The designation process was triggered due to President Trump\u2019s concern over the trafficking of fentanyl and migrants by these organisations.<\/p>\n<p>Since 2020, <a href=\"https:\/\/www.npr.org\/2019\/12\/13\/787441881\/this-grieving-family-wants-the-u-s-to-designate-mexican-cartels-as-terrorists\">due to the massacre of the LeBaron Mexican-American family<\/a>, some <a href=\"https:\/\/www.usatoday.com\/story\/news\/crime\/2023\/04\/06\/mexican-drug-cartels-terrorist-organizations-senators-fentanyl-mexico-border\/70081004007\/\">members of the Republican Party<\/a> have been calling to designate Mexican drug cartels as terrorist organisations and to consider the possibility of applying <a href=\"https:\/\/www.politico.com\/news\/2023\/04\/10\/gop-bomb-mexico-fentanyl-00091132\">measures similar to those of Al-Qaeda or the Islamic State (ISIS)<\/a>.<\/p>\n<p>This measure pretends to help American law enforcers combat drug cartels by giving them more power to freeze cartel assets and deny members entry to US soil. However, Mexican authorities fear that this designation could be used to justify <a href=\"https:\/\/www.wsj.com\/world\/americas\/trump-mexico-drug-cartel-fentanyl-us-military-fb9f193c\">unconsented military operations in Mexican territory<\/a> (through a <a href=\"https:\/\/www.rollingstone.com\/politics\/politics-features\/trump-mexico-drug-cartels-military-invade-1235183177\/\">\u201csoft invasion,\u201d<\/a> as some American politicians have called it) invoking the right to self-defence.<\/p>\n<p>Thus, this post aims to analyse the legal consequences of such designation from an international law perspective, specifically the <em>ius ad bellum<\/em>, to determine whether the US could invoke a right to self-defence against drug cartels operating in Mexican territory. As it would be explained, even under an expansive interpretation of this right, following the <a href=\"https:\/\/www.justsecurity.org\/88346\/the-expansion-of-self-defense\/\">practice of the US regarding the war on terror<\/a>, American military operations could not be justified as self-defence, as international law stands today. Rather, if they occur, unconsented military operations could constitute an act of aggression, as it would violate Mexico\u2019s territorial sovereignty, even if the operations are not conducted against the Mexican army.<\/p>\n<p><strong>Self-Defence against Terrorist Organisations<\/strong><\/p>\n<p>Under international law, it is indisputable that using armed force against another state\u2019s territory, sovereignty, or political independence constitutes a violation of Article 2(4) of the UN Charter regarding the prohibition of the use of force. Any armed attack by American troops against Mexico would be characterised as an act of aggression (according to UN General Assembly\u2019s <a href=\"http:\/\/hrlibrary.umn.edu\/instree\/GAres3314.html\">Resolution 3314(XXIX)<\/a> of 1974).<\/p>\n<p>The only possible exception that could preclude the wrongfulness of these attacks (as established in <a href=\"chrome-extension:\/\/efaidnbmnnnibpcajpcglclefindmkaj\/https:\/legal.un.org\/ilc\/texts\/instruments\/english\/draft_articles\/9_6_2001.pdf\">Article 21 of ARSIWA<\/a>) would be the right to self-defence. Although the US government has not expressly invoked this right in this context, American authorities refer to their actions as part of a national security strategy, which suggests an argument that would rely on this exception.<\/p>\n<p>However, the right to self-defence can only be triggered in response to an \u201carmed attack.\u201d As will be explained, international law debates whether non-state armed groups (NSAG) are capable of committing an \u201carmed attack.