Edgar Hoover, who headed the agency and its forerunner under eight presidents. To anyone who has grown up on Mars\u2014as Elon Musk hopes people will in years to come\u2014this might seem extraordinary. After all, a Senate investigation of US intelligence agencies\u2014established on January 27, 1975\u2014found that Hoover had orchestrated lawbreaking on an industrial scale for decades, causing people to lose their jobs, their liberty, and, in some cases, their lives.<\/p>\n<p>On the face of it, President Trump has given Patel a <a href=\"https:\/\/www.whitehouse.gov\/remarks\/2025\/01\/the-inaugural-address\/\" target=\"_blank\" rel=\"noreferrer noopener\">brief<\/a> to prevent the FBI from being \u201cweaponized to persecute political opponents.\u201d But don\u2019t expect \u201cpolitical opponents\u201d to mean progressive movements. Trump has already made clear his intent to clamp down on Palestine solidarity action with an <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/additional-measures-to-combat-anti-semitism\/\" target=\"_blank\" rel=\"noreferrer noopener\">executive order<\/a> giving every department and agency of the federal government 60 days to \u201cidentify all civil and criminal authorities or actions\u2026that might be used to curb or combat anti-Semitism.\u201d<\/p>\n<p>Hoover would have relished the task, judging by what Senator Frank Church and his committee discovered when they lifted the lid on the FBI activities in 1975. Their report, published the following year, was a blockbuster running to 2,679 pages. It had been produced in the face of stiff resistance from Hoover\u2019s successor Clarence Kelley, who had <a href=\"https:\/\/archive.org\/details\/Church-Committee-Hearings-Volume6-FBI\/page\/n19\/mode\/2up\" target=\"_blank\" rel=\"noreferrer noopener\">refused to cooperate<\/a> for six months, causing \u201cgreat difficulties\u201d for Frederick Schwarz, the inquiry\u2019s chief counsel. When agreement was finally reached to give the Church Committee access to FBI files, Schwarz discovered that \u201csubstantial numbers of relevant, highly pertinent and sensitive Bureau documents\u201d had been destroyed after Hoover\u2019s death in 1972.<\/p>\n<p>What Church exposed was nonetheless truly remarkable. The final report revealed that the FBI had engaged not only in highly intrusive domestic surveillance but also in illegal break-ins, smear campaigns and covert operations, known as COINTELPRO, to disrupt groups deemed \u201csubversive.\u201d Among its findings were:<\/p>\n<ul class=\"wp-block-list\">\n<li>FBI headquarters alone developed more than 500,000 domestic intelligence files from 1939 to 1975, over and above many more at its field offices.<\/li>\n<li>In just eight sample cities, at least 130,000 private letters were opened and photographed by the FBI between 1940 and 1966.<\/li>\n<li>The FBI conducted hundreds of break-ins, known as \u201cblack bag jobs\u2019\u201d to plant microphones and steal items such as membership and mailing lists.<\/li>\n<li>At least 26,000 individuals were at one point catalogued by the FBI as \u201cto be rounded up in the event of a \u2018national emergency,\u2019\u201d using criteria that went beyond the law.<\/li>\n<li>The FBI routinely planted information about political activists in the press, in many cases with the aim of inciting violence against them.<\/li>\n<li>The FBI had thousands of informants on its payroll whose spying did not need a warrant and who would often be given a bonus for results, such as the $300 paid to William O\u2019Neill who provided a floor plan of the apartment where police shot dead the Black Panther activist Fred Hampton in his bed.<\/li>\n<li>The FBI had been spending twice as much on informant operations for \u201cinternal security\u201d as it did on organized crime.<\/li>\n<\/ul>\n<div id=\"current-issue-block_1d74f5c2c517ad47edd5c82550255913\" class=\"current-issue  float-l-w-2\">\n<h4 class=\"current-issue__title\">\n                    Current Issue<br \/>\n            <\/h4>\n<p>    <a href=\"https:\/\/www.thenation.com\/issue\/march-2025-issue\/\" class=\"current-issue__cover\"><br \/>\n        <img decoding=\"async\" src=\"https:\/\/www.thenation.com\/wp-content\/uploads\/2025\/02\/cover0325.jpg\" alt=\"Cover of March 2025 Issue\"\/><br \/>\n    <\/a><\/p>\n<\/div>\n<p>FBI mass surveillance failed, however, to discover much that was actually unlawful. From a sample of 675 cases, Schwartz\u2019s team found that only seven prosecutions were initiated\u2014of which just four led to convictions.