{"id":133474,"date":"2025-03-14T18:25:03","date_gmt":"2025-03-14T18:25:03","guid":{"rendered":"https:\/\/peraltafinancing.com\/business\/legal\/judicial-misquotation-examining-the-error-in-tem-combustion-sdn-bhd-v-latex-form-sdn-bhd-2023-mlju-3074\/"},"modified":"2025-03-14T18:25:03","modified_gmt":"2025-03-14T18:25:03","slug":"judicial-misquotation-examining-the-error-in-tem-combustion-sdn-bhd-v-latex-form-sdn-bhd-2023-mlju-3074","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=133474","title":{"rendered":"Judicial Misquotation: Examining the Error in TEM Combustion Sdn Bhd v Latex Form Sdn Bhd [2023] MLJU 3074"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>In <em>TEM Combustion Sdn Bhd lwn Latex Form Sdn Bhd<\/em> [2023] MLJU 3074 (\u201c<strong>TEM Combustion<\/strong>\u201d), the learned High Court judge referred to the Court of Appeal\u2019s decision in <em>Paradise Boulevard Sdn Bhd v Badan Pengurusan Bersama Kompleks Pandan Safari Lagoon<\/em> [2021] MLJU 2889 (\u201c<strong>Paradise Boulevard<\/strong>\u201d):<\/p>\n<p style=\"padding-left: 40px;\">\u201c[21]\u00a0 Mahkamah ini mendapati dari mula barangan dihantar serah kepada Defendan, tiada sebarang aduan dikemukakan dan segala kecacatan yang ditimbulkan oleh Defendan mengenai barangan Plaintif hanyalah selepas tindakan ini difailkan. <strong><u>Inilah yang diperkatakan oleh Mahkamah Rayuan didalam kes <em>Paradise Boulevard Sdn Bhd v Badan Pengurusan Bersama Kompleks Pandan Safari Lagoon<\/em> [2021] MLJU 2889<\/u><\/strong>: \u2013<\/p>\n<p style=\"padding-left: 80px;\">\u201c[37] When viewed in totality, the averments and arguments raised by the first defendant are considerably inflicted by various shortcomings that do little, if at all to advance its resistance to this summary judgment application. The defendant also did not dispute the invoices sent by the Plaintiff and only raised its complaints after the writ in the main action was filed. This also suggests the issue raised by the defendant contesting this summary judgment are an afterthought\u201d.<a href=\"#_ftn1\" name=\"_ftnref1\"><sup>[1]<\/sup><\/a> (Emphasis mine)<\/p>\n<p style=\"padding-left: 80px;\">[The extract from Paradise Boulevard which was cited in paragraph 21 of TEM Combustion is referred to as the \u201c<strong>Impugned Paragraph<\/strong>\u201d].<\/p>\n<p>In Paradise Boulevard, the Impugned Paragraph was the Court of Appeal\u2019s summary of the High Court\u2019s decision:<\/p>\n<p style=\"padding-left: 40px;\">\u201c[15]\u00a0 The issues that were raised by the Defendant in opposing the Plaintiff\u2019s application for summary judgment (Enclosure 14) were dealt with by the Judge under the heading \u2013 <strong>\u201cEvaluation and Finding of this Court\u201d<\/strong> and they read (with emphasis added) as follows:<\/p>\n<p style=\"padding-left: 80px;\">\u2026<\/p>\n<p style=\"padding-left: 80px;\">[37] When viewed in totality, the averments and arguments raised by the first defendant are considerably inflicted by various shortcomings that do little, if at all, to advance its resistance to this summary judgment application.