\u201d For the sake of the argument, it is important to highlight that so far, drug cartels have not used armed force against the US. However, this post will explore whether an attack launched by a drug cartel against the US could be classified as an \u201carmed attack\u201d that triggers this right.<\/p>\n<p><strong>Two Approaches to Defining \u201cArmed Attack\u201d<\/strong><\/p>\n<p>According to Article 51 of the UN Charter, self-defence can only be invoked in response to an \u201carmed attack,\u201d <a href=\"https:\/\/www.cambridge.org\/core\/books\/armed-attack-and-article-51-of-the-un-charter\/F31FCA4C7F6B1D561466CEEEDDF014FF\">traditionally understood as the use of armed forces of one State against another<\/a>. Considering that the prohibition on the use of force (Article 2.4 of the UN Charter) is an inter-State obligation, then the exception to the general rule (Article 51) should be interpreted in those terms.<\/p>\n<p>This implies that drug cartels cannot commit armed attacks, which excludes the possibility of targeting (in self-defence) NSAG in another state\u2019s territory without that State\u2019s consent. As <a href=\"https:\/\/www.cambridge.org\/core\/books\/abs\/armed-attack-and-article-51-of-the-un-charter\/armed-attack-and-other-conditions-of-selfdefence\/F5558C40B0866BE14B8119D88ECEC021\">Tom Ruys<\/a> argues, this narrow approach is supported by the drafting process of Article 51 and followed by many States, including Mexico.<\/p>\n<p>According to this approach, non-state actors can only commit an armed attack when they are sent \u201cby or on behalf of a State\u201d and when the attacks are of \u201csuch gravity\u201d as to amount to an act of aggression (<a href=\"http:\/\/hrlibrary.umn.edu\/instree\/GAres3314.html\">Resolution 3314<\/a>, Article 3(g)). Thus, invoking the right to self-defence in this context requires that <a href=\"https:\/\/www.ejiltalk.org\/self-defense-and-non-state-actors-indeterminacy-and-the-jus-ad-bellum\/\">the NSAG\u2019s attacks be attributable to a State<\/a>, which requires that the NSAG was acting under the instructions, direction, or control of a State, as articulated in <a href=\"chrome-extension:\/\/efaidnbmnnnibpcajpcglclefindmkaj\/https:\/legal.un.org\/ilc\/texts\/instruments\/english\/draft_articles\/9_6_2001.pdf\">Article 8 of ARSIWA<\/a>.<\/p>\n<p>According to the ICJ\u2019s arguments in this regard (as articulated in <em><a href=\"https:\/\/www.icj-cij.org\/sites\/default\/files\/case-related\/70\/070-19860627-JUD-01-00-EN.pdf\">Nicaragua<\/a><\/em> and the <em><a href=\"https:\/\/www.icj-cij.org\/sites\/default\/files\/case-related\/91\/091-20070226-JUD-01-00-EN.pdf\">Genocide<\/a><\/em> cases), the test of attribution would require either (1) proofing a relationship of \u201ccomplete dependence\u201d between Mexico and the cartel, to the point of considering the cartel as a <em>de facto<\/em> state organ; or (2) that Mexico exercised effective control over the military operation that caused the armed attack. Thus, these requirements imply that the threshold to prove the nexus of attribution is challenging.<\/p>\n<p>However, there is a second approach that has received <a href=\"https:\/\/academic.oup.com\/ejil\/article\/20\/2\/359\/500852#7722562\">increasing support<\/a> in the last two decades and that has been embraced by the US since the 9\/11 attacks by Al-Qaeda. Some <a href=\"https:\/\/repository.law.umich.edu\/book_chapters\/119\/\">scholars<\/a> and States (e.g., <a href=\"https:\/\/docs.un.org\/en\/S\/2016\/523\">Belgium<\/a>, <a href=\"https:\/\/www.securitycouncilreport.org\/atf\/cf\/%7B65BFCF9B-6D27-4E9C-8CD3-CF6E4FF96FF9%7D\/s_2015_946.pdf\">Germany<\/a>, and <a href=\"https:\/\/docs.un.org\/en\/S\/2016\/513\">Norway<\/a>) maintain that Article 51 