<\/p>\n<p>Hoover\u2019s abuses did, however, have an enormous human impact through other channels. As subsequent academic studies have revealed, the intelligence the FBI generated was used, both officially and illicitly, in multiple other ways with devastating consequences for tens of thousands of people.<\/p>\n<p>According to David Caute in <em>The Great Fear<\/em>, FBI investigations led to 2,700 civilian dismissals and 12,000 resignations from government jobs under the Federal Loyalty Program and to the denial of clearance for 5,312 people under the Industrial Personnel Security Program. Seth Rosenfeld, author of <em>Subversives<\/em>, says that the FBI\u2019s secret \u201cResponsibilities Program\u201d planted derogatory information anonymously on at least 908 people, more than half of whom were fired or forced out of academic and local government jobs.<\/p>\n<p>As for the House un-American Activities Committee (HUAC), a University of Chicago study <a href=\"https:\/\/chicagounbound.uchicago.edu\/journal_articles\/8152\/\" target=\"_blank\" rel=\"noreferrer noopener\">found<\/a> that the intelligence provided by the FBI was used as ammunition in 172 hearings at which 3,079 witnesses placed into the public record 16,700 names of \u201cmisbehavers\u201d most of whom were then blacklisted in some way.<\/p>\n<div id=\"cta-block_5f9a14f98dc7a583a3150ce827641219\" class=\"cta float-l-w-2\">\n<p>Witnesses who refused to cooperate with HUAC would often be convicted of contempt of Congress and jailed. Across those targeted in different ways, hundreds ultimately suffered periods of incarceration\u2014for contempt, for proxy offences unrelated to their political views, or using the 1940 Smith Act outlawing <em>advocating<\/em> the forcible overthrow of the government, under which 145 people were indicted, of whom 108 were convicted and sentenced to a total of 418 years in prison.<\/p>\n<p>These US-wide developments were mirrored at a local level. In nearly every state, there were mini-HUACs, Smith Act replicas, oaths of allegiance, and blacklists. California\u2019s Un-American Activities Committee, for example, <a href=\"https:\/\/oac.cdlib.org\/findaid\/ark:\/13030\/ft9p3007qg\/admin\/#bioghist-1.3.3\" target=\"_blank\" rel=\"noreferrer noopener\">published<\/a> 15 reports and named in them some 20,000 people and organizations during its 30-year existence. In New York City, Caute says, the sustained purge of schools and colleges throughout the 1950s ended up ousting an estimated 379 teachers from their jobs.<\/p>\n<p>A central issue facing Church was whether to ban the FBI from investigating \u201cideas or associations\u201d completely. In a hearing on December 11, 1975, committee member Walter Mondale <a href=\"https:\/\/archive.org\/details\/Church-Committee-Hearings-Volume6-FBI\/page\/n331\/mode\/2up\" target=\"_blank\" rel=\"noreferrer noopener\">argued<\/a> that such investigations should happen only by exception and \u201cunder the severest and most closely defined standards,\u201d adding: \u201cIf we fail to do that, I am convinced that this committee has failed and that in another 50 years, there will be hearings just like this in which the excesses that we have uncovered will have been repeated.\u201d<\/p>\n<p>How right he was. Nearly all of Church\u2019s 96 recommendations have been either ditched, diluted or defied. The Smith Act has not been repealed. New guidelines requiring the FBI to have \u201cspecific and articulable facts\u201d concerning possible violence before targeting a political group were <a href=\"https:\/\/www.upi.com\/Archives\/1983\/03\/08\/Smith-approves-FBI-guidelines\/7027415947600\/\" target=\"_blank\" rel=\"noreferrer noopener\">replaced<\/a> as early as 1983 by a requirement only to have a \u201creasonable indication\u201d of such a threat and have been watered down even further since.<\/p>\n<section aria-hidden=\"true\" class=\"ad fullwidth-ad contained row position-relative ad-block alignfull \">\n            <!--Ad policy starts here--><br \/>\n                    <a href=\"http:\/\/www.thenation.com\/advertising-policy\" class=\"mid-ad-policy\">Ad Policy<\/a><br \/>\n                <!--Ad policy ends here--><\/p>\n<\/section>\n<p>A recommendation that judicial warrants must be obtained for surveillance, which led to Congress passing the Foreign Intelligence Surveillance Act (FISA) in 1978, mutated into a secret court <a href=\"https:\/\/www.wsj.com\/articles\/SB10001424127887324904004578535670310514616\" target=\"_blank\" rel=\"noreferrer noopener\">nodding through<\/a> virtually every request, including bulk authorizations since the act was amended in 2008. Meanwhile, the Senate Select Committee on Intelligence\u2014established in response to Church\u2019s call for \u201cintensified\u201d congressional oversight\u2014has proven hopelessly ineffective in living up to its brief.