The network <a href=\"https:\/\/apnews.com\/article\/fox-news-dominion-lawsuit-trial-trump-2020-0ac71f75acfacc52ea80b3e747fb0afe\" target=\"_blank\" aria-label=\"Link opens in new window (had to pay)\">had to pay<\/a> $787 million to settle a defamation case brought by Dominion Voting Systems, which claimed that Fox had slandered the firm by promoting the false theory that its voting machine technology helped deliver an illegitimate victory to former President Joe Biden in the 2020 election. The evidence that came out about Fox deliberately spreading lies served as rocket fuel for a challenge to renew one of its television licenses.<\/p>\n<p>In the fall of 2023, a <a href=\"https:\/\/progressive.org\/latest\/fox-faces-scrutiny-from-the-fcc-daigon-230907\/\">petition<\/a> filed by the <a href=\"https:\/\/www.mediaanddemocracyproject.org\/\" target=\"_blank\" aria-label=\"Link opens in new window (Media and Democracy Project)\">Media and Democracy Project<\/a> (MAD) called on the Federal Communications Commission (FCC) to hold evidentiary hearings on whether to renew the TV broadcast license of Fox\u2019s Philadelphia TV-station affiliate, WTXF. The <a href=\"https:\/\/www.editorandpublisher.com\/stories\/media-and-democracy-project-urges-fcc-to-establish-a-bright-line-test-with-hearing-on-fox,253037\" target=\"_blank\" aria-label=\"Link opens in new window (petition&#x2019;s signatories)\">petition\u2019s signatories<\/a> included ex-Fox executive Preston Padden; Alfred Sikes, former Republican FCC chairman; Democrat Ervin Duggan, former FCC commissioner; and Bill Kristol, editor of <em>The Weekly Standard<\/em>.<\/p>\n<p>MAD wanted to present to the FCC evidence that the network repeatedly and knowingly lied by suggesting that the 2020 presidential election was stolen, violating the FCC character standard that TV license holders may not repeatedly lie to the public, as well as the requirement that they serve the public interest.<\/p>\n<p>Had MAD\u2019s petition been successful, and the FCC initially ruled in favor of blocking the renewal of WTXF\u2019s license, that victory might have served\u00a0 as a template by which MAD and other groups could attempt to block the renewal of Fox\u2019s <a href=\"https:\/\/prospect.org\/blogs-and-newsletters\/tap\/2023-08-28-will-fox-lose-its-broadcast-license\/\" target=\"_blank\" aria-label=\"Link opens in new window (twenty-eight other)\">twenty-eight other<\/a> TV licenses.<\/p>\n<p>But a combination of shifting political winds and reticence among FCC members to challenge Fox have worked to undermine MAD\u2019s efforts. Despite the initial setbacks, MAD is determined to press on with its challenge to Fox.<\/p>\n<p>That challenge received a sharp setback in January, when outgoing Democratic FCC Chairwoman Jessica Rosenworcel <a href=\"https:\/\/rbr.com\/to-preserve-first-amendment-rosenworcel-oks-wtxf-license-renewal\/\" target=\"_blank\" aria-label=\"Link opens in new window (approved)\">approved<\/a> the license renewal of WTXF. Rosenworcel argued that denying the renewal would be a violation of Fox\u2019s First Amendment rights to free speech, lumping it together with three other actions brought by the conservative <a href=\"https:\/\/www.americanrights.org\/\" target=\"_blank\" aria-label=\"Link opens in new window (Center for American Rights)\">Center for American Rights<\/a> (CAR).<\/p>\n<p>CAR <a href=\"https:\/\/www.voanews.com\/a\/us-communications-agency-reinstates-complaints-starts-investigating-media\/7964421.html\" target=\"_blank\" aria-label=\"Link opens in new window (brought)\">brought<\/a> three complaints against ABC, CBS, and NBC for supposed bias against President Trump. Rosenworcel also tossed those cases on the grounds they violated the First Amendment rights of those three networks.