The provision of \u2018forfeiture of gratuity\u2019 does not speak of a conviction in a criminal proceeding. Only requirement is for Disciplinary Authority or Appointing Authority to decide as to whether, the <a href=\"https:\/\/rudrajyotinathray.com\/2017\/04\/08\/misconduct\/\">\u2018misconduct\u2019<\/a> could, in normal circumstances, constitute an offence involving \u2018moral turpitude\u2019. A further discretion is conferred to decide whether, \u2018forfeiture should be of whole or only a part of gratuity payable\u2019, which would depend on gravity of the \u2018misconduct\u2019.<\/p>\n<p class=\"has-text-align-justify\">The appointment itself being illegal, there is no question of terminated employee seeking fruits of his employment by way of gratuity.\u00a0<\/p>\n<p class=\"has-text-align-justify\">\u2013 <strong>Hon\u2019ble Justice K.
