{"id":148580,"date":"2025-03-21T22:57:18","date_gmt":"2025-03-21T22:57:18","guid":{"rendered":"https:\/\/peraltafinancing.com\/activist\/the-dark-mccarthyist-history-of-deporting-activists\/"},"modified":"2025-03-21T22:57:18","modified_gmt":"2025-03-21T22:57:18","slug":"the-dark-mccarthyist-history-of-deporting-activists","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=148580","title":{"rendered":"The Dark, McCarthyist History of Deporting Activists"},"content":{"rendered":"<p> <br \/>\n<br \/><img decoding=\"async\" src=\"https:\/\/progressive.org\/downloads\/21562\/download\/McCarranWalter7.png?cb=cf98ce483c4e87dad870b177e61bdad1\" \/><\/p>\n<div>\n<p class=\"lead\">When immigration agents <a href=\"https:\/\/progressive.org\/latest\/ice-takes-columbia-student-as-political-prisoner-amid-free-speech-crackdown-baum-20250318\/\">accosted<\/a> Mahmoud Khalil and his wife in the lobby of their apartment building in New York City in early March, the Palestinian solidarity activist, former Columbia University graduate student, and expecting father <a href=\"https:\/\/www.nytimes.com\/2025\/03\/10\/us\/trump-rubio-khalil-columbia-student-protests.html\" target=\"_blank\" aria-label=\"Link opens in new window (became the symbolic target)\">became the symbolic target<\/a> of the Trump Administration\u2019s crusade to expel noncitizen activists who have participated in nationwide campus protests against Israel\u2019s genocide in Gaza. Yet Khalil\u2019s <a href=\"https:\/\/www.wwno.org\/louisiana-news\/2025-03-20\/mahmoud-khalil-still-detained-in-notorious-louisiana-detention-center-as-case-is-moved-to-new-jersey\" target=\"_blank\" aria-label=\"Link opens in new window (detention in Louisiana)\">detention in Louisiana<\/a> and pending deportation reflect a history of politicized immigration enforcement that extends far beyond the political maelstrom around Palestine.<\/p>\n<p>In some ways, Khalil\u2019s case seems exceptional: The removal of legal permanent residents is relatively rare, especially as Khalil has <a href=\"https:\/\/www.aljazeera.com\/news\/2025\/3\/19\/us-court-rejects-trump-bid-to-dismiss-mahmoud-khalil-deportation-challenge\" target=\"_blank\" aria-label=\"Link opens in new window (not been convicted)\">not been convicted<\/a> of any crime. His main offense, <a href=\"https:\/\/x.com\/DHSgov\/status\/1898908955675357314\" target=\"_blank\" aria-label=\"Link opens in new window (according to)\">according to<\/a> the Department of Homeland Security, is engaging in \u201cactivities aligned to Hamas\u201d\u2014the administration\u2019s shorthand for peaceful pro-Palestine protests. Although he has been spared deportation while <a href=\"https:\/\/apnews.com\/article\/columbia-protests-immigration-detention-mahmoud-khalil-755774045e5e82849e3281e8ff72f26d\" target=\"_blank\" aria-label=\"Link opens in new window (his case is pending)\">his case is pending<\/a> in immigration court, his detention\u2014coupled with Donald Trump\u2019s <a href=\"https:\/\/www.axios.com\/2025\/03\/04\/trump-college-protests-israel-gaza-funding\" target=\"_blank\" aria-label=\"Link opens in new window (threat to slash)\">threat to slash<\/a> federal funding for any school or university that allows \u201cillegal protests\u201d\u2014reveals that this administration is focused on targeting anyone deemed politically undesirable, even if they are a legal permanent resident.<\/p>\n<p>Yet Khalil\u2019s case is not so unique. First, he is <a href=\"https:\/\/www.theverge.com\/policy\/634094\/trump-dhs-arresting-palestine-student-activists-ice\" target=\"_blank\" aria-label=\"Link opens in new window (one of several)\">one of several<\/a> <a href=\"https:\/\/www.cornellsun.com\/article\/2025\/03\/cornell-professor-graduate-students-sue-federal-government-over-first-amendment-violations\" target=\"_blank\" aria-label=\"Link opens in new window (academics who have been)\">academics who have been<\/a> <a href=\"https:\/\/foreignpolicy.com\/2025\/03\/21\/trump-deportation-columbia-university-palestinian-protest-mahmoud-khalil-badar-khan-suri\/?tpcc=recirc_latest062921\" target=\"_blank\" aria-label=\"Link opens in new window (threatened with deportation)\">threatened with deportation<\/a> in recent months in the backlash to the pro-Palestine protests. Days after his arrest, the Trump Administration revoked the visa of <a