Callais<\/em> and <em>Robinson v. Callais<\/em> will be heard by the Supreme Court next Monday. The court\u2019s decision on the combined case may have ramifications for the proper interpretation of the Voting Rights Act and the fate of Alabama\u2019s court-mandated district map.<\/p>\n<p>Louisiana, like Alabama, only had one Black majority Congressional district until a federal court <a href=\"https:\/\/lailluminator.com\/2022\/06\/06\/federal-court-rejects-louisiana-congressional-map\/\">ruled<\/a> the maps proposed by the state legislature following the 2020 census were racial gerrymanders. Following the Supreme Court\u2019s decision in <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/merrill-v-milligan-2\/\"><em>Allen v. Milligan<\/em><\/a>, the Louisiana legislature eventually adopted a new map with two Black majority districts.<\/p>\n<p>Piper Hutchinson <a href=\"https:\/\/lailluminator.com\/2024\/04\/30\/federal-court-tosses-landry-backed-louisiana-congressional-map\/\">reported<\/a> for the Louisiana Illuminator that the state legislature<span style=\"font-weight: 400\">\u2019<\/span>s second district map was primarily drawn in order to offer up Rep. Garret Graves, R-Louisiana, as a \u201csacrificial lamb\u201d while keeping the other Republicans in the state<span style=\"font-weight: 400\">\u2019s <\/span>Congressional delegation in safe seats.<\/p>\n<p>The 12 \u201cnon-African American voter[s]\u201d who filed <em>Louisiana v. Callais<\/em> allege in their complaint that by creating two Black majority districts, the Louisiana legislature \u201cengaged in textbook racial gerrymandering and violated the U.S. Constitution.\u201d<\/p>\n<p>In a 2-1 decision early last year, a district court sided with the plaintiffs, ruling that Louisiana<span style=\"font-weight: 400\">\u2019<\/span>s redistricting process violated the Equal Protections clause of the Fourteenth Amendment.<\/p>\n<p>Now before the Supreme Court, the consolidated case hinges on determining the proper interpretation of Section 2 of the Voting Rights Act of 1965. Ever since a key amendment was added in 1982, Section 2 has traditionally been viewed as broadly prohibiting vote dilution by requiring the creation of majority-minority districts.<\/p>\n<p>Anneshia Hardy, the executive director of Alabama Values, said during a press conference last Friday that this case and fights over proper districting<span style=\"font-weight: 400\"> are \u201cabout people power.\u201d<\/span><\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Scroll to continue reading.<\/span><\/div>\n<\/div>\n<p><span style=\"font-weight: 400\">\u201cHaving the right to vote is not not enough if that vote does not translate to real power,\u201d Hardy said. \u201cOne thing that we\u2019ve learned, that the Census data has shown us, is that our country is becoming more diverse in terms of race, ethnicity, culture, political ideology and yet what we are witnessing right now is an all-out attempt to concentrate power in the hands of a <\/span><span style=\"font-weight: 400\">few at the expense and subjugation of Black voters in Louisiana and in other states.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">The director of the Louisiana ACLU, Alana Odoms, forecast that if Section 2 is weakened, it \u201c<\/span>could create a cascade effect where once again, states around the nation would start being quite nefarious in the way that they are doing their redistricting processes.<span style=\"font-weight: 400\">\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">States could be \u201c<\/span>completely ignoring the census, completely ignoring population changes suggesting that the country is becoming blacker and browner, and continuing to try to maintain districts that largely elect candidates of choice for white voters,\u201d she explained.<\/p>\n<p>Unsurprisingly given Alabama\u2019s stance in <em>Allen v. Milligan<\/em> and other redistricting cases, Alabama Attorney General Steve Marshall has led a coalition of states arguing that if the Voting Rights Act still requires majority-minority districts, it likely violates the 15th Amendment.<\/p>\n<p>Marshall filed an <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-109\/323954\/20240903153656750_La.%20v.%20Callais.%20States%20Br.%20iso%20No%20Party%20-%20FINAL.pdf\">amicus brief<\/a> in September on behalf of Alabama and 12 other states. The brief criticizes the court system\u2019s \u201cendlessly malleable approach to [Section 2 of the Voting Rights Act of 1965]\u201d and complains it \u201ccannot justify race-based remedies and will demand race-based redistricting in perpetuity.\u201d<\/p>\n<p>\u201cEvidence that black Louisianans have less opportunity to participate in the political process is absent from the record, as the <em>Robinson<\/em> district court expressly acknowledged,\u201d one section of the brief claims. \u201cStill, the court held that \u00a72 requires Louisiana to sort voters by race. That betrays an atextual and standardless approach to \u00a72 that this Court should squarely reject in this appeal.\u201d<\/p>\n<p>Another part affirms that the states who filed the brief \u201csympathize with Louisiana, whose saga proves how impossible it has become, now almost sixty years after the passage of the Voting Rights Act, to comply simultaneously with our color-blind Constitution and increasingly expansive interpretations of Section 2.\u201d<\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Milligan<\/em>, the Supreme Court considered and rejected a similar argument that Section 2 of the VRA violated the 15th Amendment by referring to the court\u2019s past decisions. \u201cIn light of that precedent, including <em>City of Rome<\/em>, we are not persuaded by Alabama\u2019s arguments that \u00a72 as interpreted in <em>Gingles <\/em>exceeds the remedial authority of Congress,\u201d Chief Justice John Roberts wrote in the majority opinion.<\/p>\n<p>After oral arguments are heard next week, it will likely be several months until the court\u2019s decision is released before the end of the session in late June.<\/p>\n<p><!-- CONTENT END 1 -->\n\t\t\t<\/div>\n\n","protected":false},"excerpt":{"rendered":"<p>Oral arguments in Louisiana v.