<\/p>\n<p>But since the election of Trump, who has expressed the desire to revoke the licenses of media outlets he feels have treated him unfairly, the political climate has radically changed. Rosenworcel has been replaced as FCC Chair by strong Trump-backer <a href=\"https:\/\/broadbandbreakfast.com\/new-year-new-fcc-chair\/\" target=\"_blank\" aria-label=\"Link opens in new window (Brendan Carr)\">Brendan Carr<\/a>, who <a href=\"https:\/\/www.cnn.com\/2024\/11\/18\/media\/brendan-carr-trump-fcc-nominee-project-2025\/index.html\" target=\"_blank\" aria-label=\"Link opens in new window (contributed a chapter)\">contributed a chapter<\/a> about the FCC to the Heritage Foundation\u2019s Project 2025 policy blueprint.<\/p>\n<p>Calls by Trump and others on the right to <a href=\"https:\/\/www.cnn.com\/2024\/10\/22\/media\/trump-strip-tv-station-licenses-punish-media\/index.html\" target=\"_blank\" aria-label=\"Link opens in new window (challenge media license renewals)\">challenge media license renewals<\/a> have shifted momentum and placed potential supporters of the MAD petition in an awkward position. Many do not feel comfortable publicly opposing Trump\u2019s threats to punish media outlets by revoking their licenses while simultaneously supporting efforts by MAD to revoke a Fox affiliate\u2019s TV license.<\/p>\n<p>When asked about this by <em>The Progressive<\/em>, Preston Padden, a former senior <a href=\"https:\/\/www.washingtonpost.com\/media\/2023\/08\/09\/preston-padden-murdoch-fox-news-fcc\/\" target=\"_blank\" aria-label=\"Link opens in new window (executive)\">executive<\/a> with the Fox Broadcasting Company from 1990 to 1997 and a prominent spokesperson for the MAD petition, was unequivocal.<\/p>\n<p>\u201cOver the last sixteen months, I made trips to Washington, D.C., to try to get [Democratic lawmakers] to support our petition,\u201d Padden tells <em>The Progressive.<\/em> \u201cTo a person, the Democrats told me they were afraid of setting a precedent that Trump would be able to use.\u201d<\/p>\n<p>Nor did outgoing FCC Chair Rosenworcel escape criticism for her decision to renew WTXF\u2019s license on the grounds that denying it would have violated their First Amendment rights.<\/p>\n<p>\u201cThis petition was sitting for 550 days,\u201d says Gigi Sohn, a\u00a0<a href=\"https:\/\/www.eff.org\/about\/staff\/gigi-sohn\" target=\"_blank\" aria-label=\"Link opens in new window (former FCC lawyer)\">former FCC lawyer<\/a>\u00a0who withdrew her nomination for FCC commissioner in 2023 after months of deadlock and attacks by the telecoms industry. Sohn\u00a0now serves as Benton Senior Fellow &amp; Public Advocate at <a href=\"https:\/\/www.benton.org\/about-benton\" target=\"_blank\" aria-label=\"Link opens in new window (The Benton Institute for Broadband &amp; Society)\">The Benton Institute for Broadband &amp; Society<\/a>,\u00a0a nonprofit dedicated to establishing high-performance, affordable\u00a0broadband for all.<\/p>\n<p>\u201cShe did not want to decide,\u201d Sohn continues.\u00a0\u201cThe FCC has a duty to license broadcasters in the public interest. Renewal is not supposed to be automatic. The FCC has a duty to review the character and content of a broadcaster\u2019s license.\u201d<\/p>\n<hr\/>\n<p>The MAD petition cites the Dominion case as well as two others\u2014a Delaware Chancery case in which company shareholders <a href=\"https:\/\/www.reuters.com\/legal\/legalindustry\/column-fox-shareholder-case-against-board-lead-plaintiffs-fault-networks-2024-01-02\/\" target=\"_blank\" aria-label=\"Link opens in new window (sued)\">sued<\/a> owner Rupert Murdoch for mismanagement, and a Nevada suit in which Murdoch\u2019s <a href=\"https:\/\/www.nytimes.com\/2024\/12\/09\/business\/media\/rupert-lachlan-murdoch-family-trust.html\" target=\"_blank\" aria-label=\"Link opens in new window (lack of integrity)\">lack of integrity<\/a> was highlighted by a judge in an inheritance case\u2014as additional proof that Fox\u2019s top management failed to meet the FCC\u2019s character standards. Brian Hansbury, a co-founder of MAD, tells <em>The Progressive <\/em>that the organization\u2019s petition \u201crests on the FCC\u2019s character clause.