href=\"https:\/\/www.cnn.com\/2025\/03\/16\/us\/ranjani-srinivasan-columbia-university\/index.html\" target=\"_blank\" aria-label=\"Link opens in new window (another Columbia graduate student)\">another Columbia graduate student<\/a> who participated in last year\u2019s protests. Khalil\u2019s case also folds into a long history of the U.S. government wielding political deportation as a tool of repression. Secretary of State Marco Rubio claims he is deportable under an arcane provision of the <a href=\"https:\/\/encyclopedia.densho.org\/Immigration_Act_of_1952\/\" target=\"_blank\" aria-label=\"Link opens in new window (Immigration and Nationality Act of 1952)\">Immigration and Nationality Act of 1952<\/a>, also known as the McCarran-Walter Act, <a href=\"https:\/\/constitutioncenter.org\/blog\/immigration-law-from-the-1950s-may-play-role-in-columbia-deportation-case\" target=\"_blank\" aria-label=\"Link opens in new window (a product)\">a product<\/a> of Cold War anticommunist hysteria, which states that a noncitizen can be deported if the Secretary of State believes their \u201cpresence or activities in the United States . . . would have potentially serious adverse foreign policy consequences for the United States.\u201d In <a href=\"https:\/\/www.nytimes.com\/2025\/03\/10\/us\/trump-rubio-khalil-columbia-student-protests.html\" target=\"_blank\" aria-label=\"Link opens in new window (publicly demonizing)\">publicly demonizing<\/a> human rights activists like Khalil as violent extremists, the White House draws on the ideological mythmaking of the 1950s Red Scare.<\/p>\n<hr\/>\n<p>Seventy-five years before Khalil was shunted into <a href=\"https:\/\/lailluminator.com\/2025\/03\/21\/mahmoud-khalil\/\" target=\"_blank\" aria-label=\"Link opens in new window (a detention center)\">a detention center<\/a> in Jena, Louisiana, Black Trinidadian-born Communist Party leader Claudia Jones looked out over New York harbor from the prison at Ellis Island, where she was imprisoned in 1950, awaiting deportation. Jones, whose blend of Marxist feminism and militant racial justice activism had <a href=\"https:\/\/www.aaihs.org\/the-deportation-of-claudia-jones\/\" target=\"_blank\" aria-label=\"Link opens in new window (made her a target)\">made her a target<\/a> of the federal government for years, <a href=\"https:\/\/oldestvocation.com\/claudia-jones-letter-ellis-island\/\" target=\"_blank\" aria-label=\"Link opens in new window (wrote a letter)\">wrote a letter<\/a> in 1950 contemplating her experience as a radical en route to exile, observing that the Statue of Liberty \u201cliterally stands with her back to Ellis Island.\u201d\u00a0<\/p>\n<p>Jones mused that America\u2019s global image as a beacon of freedom and refuge for immigrants was betrayed by the way the country treated immigrant activists like her. She, like many other political activists, had been denied bail under the <a href=\"https:\/\/firstamendment.mtsu.edu\/article\/mccarran-internal-security-act-of-1950\/\" target=\"_blank\" aria-label=\"Link opens in new window (1950 Internal Security Act)\">1950 Internal Security Act<\/a>, which gave the President \u201cemergency\u201d powers to use preventive detention against someone suspected of espionage or sabotage. For Jones and her fellow detainees, including trade unionists and civil rights activists, deportation\u2014which is a matter of civil, not criminal, law\u2014had become a weapon of persecution that felt utterly disconnected from the United States\u2019s reputation as the world\u2019s preeminent democracy.<\/p>\n<p>\u201cThe ridiculous part of it,\u201d Jones wrote, \u201cis that the American people are supposedly asked to believe that we are \u2018awaiting deportation hearings\u2019\u2014a \u2018normal procedure.\u2019 \u201d She continued, \u201cThe truth, of course, is that this is a clear violation of the American Constitution [and] the Bill of Rights, both of which guarantee the right of bail and the right of habeas corpus.