{"id":104448,"date":"2025-02-23T02:53:09","date_gmt":"2025-02-23T02:53:09","guid":{"rendered":"https:\/\/peraltafinancing.com\/activist\/crypto-industry-asks-congress-to-scrap-irss-defi-broker-rule\/"},"modified":"2025-02-23T02:53:09","modified_gmt":"2025-02-23T02:53:09","slug":"crypto-industry-asks-congress-to-scrap-irss-defi-broker-rule","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=104448","title":{"rendered":"Crypto Industry Asks Congress to Scrap IRS&#8217;s DeFi Broker Rule"},"content":{"rendered":" \r\n<br><div>\n\n                                        \n\n\n<p><strong><em>In what may be a big test of the crypto sector\u2019s new influence over a markedly friendlier U.S. Congress, the Crypto Industry is asking for the reversal of an incoming tax policy.<\/em><\/strong><\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-what-to-know\">What to know:<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Blockchain Association marshalled 75 crypto signatories to a letter calling for Congress to repeal the IRS\u2019s decentralized financial broker rule from December.<\/li>\n\n\n\n<li>Republican Senator Ted Cruz has pushed a resolution to activate a congressional power that would allow lawmakers to erase the federal regulation.<\/li>\n<\/ul>\n\n\n\n<p>Nearly every big name in the crypto industry has signed onto a letter calling for Congress to\u00a0<a target=\"_blank\" href=\"https:\/\/theblockchainassociation.org\/wp-content\/uploads\/2025\/02\/Blockchain-Association-Letter-to-Congress-on-DeFi-Broker-Rule-CRA-Vote.pdf\" rel=\"noreferrer noopener\">eliminate a U.S. tax policy<\/a>\u00a0they say could jeopardize decentralized finance (DeFi) technology by shoehorning much of that space into the field of brokers subject to data collecting and reporting.<\/p>\n\n\n\n<p>The Internal Revenue Service \u2014 the U.S. Treasury Department\u2019s tax arm \u2014 pushed through a key\u00a0<a target=\"_blank\" href=\"https:\/\/home.treasury.gov\/news\/press-releases\/jy2762\" rel=\"noreferrer noopener\">digital assets broker rule<\/a>\u00a0between Christmas and New Year\u2019s, just days before President Donald Trump\u2019s administration was set to arrive. It was meant to institute similar information-reporting demands on DeFi brokers as would be faced by securities brokers and exchanges.<\/p><div class=\"g g-1\"><div class=\"g-single a-5\"><a class=\"gofollow\" data-track=\"NSwxLDEsNjA=\" href=\"https:\/\/brainsupreme.co\/MACRO15\" target=\"_blank\"><img loading=\"lazy\" width=\"850\" height=\"500\" decoding=\"async\" src=\"https:\/\/www.activistpost.com\/wp-content\/uploads\/2025\/01\/AP-AffiliateAd-850x500-BrainSupreme-1.jpg\"\/><\/a><\/div><\/div>\n\n\n\n<p>Recently approved rules can be erased under the Congressional Review Act, and Senator Ted Cruz, the Texas Republican,\u00a0<a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/senate-joint-resolution\/3?amp%3Br=33&amp;%3Bs=4&amp;q=%7B%22search%22%3A%22cruz%22%7D\" target=\"_blank\" rel=\"noreferrer noopener\">introduced a resolution<\/a>\u00a0last week that would do just that. The unified industry letter on Wednesday \u2014 led by the Blockchain Association and joined by Coinbase, a16z, Paradigm, Kraken, Uniswap, Anchorage Digital and dozens of others \u2014 asks the rest of Congress to embrace Cruz\u2019s measure.<\/p>\n\n\n\n<p>\u201cThe DeFi broker rule, finalized in the waning days of the Biden administration, represents regulatory overreach that fundamentally misunderstands the technology it attempts to regulate and ignores Congress\u2019s intent,\u201d according to the letter, sent to the leadership in both chambers of Congress. Using Congress\u2019s power to reverse federal agency regulations offers \u201ca clear and definitive path to rolling back this damaging rule before it can take effect.\u201d<\/p>\n\n\n\n<p>The businesses collectively argued that the rule unfairly targets U.S. firms with rules that foreign competitors wouldn\u2019t have to follow when servicing U.S. customers.<\/p>\n\n\n\n<p>\u201cThis unique burden on American companies alone could cripple DeFi innovation in this country altogether,\u201d they said.<\/p>\n\n\n\n<p>The CRA can be a powerful but sometimes blunt tool that spiked in popularity during President Donald Trump\u2019s first term. Where it\u2019s blunt is in its secondary effect: Any regulatory topic reversed in this way can never be reintroduced in any similar fashion, potentially making it difficult to apply friendlier regulations in the same area.<\/p>\n\n\n\n<p>When Congress sought to use it to repeal the Securities and Exchange Commission\u2019s crypto accounting policy, Staff Accounting Bulletin No. 121, the minority who opposed the effort argued that it would hamstring future SEC efforts to address digital assets accounting. While both chambers did approve that CRA effort,\u00a0<a href=\"https:\/\/www.coindesk.com\/policy\/2024\/05\/31\/us-president-biden-vetoes-resolution-overturning-sec-guidance\" target=\"_blank\" rel=\"noreferrer noopener\">then-President Joe Biden vetoed the attempt<\/a>, leaving Trump\u2019s interim SEC chief, Mark Uyeda, to move recently to get the\u00a0<a href=\"https:\/\/www.coindesk.com\/policy\/2025\/01\/23\/sec-withdraws-controversial-crypto-tax-accounting-bulletin\" target=\"_blank\" rel=\"noreferrer noopener\">same thing accomplished<\/a>\u00a0internally.<\/p>\n\n\n\n<p>A CRA resolution needs majority approval in both Chambers of Congress before it can be sent to President Trump for a potential sign-off. After the 2024 elections, many more pro-crypto lawmakers are walking the halls on Capitol Hill, though congressional attention is a hot commodity, and other pressing matters such as the federal budget are looming.<\/p>\n\n\n\n<p>Beyond the letter, other crypto organizations are also weighing in.