\u201d<\/p>\n<p>On February 19, MAD announced it was <a href=\"https:\/\/newsdirect.com\/news\/media-and-democracy-project-appeals-dismissal-of-fox-broadcast-license-challenge-735601053\" target=\"_blank\" aria-label=\"Link opens in new window (appealing)\">appealing<\/a> the initial decision by Rosenworcel to the full FCC. While supporters concede the full Commission is unlikely to overturn Rosenworcel\u2019s dismissal, and even though there have been many conservative-leaning judges appointed during Trump\u2019s first term, supporters don\u2019t feel the outcome is necessarily cut and dried.<\/p>\n<p>\u201cThe case would be going to the D.C. Court of Appeals, which is split right now between Democrats and Republicans,\u201d says Sohn. \u201cIt is a long shot, but sometimes a long shot hits.\u201d<\/p>\n<p>Other supporters were more confident.<\/p>\n<p>\u201cOur case is a slam dunk,\u201d says Padden. \u201cWe have a court [in the Dominion case] that got access to a treasure trove of internal Fox emails . . . . Our petition was based on a 120-page judicial decision, backed up by voluminous evidence, that Fox repeatedly and knowingly presented false news.\u201d<\/p>\n<p>But in an ominous development of what might be in store for media outlets, Carr <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/jan\/22\/fcc-reinstates-complaints-abc-cbs-nbc\" target=\"_blank\" aria-label=\"Link opens in new window (reinstated)\">reinstated<\/a> the three complaints brought by CAR against ABC, CBS, and NBC in January, while letting the decision against MAD and in favor of Fox stand.<\/p>\n<p>CAR is now suing all three networks: Its suit against CBS claims that the network employed <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/jan\/22\/fcc-reinstates-complaints-abc-cbs-nbc\" target=\"_blank\" aria-label=\"Link opens in new window (biased editing)\">biased editing<\/a> on an interview with former Vice President Kamala Harris, while its suits against ABC and NBC allege anti-Trump bias during the nationally televised <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/jan\/22\/fcc-reinstates-complaints-abc-cbs-nbc\" target=\"_blank\" aria-label=\"Link opens in new window (presidential debate)\">presidential debate<\/a> and an <a href=\"https:\/\/www.pbs.org\/standards\/media-law-101\/candidate-appearances\/\" target=\"_blank\" aria-label=\"Link opens in new window (equal time rule)\">equal time rule<\/a> violation due to <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/jan\/22\/fcc-reinstates-complaints-abc-cbs-nbc\" target=\"_blank\" aria-label=\"Link opens in new window (Harris&#x2019;s appearance)\">Harris\u2019s appearance<\/a> on <em>Saturday Night Live, <\/em>respectively. \u201cWhen it comes to the Center for American Rights\u2019 challenges, they absolutely do seek to weaponize the licensing of the FCC in a way that is absolutely at odds with the First Amendment,\u201d says Hansbury, who claims that these suits were filed to extort better coverage and money from media outlets seen as hostile to Trump.<\/p>\n<p>\u201cCBS, Paramount have a <a href=\"https:\/\/www.mediaite.com\/tv\/cnns-jake-tapper-explains-why-every-american-should-care-about-cbs-settling-dangerous-trump-lawsuit-even-maga\/\" target=\"_blank\" aria-label=\"Link opens in new window (major merger deal)\">major merger deal<\/a>,\u201d he says. \u201cIt [legal actions by Trump and the right] is almost akin to [saying], \u2018Hey, that\u2019s a nice merger deal\u2014it would be a shame if something happened to it.