\u201d<\/p>\n<p>Around the same time, Harry Carlisle, a British-born writer and founding member of the Los Angeles Committee for the Protection of Foreign Born, was penning his own observations from the Terminal Island detention facility near Los Angeles, an immigration prison off the coast of California. Carlisle was being held with three other noncitizen leftists who alongside him became known as the <a href=\"https:\/\/oac.cdlib.org\/findaid\/ark:\/13030\/kt067nb6v8\/admin\/\" target=\"_blank\" aria-label=\"Link opens in new window (Terminal Island Four)\">Terminal Island Four<\/a>: Korean-born architect David Hyun, Polish-born communist educator Frank Carlson, and British dance instructor Miriam Stevenson. Comparing the the unilateral and undemocratic authority with which the state had detained him to the allegations against Carlisle and his fellow immigrants, he wrote in an open letter to then Attorney General Howard McGrath:\u00a0<\/p>\n<p><em>\u201cYour department terms us \u2018undesirable.\u2019 Yet all four of us have been residents of the United States or its territories for decades, some of us since early childhood, and we have no criminal records. . . . Yes, we are part of the millions of foreign-born non-citizens, whom you now threaten with jail and deportation in order to coerce them into compliance with beliefs and policies leading to war and fascism.\u201d<\/em><\/p>\n<hr\/>\n<p>While it was <a href=\"https:\/\/immigrationhistory.org\/item\/immigration-and-nationality-act-the-mccarran-walter-act\/\" target=\"_blank\" aria-label=\"Link opens in new window (framed)\">framed<\/a> as an immigration reform law, McCarran-Walter actually built on a series of national security policies clamping down on leftwing political activity in the preceding years. There was the <a href=\"https:\/\/firstamendment.mtsu.edu\/article\/smith-act-of-1940\/\" target=\"_blank\" aria-label=\"Link opens in new window (1940 Alien Registration Act)\">1940 Alien Registration Act<\/a>, which required immigrants to register with federal authorities and criminalized any movement or organization deemed to be advocating the \u201coverthrow\u201d of the government. A decade later came the <a href=\"https:\/\/web.archive.org\/web\/20221006103713\/http:\/\/tucnak.fsv.cuni.cz\/~calda\/Documents\/1950s\/Inter_Security_50.html\" target=\"_blank\" aria-label=\"Link opens in new window (Internal Security Act of 1950)\">Internal Security Act of 1950<\/a>, which established a Subversive Activities Control Board to surveil and suppress leftist organizations and gave the President emergency powers to detain those suspected of espionage or sabotage.<\/p>\n<p>McCarran-Walter also maintained draconian immigration restrictions that had <a href=\"https:\/\/www.migrationpolicy.org\/article\/1924-us-immigration-act-history\" target=\"_blank\" aria-label=\"Link opens in new window (sharply limited migration)\">sharply limited migration<\/a> from Eastern and Southern Europe, while imposing political strictures targeting the left. In turn, foreign-born Americans, even naturalized citizens, who had been involved with labor and political activism since the Popular Front mobilizations of the 1930s, became more vulnerable to being investigated, detained, and removed from the country on political grounds. Some immigrants <a href=\"https:\/\/scholarlypublishingcollective.org\/uip\/jaeh\/issue\/43\/4\" target=\"_blank\" aria-label=\"Link opens in new window (were surveilled)\">were surveilled<\/a> and <a href=\"https:\/\/doi.org\/10.1163\/23519924-09010005\" target=\"_blank\" aria-label=\"Link opens in new window (put into deportation proceedings)\">put into deportation proceedings<\/a> based on evidence of \u201csubversive activity\u201d that dated back decades.\u00a0<\/p>\n<p>According to a <a href=\"https:\/\/www.jstor.org\/stable\/40400330\" target=\"_blank\" aria-label=\"Link opens in new window (survey)\">survey<\/a> by the National Lawyers Guild published in 1955 of more than 200 people arrested for deportation on political grounds between 1944 and 1952, nearly all had resided in the United States for at least twenty-one years; two out of three had lived in the United States for more than thirty-one years. A large majority were also more than sixty-five years old. Nearly half hailed from Eastern Europe or the Balkans. Nearly half had applied for citizenship at least once, and a similar portion were parents of children who were U.S. citizens. About one in ten had been officers of trade unions, underscoring how being a visible labor activist could expose one to political persecution via immigration enforcement.