Jim Hill introduces Speedy Trial Act in attempt to fix court backlogs"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>Earlier this week, Representative Jim Hill, R-Moody, introduced HB307, or the Speedy Trial Act. A retired judge, chair of the House Judiciary Committee, and <a href=\"https:\/\/www.alreporter.com\/2023\/02\/08\/rep-jim-hill-talks-prison-reforms-for-upcoming-session\/\">frequent proponent<\/a> of reforms to the state\u2019s criminal justice system, Hill says the bill is meant to fix backlogs that have begun building up in the state\u2019s courts following the COVID-19 pandemic.<\/p>\n<p>On Feb. 11, Birmingham mayor Randall Woodfin <a href=\"https:\/\/www.wbrc.com\/2025\/02\/13\/jefferson-co-faces-3-year-backlog-murder-trials-city-leaders-push-solutions\/\">told<\/a> the Birmingham city council that it\u2019s taking as long as three years for a murder trial to begin in Jefferson County and \u201cwithout help from the state, \u2026 we won\u2019t see that backlog decrease anytime soon.\u201d And in a January article for <a href=\"https:\/\/stateline.org\/2024\/01\/25\/shortage-of-prosecutors-judges-leads-to-widespread-court-backlogs\/\">Stateline<\/a>, Amanda Hern\u00e1ndez reported that court backlogs are quickly becoming a big problem in states across the country.<\/p>\n<p>\u201cWe have certain circuits in this county and the state that are soon to have a backlog of criminal cases,\u201d Rep. Hill told APR on Thursday. \u201cThose criminal cases need to be tried quickly. There\u2019s constitutional issues about not trying criminal cases in a speedy manner.\u201d Under the Sixth Amendment to the U.S. Constitution, anyone charged with a crime has \u201cthe right to a speedy and public trial.\u201d<\/p>\n<p>As drafted, HB307 would let the Chief Justice of Alabama decide to appoint \u201cvisiting judges\u201d when the state attorney general or a district attorney requests it. These visiting judges would be selected from amongst either sitting or retired circuit court judges and then be appointed to a specific circuit in order to serve as a judge for \u201ca specific case or cases arising from one or more violent crimes.\u201d<\/p>\n<p>Hill explained that as a result of Alabama\u2019s sentencing guidelines, people charged with nonviolent crimes typically plea out, rendering nonviolent crimes less of a factor in court backlogs. <span style=\"font-weight: 400\">\u201cAs a general rule, the cases that end up having <\/span><span style=\"font-weight: 400\">to be tried are Class A felonies and those are primarily your violent crimes: manslaughter, murder, rape, drug trafficking,\u201d he said. \u201cThose types of crimes are often the ones that absolutely did not fall under the sentencing guidelines.\u201d<\/span><\/p>\n<p>Alabama Attorney General Steve Marshall released a statement on Wednesday praising HB307 and another piece of legislation by Sen. Will Barfoot, R-Pike Road. \u201cSpeedy trials are a constitutional guarantee for a defendant but no one deserves swift justice more than a crime victim,\u201d Marshall wrote. \u201cWhen violent criminals remain in our communities due to prolonged trial delays, the risk of reoffending rises.\u201d<\/p>\n<p>The bill\u2019s reception amongst Alabama\u2019s criminal justice professionals hasn\u2019t been universally positive though. Circuit court judge, David Carpenter, posted on Facebook that HB307 \u201cis a good idea, but it\u2019s not enough to have retired judges hear cases.\u201d Legislators need to \u201camend the Bill to provide funding for staff,\u201d Carpenter said, arguing that visiting judges would require staff and that could take away resources for sitting judges, reducing the proposal\u2019s efficacy.<\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Scroll to continue reading.<\/span><\/div>\n<\/div>\n<p>In Hill\u2019s interview with APR, he said it \u201cmay well take some additional staff,\u201d but he doesn\u2019t \u201csee it as an insurmountable issue at all.\u201d Focusing mainly on court reporters, he said that the Alabama court system already has roving court reporters that could help address visiting judges\u2019 needs and that there are independent agencies the state could hire.<\/p>\n<p>Visiting judges\u2019 needs for court reporters are also addressed specifically in HB307. The bill states that sitting judges appointed by the Chief Justice to serve as a visiting judge could make use of their official court reporter, and otherwise a visiting judge could request a special roving reporter or special reporter. If all the previous options are unavailable, the bill would allow the Attorney General and district attorneys to hire a court reporter for visiting judges.\u00a0<\/p>\n<p>This session Hill has also introduced another bill, <a href=\"https:\/\/legiscan.com\/AL\/bill\/HB43\/2025\">HB43<\/a>, that would expand judges\u2019 ability to issue \u201csplit sentences.\u201d Judges in Alabama are currently able to split sentences for Class A or B felonies between jail or prison time and probation, within specific limits. HB43 would grant judges more discretion by allowing them to issue split sentences for sentences of up to 30 years and has already passed the state House.<\/p>\n<p>In 2024, he introduced and sponsored an <a href=\"https:\/\/www.alreporter.com\/2024\/05\/07\/will-the-legislature-address-prison-overcrowding-before-sessions-end\/\">almost identical piece of legislation<\/a> which also passed the House but then failed to see a vote in the Senate before the session ended, despite Hill\u2019s conviction at the time that the bill would have passed if it got to the Senate floor.<\/p>\n<p>Rep. Hill is still optimistic about his split sentencing bill finally becoming law this session. \u201cI hope it will [pass],\u201d he said. \u201cI think it will, I hope it will. I believe it\u2019s a step in the right direction.\u201d<\/p>\n<p>HB307 is currently awaiting the approval of the House Judiciary Committee.