does not constrain the definition of \u201carmed attack\u201d to an inter-State scenario. This narrow approach was criticised by a minority of judges in the <em><a href=\"https:\/\/www.icj-cij.org\/case\/131\/advisory-opinions\">Wall Advisory Opinion<\/a><\/em> and left open in the case of <em><a href=\"https:\/\/www.icj-cij.org\/sites\/default\/files\/case-related\/116\/116-20051219-JUD-01-00-EN.pdf\">Armed Activities<\/a><\/em>. Furthermore, Security Council\u2019s <a href=\"https:\/\/digitallibrary.un.org\/record\/448051?ln=en\">Resolutions 1368<\/a> (12 September 2001) and <a href=\"chrome-extension:\/\/efaidnbmnnnibpcajpcglclefindmkaj\/https:\/www.unodc.org\/pdf\/crime\/terrorism\/res_1373_english.pdf\">1373<\/a> (28 September 2001) have been understood as extending self-defence to terrorist attacks.<\/p>\n<p>This approach could hypothetically justify a reaction in self-defence if a drug cartel launches an attack against the US. However, further considerations need to be taken into account before adopting this expansive interpretation of Article 51.<\/p>\n<p><strong>A Global Consensus Towards the Recognition of Self-defence against NSAG?<\/strong><\/p>\n<p>Some <a href=\"https:\/\/repository.law.umich.edu\/book_chapters\/119\/\">scholars<\/a> have been too enthusiastic that this approach already constitutes <em>lex lata<\/em>, as it is perceived as an unstoppable trend among States. Nevertheless, four caveats require further analysis.<\/p>\n<ol class=\"wp-block-list\">\n<li>This approach requires that the cartel\u2019s attack (or series of attacks) must be grave enough to reach the threshold of an \u201carmed attack\u201d (see <a href=\"https:\/\/www.icj-cij.org\/sites\/default\/files\/case-related\/90\/090-20031106-JUD-01-00-EN.pdf\"><em>Oil Platforms Case<\/em><\/a><em>,<\/em> para 51 and <em><a href=\"https:\/\/www.icj-cij.org\/sites\/default\/files\/case-related\/70\/070-19860627-JUD-01-00-EN.pdf\">Nicaragua<\/a><\/em>, para 191). Thus, not any operation would be automatically classified as an \u201carmed attack\u201d that triggers the right to self-defence.<\/li>\n<li>Despite increasing support for this approach, this debate is far from settled, as the different State interventions demonstrated in the <a href=\"https:\/\/media.un.org\/avlibrary\/en\/asset\/d260\/d2604457\">Arria Formula Meeting convened by Mexico in 2021<\/a> regarding self-defence against NSAG. <a href=\"https:\/\/perma.cc\/7SC3-UBDG\">Latin American States<\/a>, in general, have expressed their opposition to this approach. Also, even though some Western states have invoked Article 51 in self-defence against NSAG, <a href=\"https:\/\/perma.cc\/K4XQ-D4BZ\">their practice has not been uniform and their justifications have differed<\/a> (<em>opinio juris<\/em>), undermining the norm\u2019s consolidation as a customary rule.<\/li>\n<li>Even if the right to self-defence against terrorist organisations is crystallised through customary law, the discussion of whether drug cartels could be classified as terrorist organisations remains open.\n<p>Although there is possibly an emerging consensus that the concept of terrorism involves a broad notion of \u201ccriminal violence intended to intimidate a population or coerce a government\u201d (see <a href=\"https:\/\/global.oup.com\/academic\/product\/defining-terrorism-in-international-law-9780199295975?cc=mx&amp;lang=en&amp;\"><em>Defining Terrorism in International Law<\/em><\/a> by Ben Saul), under international law, there is no universally accepted definition of terrorism. Thus, the US would need to legally justify the classification of drug cartels as terrorist organisations as a prerequisite to exercise a hypothetical right to self-defence.