\u00a0<\/p>\n<p><a href=\"https:\/\/www.nytimes.com\/1975\/09\/17\/archives\/james-j-mantles-a-top-official-of-electrical-workers-66-dies.html\" target=\"_blank\" aria-label=\"Link opens in new window (James Matles)\">James Matles<\/a>, the Romanian-born director of organization for the leftwing United Electrical Workers Union (UE), faced denaturalization based on allegations that he had been a communist prior to becoming a citizen. A pamphlet issued by UE <a href=\"https:\/\/digicoll.lib.berkeley.edu\/record\/71303\/files\/lb000153.pdf\" target=\"_blank\" aria-label=\"Link opens in new window (described)\">described<\/a> Matles as a victim of both the state and the corporations he had challenged as an organizer, like Westinghouse and General Electric, noting that the Justice Department had previously attempted to indict him under the anti-communist provisions of the conservative <a href=\"https:\/\/www.nlrb.gov\/about-nlrb\/who-we-are\/our-history\/1947-taft-hartley-substantive-provisions\" target=\"_blank\" aria-label=\"Link opens in new window (Taft-Hartley)\">Taft-Hartley<\/a> labor law. \u201cIf the corporations succeed in taking away his citizenship because of his effectiveness as a labor leader,\u201d the pamphlet read, \u201cMatles and his American-born wife and child won\u2019t be the only ones hurt in the process . . . . Foreign-born workers, whether non-citizens, naturalized, or first-generation, would see this as a threat to their own [status] if they stand up to rate-cuts, speed up, and seniority violations. It would disorganize electrical and machine workers.\u201d (Matles ultimately <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/356\/256\/\" target=\"_blank\" aria-label=\"Link opens in new window (took his fight)\">took his fight<\/a> to retain his citizenship to the Supreme Court, which threw out the case in 1958.)\u00a0<\/p>\n<p>The zeal for political deportation faded largely by the early 1960s. The McCarthyite climate of repression had <a href=\"https:\/\/www.theatlantic.com\/magazine\/archive\/2017\/04\/who-stopped-mccarthy\/517782\/\" target=\"_blank\" aria-label=\"Link opens in new window (dissipated)\">dissipated<\/a> due to political backlash and courts invalidating some of the most draconian anti-communist restrictions. But the intersection of political persecution and immigration enforcement has resurfaced in more subtle ways in recent years.\u00a0<\/p>\n<p>In 2018, Ravi Ragbir, a Trinidadian-born immigrant rights advocate who had been a prominent deportation defense advocate with the New Sanctuary Project in New York City, was <a href=\"https:\/\/www.thenation.com\/article\/archive\/ravi-ragbir-deportation-free-speech\/\" target=\"_blank\" aria-label=\"Link opens in new window (abruptly detained)\">abruptly detained<\/a> by U.S. Immigration and Customs Enforcement (ICE) on a long-pending deportation order. He <a href=\"https:\/\/theintercept.com\/2019\/04\/27\/ice-ravi-ragbir-appeals-court-ruling\/\" target=\"_blank\" aria-label=\"Link opens in new window (claimed in court)\">claimed in court<\/a> that ICE was punishing him for his activism, violating his First Amendment rights.\u00a0<\/p>\n<p>Another <a href=\"https:\/\/www.dissentmagazine.org\/online_articles\/the-abduction-of-mahmoud-khalil\/\" target=\"_blank\" aria-label=\"Link opens in new window (chilling precursor)\">chilling precursor<\/a> to Khalil\u2019s experience was the case of the 1987 <a href=\"https:\/\/ccrjustice.org\/home\/what-we-do\/our-cases\/matter-hamide-and-shehadeh\" target=\"_blank\" aria-label=\"Link opens in new window (Los Angeles Eight)\">Los Angeles Eight<\/a>, in which a group of young activists in California\u2014seven Palestinians and one Kenyan\u2014were <a href=\"https:\/\/www.aclu.org\/press-releases\/california-judge-ends-20-year-old-deportation-case-against-palestinians\" target=\"_blank\" aria-label=\"Link opens in new window (charged)\">charged<\/a> with being members of the Marxist-Leninist Popular Front for the Liberation of Palestine. Years later, with the passage of the post-9\/11 USA PATRIOT Act, the government <a href=\"https:\/\/www.thenation.com\/article\/archive\/911-and-la-8\/\" target=\"_blank\" aria-label=\"Link opens in new window (doubled down)\">doubled down<\/a> by additionally charging Los Angeles Eight members Khader Hamide and Michel Shehadeh, both green card holders, with giving \u201cmaterial support\u201d to a terrorist organization. The case was <a href=\"https:\/\/www.nytimes.com\/2007\/11\/01\/us\/01settle.html\" target=\"_blank\" aria-label=\"Link opens in new window (finally dismissed)\">finally dismissed<\/a> twenty years later, after the government failed to present evidence of their membership in the named organization. By then, the activists had settled into fairly ordinary lives as naturalized citizens and permanent residents of the United States.