{"id":141610,"date":"2025-03-18T12:30:19","date_gmt":"2025-03-18T12:30:19","guid":{"rendered":"https:\/\/peraltafinancing.com\/alabama\/marshall-asks-u-s-supreme-court-to-ok-religious-charter-schools\/"},"modified":"2025-03-18T12:30:19","modified_gmt":"2025-03-18T12:30:19","slug":"marshall-asks-u-s-supreme-court-to-ok-religious-charter-schools","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=141610","title":{"rendered":"Marshall asks U.S. Supreme Court to OK religious charter schools"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p style=\"font-weight: 400;\">Alabama Attorney General Steve Marshall joined a 12-state amicus brief sent to the U.S. Supreme Court endorsing the foundation of a religious charter school in Oklahoma.<\/p>\n<p style=\"font-weight: 400;\">The brief responds to an upcoming case the court is expected to hear beginning April 30 regarding the constitutionality of a proposed Catholic online charter school in Oklahoma.<\/p>\n<p style=\"font-weight: 400;\">The U.S. Supreme Court agreed in January to consolidate and hear arguments regarding Oklahoma Charter School Board v. Drummond, a <a href=\"https:\/\/apnews.com\/article\/catholic-public-religious-charter-school-oklahoma-drummond-d7f320f80427517ecfbedf54a4d07567\">lawsuit<\/a> filed in 2023, by Oklahoma Attorney General Gentner Drummond to block the approval of a proposed Catholic virtual charter school, and St. Isidore of Seville Catholic Virtual School v. Drummond, a counter-suit filed against Drummond by the school.<\/p>\n<p style=\"font-weight: 400;\">The school was proposed by the Archdiocese of Oklahoma City and the Diocese of Tulsa to provide free online Catholic K-12 education to Oklahoma residents.<\/p>\n<p style=\"font-weight: 400;\">If the court agrees to affirm St. Isidore\u2019s contract, the school would be the first public religious charter school in the U.S.<\/p>\n<p style=\"font-weight: 400;\">The Oklahoma Supreme Court <a href=\"https:\/\/oklahomavoice.com\/2024\/06\/25\/oklahoma-supreme-court-strikes-down-catholic-charter-school\/\">ruled<\/a> the school was unconstitutional and struck down its charter approval in June 2024.<\/p>\n<p style=\"font-weight: 400;\">\u201cReligious liberty is the cornerstone of our great nation, and our coalition will stand firm as a safeguard against governments that discriminate against religious institutions,\u201d Marshall <a href=\"https:\/\/www.alabamaag.gov\/alabama-attorney-general-marshall-joins-fight-for-religious-liberty-and-school-choice-at-u-s-supreme-court\/\">said<\/a>. \u201cWe will relentlessly fight to ensure that the highest court in the land upholds the right of schools to not be denied public benefits based on religion.\u201d\u00a0<\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Scroll to continue reading.<\/span><\/div>\n<\/div>\n<p style=\"font-weight: 400;\">Drummond, a fellow Republican state attorney general, on the other hand, has also argued his disapproval of the school was an attempt to stand up for religious freedom.<\/p>\n<p style=\"font-weight: 400;\">\u201cI will continue to vigorously defend the religious liberty of all four million Oklahomans. This unconstitutional\u00a0scheme to create the nation\u2019s first\u00a0state-sponsored religious charter school\u00a0will open the floodgates and force taxpayers to fund all manner of religious indoctrination, including radical Islam or even the Church of Satan,\u201d Drummond <a href=\"https:\/\/oklahoma.gov\/oag\/news\/newsroom\/2024\/october\/attorney-general-drummond-comments-on-st-isidore-filing.html\">said<\/a> in an October 2024 press release responding to St. Isidore\u2019s appeal to the U.S. Supreme Court.<\/p>\n<p style=\"font-weight: 400;\">The American Civil Liberty Union has similarly come out against St. Isidore on the issue.<\/p>\n<p style=\"font-weight: 400;\">\u201cThe law is clear: Charter schools are public schools and must be secular and open to all students. The Oklahoma Supreme Court correctly found that the state\u2019s approval of a religious public charter school was unlawful and unconstitutional,\u201d representatives from the organization <a href=\"https:\/\/www.aclu.org\/press-releases\/supreme-court-to-hear-oklahoma-case-involving-nations-first-religious-public-charter-school\">wrote<\/a> in a January statement regarding St. Isidore\u2019s appeal to the nation\u2019s highest court being granted. \u201cWe urge the U.S. Supreme Court to affirm that ruling and safeguard public education, church-state separation, and religious freedom for all.\u201d<\/p>\n<p style=\"font-weight: 400;\">The brief signed by Marshall argues religious charter schools align with the First Amendment\u2019s protections for religious liberty and are also not state actors under the First Amendment.<\/p>\n<p style=\"font-weight: 400;\">\u201cDoes a private religious entity become a state actor for First Amendment purposes when it contracts with the state to provide free educational opportunities to students who choose them?\u201d the brief reads. \u201cThis Court\u2019s precedents clearly indicate the answer is \u2018no.\u2019 Instead, religious charter schools promote religious freedom.\u201d<\/p>\n<p style=\"font-weight: 400;\">The brief also argues public charters are no more of a state entity than the \u201cmany private corporations whose business depends primarily on contracts to build roads, bridges, dams, ships, or submarines for the government.\u201d<\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Scroll to continue reading.<\/span><\/div>\n<\/div>\n<p style=\"font-weight: 400;\">Marshall\u2019s office said his stance on the case is, \u201cpart of Attorney General Marshall\u2019s broader commitment to protecting religious freedom and expanding educational opportunities.\u201d<\/p>\n<p style=\"font-weight: 400;\">\u201cThe outcome of this case could set a significant precedent for school choice and the role of religious institutions in education nationwide,\u201d they continue.<\/p>\n<p style=\"font-weight: 400;\">Marshall has previously weighed in on public charter school policy this year in Alabama, when he was amongst Republicans who publicly called into question the state\u2019s funding of The Magic City Acceptance Academy, a public charter in Birmingham focused on serving the needs of LGBTQ+ students.<\/p>\n<p style=\"font-weight: 400;\">\u201cI think the biggest leverage in these areas that we have is the power of the purse string,\u201d Marshall <a href=\"https:\/\/www.rightsidemedia.org\/rsr\/1-31-25\">said<\/a> during a January appearance on conservative talk radio show, Rightside Radio, continuing, \u201cThe legislature determines who gets funded, and how, and to the extent that you have an entity or organization that\u2019s subject to that law that\u2019s otherwise not complying with its parameters, then the legislature has the opportunity to be able to take that next step.\u201d<\/p>\n<p><!-- CONTENT END 1 -->\n\t\t\t<\/div>\n\n","protected":false},"excerpt":{"rendered":"<p>Alabama Attorney General Steve Marshall joined a 12-state amicus brief sent to the U.S. Supreme Court endorsing the foundation of a religious charter school in Oklahoma.
