Too often, in jury debriefings and in focus groups, jurors
\ncomplain that the attorneys do not connect their points or evidence to the
\nspecifics of the complaint. Furthermore, attorneys rarely fully explain the
\njury instructions to the jury, tying in those instructions to the attorney\u2019s
\ninterpretation of the case.<\/p>\n

In a classic case, namely the Blagojevich trial, the jury
\nforeman brought up this very dilemma, saying of the U.S. attorneys: \u201cThey
\ndidn\u2019t impress upon the jury the importance of the different counts and how
\nthey related to the six schemes that Rod Blagojevich was charged with. And as a
\nconsequence when we went into the deliberation room we were very confused. We
\ndidn\u2019t know how to start\u2026.it was days before we found the indictment. We didn\u2019t
\neven know that the indictment was in the evidence carts.\u00a0 Once we found
\nthat we were elated.\u201d (Chicago Tonight TV show)<\/p>\n

This lack of clarity leaves jurors in distress. They are
\nconfused, perturbed, and unable to think in a reasonable manner about the case.<\/p>\n

Be good to your jurors. Always make the connection for them,
\nin obvious, preferably visual ways, between the evidence and testimony, and the
\ncomplaint\/cross-complaint. Do the same with the jury instructions.<\/p>\n

Experience shows time and again, that the attorney who
\npresents their case the most clearly, all else being roughly equal, is the most
