Window View with Sunlight.<\/p>\n<\/p><\/div>\n<p>\n\t\t\t\tAirlines for America and five U.S. airlines are asking an appellate court to \u201chold unlawful and set aside\u201d the rules for wheelchair handling put in place at the end of 2024.\t\t\t\t<\/p>\n<p>\n\t\t\t\tThe airlines are looking to strike down another commercial aviation rule that was set during the Biden administration.\t\t\t\t<\/p>\n<p>\u00a0<\/p>\n<p>In a petition to the Fifth Circuit U.S. Court of Appeals, Airlines for America, American Airlines, Delta Air Lines, JetBlue, Southwest Airlines, and United Airlines are asking a court to rule the federal regulation \u201cEnsuring Safe Accommodations for Air Travelers with Disabilities Using Wheelchairs\u201d as unlawful.<\/p>\n<p>\u00a0<\/p>\n<h2><strong>Airlines Claim Transportation Department Acted Outside of Authority<\/strong><\/h2>\n<p>The final ruling which created the current rules for handling wheelchairs <a href=\"https:\/\/www.flyertalk.com\/articles\/dot-hands-down-final-rule-for-wheelchair-handling-effective-2025.html\">went into effect on December 16, 2024<\/a>, as one of the final acts of the Biden administration under Transportation Secretary Pete Buttigieg. The federal regulation required airlines to offer \u201cassistance provided in a manner that respects a passenger\u2019s independence, autonomy, and privacy,\u201d while creating new rights for those who have a mobility device mishandled or damaged while in the possession of the airline.<\/p>\n<p>\u00a0<\/p>\n<p>However, Airlines for America and the carriers believe that the law was implemented unlawfully. In their two-page brief to the Court of Appeals, the group claims that \u201cprovisions of the Rule exceed DOT\u2019s statutory authority and the Rule violates the Administrative Procedure Act.\u201d Specifically, their complaint alleges that the rulemaking was \u201cin excess of statutory\u2026authority\u201d or \u201cwithout observance or procedure required by law.\u201d<\/p>\n<p>\u00a0<\/p>\n<p>Flyers rights were a major focus for the Transportation Department under Buttigieg, who also spearheaded several other initiatives. Under his leadership, the DOT created rules requiring <a href=\"https:\/\/www.flyertalk.com\/articles\/white-house-dot-look-to-require-fee-free-family-seating.html\">airlines to allow families to sit together<\/a> without additional seat selection fees, <a href=\"https:\/\/www.flyertalk.com\/articles\/new-dot-rules-require-refunds-for-cancelled-flights-junk-fees.html\">refund flyers for certain fees due<\/a> to flight cancellation, and began a <a href=\"https:\/\/www.flyertalk.com\/articles\/transportation-department-probes-big-four-loyalty-programs.html\">probe of the major airlines\u2019 loyalty programs<\/a>.<\/p>\n<p>\u00a0<\/p>\n<p>The move by the airlines is the second time they are trying to get the White House and courts to change regulations from the last administration. Airlines for America has also asked the Trump Administration to reconsider a proposed rule which would <a href=\"https:\/\/www.flyertalk.com\/articles\/airlines-push-trump-administration-to-rethink-controllable-delay-compensation.html\">make airlines pay passengers for a \u201ccontrollable\u201d flight delay<\/a>.<\/p>\n<\/p><\/div>\n\n","protected":false},"excerpt":{"rendered":"<p>Wheelchair Service in Airport Terminal.