<\/p>\n<\/li>\n<li>One last important issue is Mexico\u2019s sovereign rights as the State in which the cartel operates. Two doctrines have been developed in this regard to justify the violation of the State\u2019s territorial sovereignty. One is the <a href=\"https:\/\/www.lawfaremedia.org\/article\/which-states-support-unwilling-and-unable-test\">\u201cunwilling or unable\u201d<\/a> standard, adopted by the US, that maintains that when a State is not capable of or not willing to stop the launch of attacks by NSAG from its territory, then a reaction in self-defence is justified. The second standard is the \u201cexercise of effective control,\u201d adopted by <a href=\"https:\/\/www.securitycouncilreport.org\/atf\/cf\/%7B65BFCF9B-6D27-4E9C-8CD3-CF6E4FF96FF9%7D\/s_2015_946.pdf\">Germany<\/a> and <a href=\"https:\/\/docs.un.org\/en\/S\/2016\/523\">Belgium<\/a>. It states that action against a NSAG in another State is justified without the State\u2019s consent if it has lost effective control over the relevant territory.\u00a0<\/li>\n<\/ol>\n<p>Thus, in any event, the US would have to demonstrate that any of these scenarios has been reached in a particular case.<\/p>\n<p><strong>What are the Possible Outcomes?<\/strong><\/p>\n<p>As explained, the legality of the right to self-defence against NSAG remains an open discussion. Although some scholars and Western States share this expansive interpretation, it is not <a href=\"https:\/\/www.justsecurity.org\/88346\/the-expansion-of-self-defense\/\">universally accepted<\/a>. <a href=\"https:\/\/perma.cc\/K4XQ-D4BZ\">Latin American states, especially Mexico<\/a>, have continuously expressed concerns and disagreements. This is of utmost relevance in this debate, as they can be considered as <a href=\"https:\/\/www.cambridge.org\/core\/journals\/american-journal-of-international-law\/article\/abs\/speciallyaffecting-states-doctrine\/A77B3C2A4BC4E8B632A3004B498DA10F\">specially affected states<\/a> in the crystallisation of a customary norm in this issue.<\/p>\n<p>On the other hand, it is possible that this situation will not trigger further international legal consequences. Trump\u2019s designation of drug cartels as foreign terrorist organisations might be more a <a href=\"https:\/\/www.elfinanciero.com.mx\/nacional\/2024\/12\/23\/trump-declarara-a-carteles-como-organizaciones-terroristas\/\">measure of political pressure<\/a> against the Mexican government than a real threat. During Trump\u2019s meeting with President Claudia Sheinbaum, he agreed to <a href=\"https:\/\/edition.cnn.com\/2025\/02\/03\/world\/sheinbaum-trump-tariffs-paused\/index.html\">pause the imposition of 25% tariffs on Mexican products after Mexico committed to supply 10,000 soldiers on the border to stop the flow of drugs and illegal migration<\/a>.<\/p>\n<p>It seems that Mexico has even taken further measures as a response, like a <a href=\"https:\/\/comunicacionsocial.diputados.gob.mx\/index.php\/notilegis\/dof-publica-reforma-constitucional-que-amplia-catalogo-de-delitos-que-ameritan-prision-preventiva-oficiosa\">new constitutional amendment of Article 19<\/a> to extend pre-trial detention for crimes related to the production, storage, or distribution of fentanyl.<\/p>\n<p>Another possible scenario is a joint military strategy between the Mexican and American governments, like the <a href=\"https:\/\/mx.usembassy.gov\/the-merida-initiative\/\">Merida Initiative<\/a> of 2008. The president of the Mexican Commission on National Defense has already said that <a href=\"https:\/\/www.elfinanciero.com.mx\/nacional\/2024\/12\/12\/soldados-de-eu-ingresaran-a-mexico-en-2025-a-que-estados-llegara-el-ejercito-estadounidense\/\">cooperation with the American government in conducting military operations against drug cartels<\/a> is possible.