<\/p>\n<section id=\"popular-block_a9b463b1f753cd192451e297c629356d\" class=\"popular-articles\">\n<div class=\"swiper\">\n<p><h2>Popular<\/h2>\n<p>            <span class=\"swipe-msg\"><span class=\"sr-only\">\u201cswipe left below to view more authors\u201d<\/span>Swipe \u2192<\/span>\n        <\/p>\n<ol class=\"popular-articles__list\">\n<li class=\"popular-articles__list-item swiper-slide\">\n<\/li>\n<li class=\"popular-articles__list-item swiper-slide\">\n<\/li>\n<li class=\"popular-articles__list-item swiper-slide\">\n<\/li>\n<li class=\"popular-articles__list-item swiper-slide\">\n<\/li>\n<\/ol><\/div>\n<\/section>\n<p>While the Church Committee\u2019s exposure of past abuses was historic, the harsh reality is that it failed to produce a fundamental change in the modus operandi of US intelligence agencies. The FBI did not even make cosmetic changes. Not only is its headquarters still named after Hoover; its website has a tribute to his third in command, Cartha De Loach, who continued to work for the agency as a consultant after the Church inquiry and was <a href=\"https:\/\/www.fbi.gov\/news\/stories\/deke-deloach-adviser-to-j-edgar-hoover-dies-at-92\" target=\"_blank\" rel=\"noreferrer noopener\">hailed<\/a> when he died in 2013 by the then\u2013FBI Director Robert Mueller as someone who upheld the agency\u2019s \u201chighest ideals.\u201d<\/p>\n<p>At the heart of the problem is the question of whom the intelligence agencies deem \u201csubversive\u201d to the interests they serve. In the decade following Church, the FBI <a href=\"https:\/\/www.latimes.com\/archives\/la-xpm-1987-12-02-mn-17461-story.html\" target=\"_blank\" rel=\"noreferrer noopener\">targeted<\/a> groups campaigning against US military intervention in Central America. The American Civil Liberties Union <a href=\"https:\/\/assets.aclu.org\/live\/uploads\/document\/asset_upload_file893_29902.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">discovered<\/a> in 2008 that the FBI had been targeting anti-war groups such as the Thomas Merton Center and United for Peace and Justice. In recent years, it has mounted <a href=\"https:\/\/www.politico.com\/news\/2023\/05\/19\/fbi-surveillance-black-lives-matter-protesters-00097924\" target=\"_blank\" rel=\"noreferrer noopener\">surveillance<\/a> and <a href=\"https:\/\/theintercept.com\/2023\/08\/01\/fbi-infiltrate-activists-first-amendment\/\" target=\"_blank\" rel=\"noreferrer noopener\">covert<\/a> operations against racial justice activists. Now pro-Palestine protesters are top of the list.<\/p>\n<p>To make matters worse, the FBI now has 38,000 staff, compared to the 4,602 at the height of the witch hunt in 1950\u2014and access to technology beyond Hoover\u2019s wildest dreams. While Washington politicians worry about this force being weaponized against each other, the real issue for progressives is whether it is being used for repression of dissent.<\/p>\n<p>The lesson from Hoover\u2019s era is the classic adage that we must not stand by while they come for people whose views we don\u2019t wholly or even partially share. Hoover may have started with communists\u2014but social democrats and liberals soon found themselves caught in his net. It was not until the latter stages of the witch hunt that opposition to it took on a mass character, as happened with protests against HUAC hearings in <a href=\"https:\/\/considerthesourceny.org\/activity\/protest-against-un-american-activities-committee-1959\" target=\"_blank\" rel=\"noreferrer noopener\">San Juan<\/a> in 1959 and <a href=\"https:\/\/www.foundsf.org\/index.php?title=The_House_Un-American_Activities_Committee_(HUAC)_Hearing_and_Riot_of_1960\" target=\"_blank\" rel=\"noreferrer noopener\">San Francisco<\/a> in 1960. Those events were the beginning of the end for HUAC, though it would also take a <a href=\"https:\/\/www.thenation.com\/article\/archive\/breaking-43-years-silence-last-fbi-burglar-tells-story-her-years-underground\/\" target=\"_blank\" rel=\"noreferrer noopener\">burglary<\/a> in 1971 by seven brave civil rights activists to expose the way Hoover had turned to covert action as other weapons in his war on progressives were being denied him.<\/p>\n<p>Today, we should expect Trump and Patel to act fast and fiercely in cracking down on political dissent.
