For your expert witnesses under the gun of
\ncross-examination, usually the most problematic answer is a flat \u201cyes\u201d or \u201cno.\u201d
\nScience holds few absolutes to be true, thus most scientists (which is the
\nmajority of your experts) are uncomfortable with an uncategorical \u201cyes\u201d or \u201cno\u201d
\nin response to many of opposing counsel\u2019s questions.<\/p>\n

Yet opposing counsel has one goal in mind: get that expert
\nto say \u201cyes\u201d to certain questions and \u201cno\u201d to certain others.<\/p>\n

A useful technique is to suggest to your expert that they
\nrespond with a qualifier in front of their \u201cyes\u201d or \u201cno,\u201d such as: \u201cIn this
\nsituation, yes.\u201d \u201cUnder certain conditions, no.\u201d \u201cWhen X is detected, yes.\u201d \u201cIn
\nthe presence of Y, no.\u201d And so on.<\/p>\n

These responses open the door to asking your witness later, why<\/i> they qualified their answer in such
\na manner.<\/p>\n

Now, here\u2019s where it gets really interesting: the results of
\nmeta-research<\/a> on 107
\ndifferent studies conducted over 50 years on persuasion and sidedness show that
\ntwo-sided arguments are more persuasive than their one-sided equivalents, as
\nlong as counter-arguments are raised when presenting the opposing view.<\/p>\n

So, in telling the jury the rationale behind the qualifier,
\nthe expert can present their thinking. For example: \u201cIt could be said, as
\nopposing counsel\u2019s expert stated, that X is a determining factor, however, more
\nrecent studies show that Y is the more decisive, thus the basis for my opinion.\u201d
\nThis format serves to present the two sides of the argument, even as it raises
\nthe counter argument.<\/p>\n
