\u00c2\u00a0 If that determination is not made, the President is required to impose three sanctions from a set of six possible sanctions.\u00c2\u00a0 Those six possible sanctions are:<\/p>\n<ul style=\"margin-left: 15px; padding-left: 50px; list-style-type: square;\">\n<li>Opposing multilateral bank financial assistance to Russia<\/li>\n<li>Prohibition of U.S. bank loans to the government of Russia<\/li>\n<li>Prohibition of all exports of all U.S. goods and technology to Russia<\/li>\n<li>Downgrading or suspending diplomatic relations with Russia<\/li>\n<li>Termination of all service to and from the United States by Russian airlines<\/li>\n<\/ul>\n<p>Whether the President will make the findings necessary to impose this second\u00c2\u00a0stage and which three of the six will be imposed is anyone\u2019s guess, although I suspect that most people likely have a pretty good guess.\u00c2\u00a0\u00c2\u00a0 The upcoming Federal Register notice will probably not even address\u00c2\u00a0the second stage sanctions.\u00c2\u00a0\u00c2\u00a0 If the United States does in fact impose the three second\u00c2\u00a0stage\u00c2\u00a0sanctions, the best guess is probably that he will impose the least restrictive of those, i.e., opposing multilateral bank loans, prohibiting U.S. bank loans, and expelling a few more diplomats.<\/p>\n<p>\u00a0<\/p>\n<p>\t\t\t\t<span style=\"font-size:0.8em;\"><plusone size=\"small\" count=\"false\" href=\"https:\/\/www.exportlawblog.com\/archives\/9235\"><\/plusone> <img decoding=\"async\" src=\"https:\/\/www.exportlawblog.com\/images\/permalink.gif\" alt=\"\" \/><a href=\"https:\/\/www.exportlawblog.com\/archives\/9235\" rel=\"bookmark\">Permalink<\/a>  <\/span><\/p>\n<div><a class=\"addthis_button\" href=\"http:\/\/www.addthis.com\/bookmark.php?v=250&amp;username=clifburns\" addthis:url=\"https%3A%2F%2Fwww.exportlawblog.com%2Farchives%2F9235\" addthis:title=\"Sanctions+in+Name+Only+Imposed+on+Russia+for+Nerve+Gas+Attack\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/s7.addthis.com\/static\/btn\/v2\/lg-share-en.gif\" width=\"125\" height=\"16\" alt=\"Bookmark and Share\" style=\"border:0\" \/><\/a><\/div>\n<p><!-- AddThis Button END --><br \/>\n<br \/>\nCopyright \u00a9 2018 Clif Burns. Thanks, Clif!<\/p>\n<p>Question regarding the control on NS items \u2013 if there were a license exception in place today to permit the export of a NS controlled item to Russia, is it no longer valid when these sanctions are put in place?<\/p>\n<p>First, outstanding work in teasing out the details.  <\/p>\n<p>Second, given Clif\u2019s take from 12:22pm 10 August, that suggests that 5A002 and 5D002 items \u2013 which today flow readily to many destinations in Russia under ENC, despite NS controls \u2013 might come to a halt.  Am I mistaken? <\/p>\n<p>Twenty years ago, that would be a tiny fraction of exports.
