Many deals fall apart due to poor negotiation\u2014whether it\u2019s giving up too soon, engaging in unnecessary arguments or relying too heavily on logic when experts say emotions and psychology drive decision-making.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The good news? Negotiation is a skill that can be learned, including the confidence required to improve. It\u2019s all teachable, says Suze Cumming, a real estate negotiation coach and former top-producing Toronto agent.<\/span><\/p>\n<p>\u00a0<\/p>\n<h2><b>Preparation is key<\/b><\/h2>\n<p>\u00a0<\/p>\n<p><span style=\"font-weight: 400;\">Cumming, who says she succeeded in high-pressure transactions as a top-producing Realtor in Toronto for 20 years before training at Adler (a university specializing in psychology), notes that top business schools advocate four hours of preparation for every hour of negotiating.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cRealtors are paid significant amounts of money to professionally negotiate on behalf of clients,\u201d she points out, noting that understanding the stakeholders involved, how they respond and what they value is as important as knowing the financials.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">To get that intel, Ann Frost, associate professor at Western University\u2019s Ivey Academy and co-lead of its Collaborative Negotiation program, suggests leveraging your team and brokerage as a resource. \u201cTalk about what you\u2019ve done. Share stories and lessons learned,\u201d she says. \u201cAsk questions and seek advice from those who\u2019ve been there.\u201d<\/span><\/p>\n<p>\u00a0<\/p>\n<h2><b>Extracting information and navigating difficult agents<\/b><\/h2>\n<p>\u00a0<\/p>\n<p><span style=\"font-weight: 400;\">A skilled negotiator must know how to extract helpful details, even when the opposing agent is guarded, Cumming insists. Ethical information-sharing benefits both parties, yet many agents lack the training to differentiate between what can and can\u2019t be shared.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Frost teaches being open and vulnerable to close deals. \u201cWe establish connections with people through that. Once I\u2019m open with you, I can put all my cards on the table because I trust you, and you\u2019ll do the same. If I\u2019m holding my cards close, in the end, maybe there\u2019s no deal. No one wins as there\u2019s value we didn\u2019t exploit.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Cumming asserts Realtors\u2019 jobs include having that conversation with their counterparts. \u201cEncourage them to collaborate (within) the rules,\u201d she advises, adding how \u201cblown away\u201d she is by agents who don\u2019t research the other party online. \u201cThat\u2019s a no-brainer.\u201d<\/span><\/p>\n<p>\u00a0<\/p>\n<h2><b>Disarming aggression and balancing competition and collaboration<\/b><\/h2>\n<p>\u00a0<\/p>\n<p><span style=\"font-weight: 400;\">While Cumming champions \u201cdeliberate, strong collaborativeness,\u201d where all stakeholders\u2019 needs are met through strategic conversations and deep understanding, the real estate world is full of competitive negotiators who, she cautions, \u201ccome at you.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Her antidote is the \u201cnegotiator\u2019s dilemma,\u201d a balance of competitive and collaborative strategies. A skilled negotiator recognizes when to shift gears, by disarming an aggressive counterpart or using strategy to maintain control, she notes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThere\u2019s a lot of aggression in our world right now\u2026It multiplies,\u201d Cumming observes, noting the skills to diffuse it are crucial to agents\u2019 ability to negotiate today.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For example, knowing to stay on \u201chigh alert,\u201d as a shift in tone, evasiveness or an overly charming demeanour can signal a highly aggressive negotiator seeking an edge, she warns. Cumming recommends testing their trustworthiness with a minor, non-damaging information offer. \u201cSee what they do with it and if they give you (anything) back. If they don\u2019t and get smug, adjust accordingly.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If all else fails when emotions run high, Frost advises simply taking a time-out. \u201cCome back later. Otherwise, there won\u2019t be any good outcome.\u201d<\/span><\/p>\n<p>\u00a0<\/p>\n<h2><b>Adapting strategy to market conditions, beyond price<\/b><\/h2>\n<p>\u00a0<\/p>\n<p><span style=\"font-weight: 400;\">Cumming highlights that agent-client conflict can start at the listing stage when property value opinions are shared. \u201cYou need to create a relationship with your seller and work toward the same end\u2014listing isn\u2019t enough, especially when properties aren\u2019t selling. It\u2019s about developing and executing a strategy together,\u201d something she says requires a massive amount of connection and trust.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, negotiations aren\u2019t solely about price. \u201cOnce you satisfy (price), most people have other important issues,\u201d like timing on offer duration and closing dates or the conditions added, Cumming explains. She adds that people often bicker over used items with little to no value, like furnishings or appliances. \u201cIt\u2019s a bad place for people to lose their ego\u2026It distracts from getting the terms right for the deal.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Power shifts between buyers and sellers depending on economic conditions, and successful agents assess and adjust. In competitive bidding situations, securing any advantage\u2014like meeting a seller\u2019s non-monetary priorities\u2014can make all the difference, Cumming notes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWhen you don\u2019t have power, you must find out what\u2019s important to the other side and give it to them,\u201d whether it\u2019s showcasing a buyer\u2019s story in a letter, offering low to no financial risk with a large down payment or something simpler.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Frost echoes this notion, citing a time she bought a property from someone who wasn\u2019t concerned about price, \u201cWe couldn\u2019t afford it and were about to walk, but he took $100,000 off\u2026He wanted a quick sale\u2014that was important to him, so we traded off on price.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">She notes that sometimes both sides want the same thing\u2014to quickly and easily close the deal\u2014making for an easier negotiation. Taking what both parties want or don\u2019t want off the table early on establishes goodwill and momentum, which Frost says, \u201chelps with progress, likely making it easier to deal with the hard stuff at the end.\u201d After all, she notes, people want to help those they like.<\/span><\/p>\n<p>\u00a0<\/p>\n<h2><b>Keeping a crumbling deal alive<\/b><\/h2>\n<p>\u00a0<\/p>\n<p><span style=\"font-weight: 400;\">If negotiations stall despite best efforts, Cumming advises determining whether a Zone of Possible Agreement (ZOPA)\u2014or overlap in what the buyer\u2019s willing to pay and what the seller\u2019s willing to take\u2014exists. If there\u2019s room to move, skilled negotiators use techniques to reduce defensiveness, foster open discussion and guide clients toward mutually beneficial outcomes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Above all, it\u2019s never about pushing them toward a deal or price, which many agents do, Cumming stresses. \u201cThis is why they\u2019re not trusted. The fact that the industry and its reward system is commission-centred teaches agents to push, meaning they skip over the real client experience and service, and the complex skills of putting great transactions together.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Instead, she insists it\u2019s about finding a way to create the right environment for people to make important decisions for themselves.<\/span><\/p>\n<\/div>\n\n","protected":false},"excerpt":{"rendered":"<p>Current market conditions in many of Canada\u2019s larger cities are creating opportunities; with increased inventory and less competition, buyers have more choices, and motivated sellers are open to negotiation.
