{"id":117300,"date":"2025-03-07T07:29:57","date_gmt":"2025-03-07T07:29:57","guid":{"rendered":"https:\/\/peraltafinancing.com\/business\/insurance\/new-york-commercial-division-clarifies-how-claims-will-be-valued\/"},"modified":"2025-03-07T07:29:57","modified_gmt":"2025-03-07T07:29:57","slug":"new-york-commercial-division-clarifies-how-claims-will-be-valued","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=117300","title":{"rendered":"New York Commercial Division Clarifies How Claims Will Be Valued"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div itemprop=\"description articleBody\">\n<p>The New York Commercial Division, the specialized arm of the New York State Supreme Court composed of justices experienced in handling complex civil matters, recently amended its rules to clarify how actions seeking equitable or declaratory relief will be valued for purposes of meeting the Commercial Division\u2019s monetary thresholds. <em>See <\/em>AO\/038\/25 (Jan. 28, 2025).<\/p>\n<p>In order to qualify for assignment to the Commercial Division, the relief sought in an action must exceed a certain monetary value, which varies from county to county. In New York County, for example, actions must meet the monetary threshold of $500,000. NYCRR 202.70(a).<\/p>\n<p>The rule change clarifies how actions seeking equitable or declaratory relief are valued. Going forward, whether such actions meet the Commercial Division\u2019s monetary threshold will be measured by the \u201cvalue of the object of the action,\u201d defined as \u201cthe value of the suit\u2019s intended benefit, the value of the right being protected, or the value of the injury being averted, whichever is greatest.\u201d NYCRR 202.70(b).