\u2019 \u201d\u00a0<\/p>\n<p>Hansbury is referring to a potentially lucrative <a href=\"https:\/\/www.mediaite.com\/tv\/cnns-jake-tapper-explains-why-every-american-should-care-about-cbs-settling-dangerous-trump-lawsuit-even-maga\/\" target=\"_blank\" aria-label=\"Link opens in new window (proposed merger)\">proposed merger<\/a> between CBS parent company Paramount Global and Skydance Media, which will seek approval from an FCC that will soon have a Republican majority. Critics maintain that Paramount is trying to settle Trump\u2019s lawsuit, which is <a href=\"https:\/\/variety.com\/2025\/tv\/news\/paramount-trump-cbs-settlement-shari-redstone-experts-1236307036\/\" target=\"_blank\" aria-label=\"Link opens in new window (widely viewed)\">widely viewed<\/a> as frivolous, against him in order to curry favor and make FCC approval more likely.<\/p>\n<p>As one anonymous CBS correspondent <a href=\"http:\/\/v\" target=\"_blank\" aria-label=\"Link opens in new window (reportedly told)\">reportedly told<\/a> CNN, \u201cTrump\u2019s lawsuit was a joke, but if we settle, we become the laughingstock.\u201d\u00a0<\/p>\n<p>Carr\u2019s conservative agenda goes beyond reinstating the cases brought by CAR. At the end of January, he <a href=\"https:\/\/www.npr.org\/2025\/01\/30\/nx-s1-5281162\/fcc-npr-pbs-investigation\" target=\"_blank\" aria-label=\"Link opens in new window (announced)\">announced<\/a> he was opening up an investigation against National Public Radio (NPR) and PBS, with the stated goal of defunding them\u2014a move that is specifically <a href=\"https:\/\/www.cbsnews.com\/news\/trump-project-2025-playbook\/\" target=\"_blank\" aria-label=\"Link opens in new window (proposed)\">proposed<\/a> in chapter eight of Project 2025. Carr\u2019s efforts have been <a href=\"https:\/\/www.lee.senate.gov\/2025\/2\/lee-introduces-bill-to-cut-american-tax-dollars-from-funding-npr-and-pbs\" target=\"_blank\" aria-label=\"Link opens in new window (celebrated)\">celebrated<\/a> by like-minded Republicans in Congress.<\/p>\n<p>While the shift in climate has complicated MAD\u2019s case against Fox, the network isn\u2019t out of the woods. Last month, an appellate court in New York State <a href=\"https:\/\/www.npr.org\/2025\/01\/10\/nx-s1-5256432\/smartmatic-fox-news-trial-defamation-election-2020-trump\" target=\"_blank\" aria-label=\"Link opens in new window (gave the green light)\">gave the green light<\/a> to a $2.7 billion suit against Fox by <a href=\"https:\/\/www.smartmatic.com\/us\/\" target=\"_blank\" aria-label=\"Link opens in new window (Smartmatic)\">Smartmatic<\/a>, a company that builds and implements electronic voting systems. Smartmatic\u2019s suit includes similar allegations to those made by Dominion, highlighting potentially defamatory claims made on Fox about the 2020 election having supposedly been stolen. Should Fox lose in this case, the outcome could add fuel for more license renewal challenges.<\/p>\n<p>Even if MAD\u2019s petition falls short, Hansbury asserts that the effort has already had a positive impact by raising public awareness and serving as a potential model for other civic groups. But the political momentum for media reform has shifted over the last year, as high-profile efforts by Trump and his rightwing allies to punish media outlets they view as adversarial have undercut the initial momentum of MAD\u2019s efforts to make media conglomerates more accountable to the public.<\/p>\n<p>\u201cThe very first duty, when Congress passed the 1934 Communications Act,\u201d states Sohn, \u201csaid that the FCC licenses the public airwaves\u2014and they belong to the public; they don\u2019t belong to Fox, they don\u2019t belong to CBS, they don\u2019t belong to Sinclair\u2014in the public interest.\u201d<\/p>\n<\/p><\/div>\n\n","protected":false},"excerpt":{"rendered":"<p>In 2023, Fox News looked like it was on the ropes.