<\/p>\n<p>Hopefully, Khalil and his young family will not have to wait another twenty years for justice. But their allies, in rallying to demand his release, are already writing the next chapter in an old story of political deportation and resistance.\u00a0<\/p>\n<hr\/>\n<p>In 1953, Abner Green, the leader of the <a href=\"https:\/\/findingaids.library.nyu.edu\/tamwag\/tam_086\/\" target=\"_blank\" aria-label=\"Link opens in new window (American Committee for the Protection of Foreign Born)\">American Committee for the Protection of Foreign Born<\/a>, reported growing concern that foreign-born U.S. residents faced unprecedented threats amid the nationwide rise of anti-communist and anti-immigrant sentiment, ongoing conflict with Communist China in the Korean War, and an intensifying atmosphere of repression. But so, too, did all other Americans.\u00a0<\/p>\n<p>\u201cCongress is anti-alien. The Justice Department is anti-alien. The courts are anti-alien,\u201d Green warned at a national conference for immigration advocates. The group, he argued, would have to defend equal justice for immigrants by centering universal values enshrined in the Bill of Rights, for U.S.- and foreign-born people alike. \u201cWe have one advantage,\u201d he said. \u201cWe speak of and for the people of this country. We are with the millions of Americans who want peace and who want security. To them we say the deportation of non-citizens is part of this attempt to destroy the liberties of the American people, to impose police-state conditions of living for all persons in the country in order to prevent a united people\u2019s fight for peace.\u201d\u00a0<\/p>\n<p>The committee\u2019s movement defended noncitizens\u2019 rights under the banner of defending all Americans\u2019 right to due process and dignity. In many cases, they were successful\u2014of those investigated and ordered deported, only a small percentage were actually removed, thanks to a robust legal defense from civil liberties advocates, and courts that were at least somewhat sympathetic to their free speech arguments. In the National Lawyers Guild study, only about five percent of the cases studied ended with an actual removal. The main hardship most of the targeted dissenters endured was not expulsion itself, but the burden of detention, surveillance, and protracted legal limbo.\u00a0<\/p>\n<p>Nonetheless, the failure of the government\u2019s postwar deportation drive suggests that a fierce defense of the First Amendment and due process rights for noncitizens helped many activists and their families avoid the worst of the xenophobic political persecution under McCarthyism.<\/p>\n<p>As Claudia Jones put it in her 1950 letter, deportation resistance is not about what happens in the courts. \u201cLegal struggles, important as they are . . . are incidental to the mass struggle to free us . . . . No law or decree can whittle away or pierce by one iota our convictions and loyalty to America\u2019s democratic and revolutionary traditions.\u201d She continued, \u201cWhat we want is aid\u2014aid morally, financially, and above all by mass protests and action, to the mass campaign of the American Committee for Protection of the Foreign Born, by the trade unions, the Negro people, the women, the youth, national groups, and all labor progressives who love peace and cherish freedom, lest all face the bestiality and tormented degradation of fascism.\u201d<\/p>\n<p>A new mass struggle may now be emerging once again to defend politically persecuted immigrants. We are seeing the beginnings of it in <a href=\"https:\/\/www.cbsnews.com\/newyork\/news\/mahmoud-khalil-protest-arrests-at-city-hall\/\" target=\"_blank\" aria-label=\"Link opens in new window (recent demonstrations)\">recent demonstrations<\/a> in New York City, with Columbia activists calling for Khalil\u2019s release and Jewish protesters <a href=\"https:\/\/apnews.com\/article\/columbia-university-protests-khalil-trump-tower-8e2f455134a2f1b82458e32aecbb59f7\" target=\"_blank\" aria-label=\"Link opens in new window (declaring)\">declaring<\/a> \u201cNot in our name.\u201d A few months ago, Khalil himself was protesting alongside them, calling for peace and Palestinian freedom.
